s13 Rear ended

Hey guys, I just got rear ended this morning on my motorcycle while going to work on Camp Pen. By a marine who wasn't paying attention. My bike wasn't totaled or nothing, but I wont shift out of first gear, the clutch lever is gone, the back tire wobbles and all the plastic in the rear is gone. I.E license place holder! Im currently leaking fluid slowly underneath the bike, and I hear grinding when I was driving it into my garage! I suffered a bruised ego and a large contusion to my inner leg. My knee is unstable and I cant bear weight! I just woke up from the narcs they gave me for the pain! I just dropped over 1k on my bike due to someone running over it in Texas, does anyone know if my prev. accident will play a part in considering my bike totaled? Nada values my bike from 3500 to 4600. I owe approximate 3200 on the bike plus I have gap insurance. Opinions are needed thanks Lou! O ya if anyone knows of an awesome repair shop in the Oceanside area please hit me up!

I think you can sue his insurance company to get more money cause your hurt but its up to you

you might have some subframe damage if you were hit that hard from behind. If that is case, it will most likely be totaled.

Hey guys latest update, the progressive insurance rep came by and we talked. She offered me 1k for pain and inconvenience. They ave. my medical cost to be around 1800 give or take! But I told her it was to soon to sign any paper work due to the point im still swollen and limping around. Actually the pain as decreased slightly but the swelling is bigger. should i take the first offer or is this standered practice for the insurance company?

i wouldn't take that, i'd get a lawyer and sue his ass. you got hit on your bike and are hurt.

^^ i agree, get a lawyer and im sure he will get you a good amount of cash, especially cuz the more they get you the more they get for themselve

You have to remember lawyers get 33% of your settlement. Settlements are all dependent on property damage and bodily injury? The more injured you are means more medical bills, which usually means a bigger settlement.

Insurance pays "market value" for your property. They could care less about what you owe. Having the GAP insurance protects you from owing more than what your property is worth.

Don't sign anything with anyone until you have researched everything.

Your bike will be totalled. From what youre saying, it sounds like it will cost more to repair than replace.

I would contact your own insurance company and have them file and handle the claim for you.

If you really want to do this yourself, go to the doctors and really get checked out! You will need medical bills so you can claim it and make sure the other insurance co pays you out for a reasonable amount on your bike - do your research on the bikes worth.

Get a lawyer, insurance company WILL ALWAYS LOW BALL YOU.

I have tricare so I dont get the medical bill! The main thing I'm worried about is when the claim adjuster stops by he is only going to look at the plastic and the cosmetic shit! I know for a fact that I have internal damage to either the trans, clutch, or both! My bro is in school at MMI and I talked with his senior instructor and he told me pretty much what was wrong with my bike. He only used my descriptions on how it is running! It's a known fact u cant diagnose anything without laying your hands on the object but he knows what usually brakes when a bike is rear ended at 10-25 mph! I would like to settle this fast do to the point i have an upcoming deployment and a lot of field time scheduled! I hope they dont drop me from my deplyoment this fall, i need the money to help build my house!

Tough call. Id say you give the adjuster a reasonable figure, be firm and see what happens. If they decline, then decide if you need a lawyer.

If you get a lawyer, it may be dragged out due to counter offers and then you would pay your lawyer fees too.... Handling this yourself is the quickest way, just make sure you are knowledgeable about this situation and the adjuster cant screw you over...

go to as many doctors' appointments as possible- document everything. take photos of swelling, bruises, everything! call around to a bunch of lawyers and see what they say. you can sometimes even find reviews of individual lawyers online.... their insurance company will try to buy you out quick. don't take their lowball offers.

well if the back tire is wobbling, and you got rear ended, your insurance company will probably just total out the bike. my ducati got totalled because a rim was scratched, the tank was scratched the handlebar bent, and some othere minor details. get a laywer and sue... .its the california way... besides the marine that hit you shouldn't have been texting...
