Going to put my turbo back on this morning, pick it up and the waste gate actuator flag falls out... wtf how does this break? There are no marks on it or my turbo elbow to suggest it was making contact. It looks like this should be press fit together and the whole level assembly does not look like it can be serviced. Has this happened to anyone else? Can I fix this? I was thinking of putting a washer on it and welding but I'm not sure if that is wise.

My turbo is 2 years old so warranty I'm betting will be difficult.

Probably just a failure in the metal. Cap the hole and weld it and run external wastegate.

I think I will try welding a washer onto the end of it before that. Capping the hole will be difficult and I would need a new manifold for to go with an external.

if there wasnt some sort of e-clip that held it on, just get someone to weld the flapper to the arm. but weld the flapper with the wastegate in the closed position so the chance of it being crooked when you weld is reduced. doesnt seem like a terrible fix.

This is a common issue with the Tomei turbo.
I've read a few people had the same issue you are experiencing.

^ I was some post's on evo forums of some people having the same issue. This turbo has had it's share of issues, I had to return it on warranty within a month of getting for leaking seals. I'll admit the warranty process went smooth, tomei paid for all the shipping but upsetting when you think your purchasing a quality part and it took 2 weeks.

Either way I decided to fix this shit on my own and not bother trying warranty again.

I put a thread on the flap then welded a nut on. It is still free to move and is likely stronger than what I started with.
