Once you installed the turbo you made your acceptance pretty concrete. There is nothing you can do, and no way you can get your money back. Unless the seller is retarded.

It's up to the buyer to inspect goods on arrival. If you contacted him right away you could have done something about it.

Yeah, but I'm pretty sure not all of us shop at Nordstrom where we could buy a $50 shirt (which cost $5 to make), wear it for 3 years, and still get an exchange.

You're buying used parts, in which most are labeled "as-is" basis and it's up to you to check within a reasonable time.

It's kinda like me buying a 3 button mouse because it's says "gaming mouse" on the cover, but what I really want was a 3-button mouse that says "gaming mouse" with a middle scroll. If I come back to Fry's Electronics 1 year later, you think they will give me an exchange with receipt?

Not related at all. In both of those situations the seller did nothing wrong. In this case, I was told the item was something it's not which was wrong on the sellers part. Let's say you buy a cat that's supposed to be spayed and then a year later you find your cat is pregnant. You'd go back to the store and ask them to spay the cat, wouldn't you? All I want is what was supposed to be mine in the first place which is the same in this case. The difference is that I was dealing with a private party and not a store which has receipts/records making the transaction more legitimate. The fact I was dealing with a private party put some responsibility on my shoulders to verify the item is correct, yes, but the seller also has a responsibility to provide the correct item.

I'm done arguing against why I should not be able to seek a solution to this but if anyone has a positive suggestion; I'm all ears.

YOU DIDN'T NOTICE THE DIFFERENCE IN BOOST/LAG/POWER?

you said you had a ball bearing t28.
and this is a t25 journal.
That's like chocolate and shit.

So i walked into a candy store asking the cashier to sell me a milk chocolate bar laying behind the counter. He hands me the chocolate bar that was supposed to be the regular milk bar but it was actually a chocolate bar with peanuts in it. I bought it with out reading the huge print on the wrapper that says peanuts and stood their and ate the bar in front of him. After i got done eating the whole chocolate bar I realized that it contains peanuts. I told the cashier i want a refund and the right chocolate bar because you handed me the wrong one.

So whose at fault?

I think both

But how should this be resolved?

So what would happen when he says he sent you the right turbo, its been over a year, YOU'RE THE ONE TRYING TO SCAM HIM, claiming that he sent you a different turbo.

As a seller, if I sold you something, sent you the part, never heard anything from you for over a year, you even installed/ran it for that long and you're now claiming I gave you the wrong part, I'd tell you to eat a dick. That money is long gone. Go sell it yourself and maybe get some of your money back that way.

Gotta love Zilvia sometimes. I make a valid point against your argument and this is what you come back with? Only an immature person losing an argument resorts to petty insults.

Garrett Version S15 Turbo : GT2560R - SR20DET

The s15 turbo is the GT2560 also... The difference is that my old one (s15 GT2560) was ball bearing while the new one (s14 GT2560) is journal. Power output is similar but the s15 one spools a good bit faster. Due to my new one spooling slower, it felt like it could have been a GT2871. Also, I haven't ridden in many 300whp+ cars so I didn't know what to expect. I can go on with more reasons but that's the jist of it.

same shit happened to me about a yr and a half ago. bought q45's with rotors. guy said the rotors and calipers were good. went to have the rotors turned, shop told me they didn't have enough life left. i only paid like 5-10$ extra for them, but that's still bullshit.

as for the calipers, i had to find out they were blown the hard way. put them on with new pads and rotors and everything, and it started leaking brake fluid. shit was smoking.

Honestly man I don't think there is anything you can do besides contacting the seller and hoping he's rich or extremely nice.
It could have been an honest mistake tho like he could have been told the wrong information when he got it and passed it along to you.

I bought "2 rear TT 300zx rims" from a guy local to me and when i got them home I put them on my car just to see how they fit.

Thats when I realized they were actually the fronts, not the rears.

I called him up that day and let him know and he apologized saying he was told they were TT rears.
He offered me my money back or asked me how much I would want back to keep them.
He was really cool about it.
Always depends on the person your dealing with, but if I had waited a year to tell him about it, I doubt he would have really cared.

This still isn't completely accurate to my situation. In my situation, I didn't eat the candy bar (turbo). I still have the candy bar (turbo) and can give it back to the seller in exchange for what was supposed to get. Your example would work if I had ruined the turbo and then tried to take it back. The turbo still works the same as when I bought it so this is not the case.

You raise a good point. I had considered the thought that threatening to make his name public would make him consider righting his wrong. But I did not consider the fact that he might lie and spread word that I'm trying to scam him. Then it's a big he said/she said on the internet and both of our reputations are damaged.

Internet reputation...who really gives a flying fuck about it? If start giving me bad reviews, I could fucking care less. You've been here no more than a year so why would we side with noob if the seller is really "reputable". You're not part of the cool kids so nobody would give a fuck. At this point, you have no case. Move on with your life, let it be a lesson learned on buying used parts. There's a reason folks only prefer buying brand new parts from reputable shops.

One strange thing about it was that he called it a GT2871rs instead of a GT2871r so I think it's likely he may not have know what he was talking about. He has a fairly large post count so I doubt he would want to intentionally ruin that account. He's now trying to sell a car on it so I'd imagine his account's reputation is pretty important to him.

I think I'll leave this open for a bit and see if there are any more suggestions then message him this weekend.

I've been on the other site longer. Even though I am a "noob" having someone out there speaking against him would still make people think twice about buying from him. If he's using that account to sell things then I'd say his "internet reputation" is pretty important to him because if he starts building a bad rep, he starts losing money.

My point is, there are still options in talking with him... I came here for advice in how to go about doing that.

I also would not expect a full refund considering I got a year of use out of it. Perhaps he could buy it back from me for $600 or so. (I paid $750)

dude...

DUDE! what the fuck.. you're an idiot.

you dont get shit, regardless if the seller made a mistake or not - you're a few sandwiches short of a picnic and a year short of a case. its been a fucking year, you've used whatever turbo you have and its OVER.

the irony behind all this, is you make this post and we're supposed to assume that you're 100% legit. I mean, why cant we assume that you arent trying to pull a fast one and now trying to send that turbo back? Makes no sense. Whatever claim you're trying to claim is moot. Whatever turbo you have is what you OWN, the end.

i dont get some people... fucking retarded.

In the end, you're fucked unless the seller is nice enough that he will give you ANY REFUND/exchange.

I'd have to disagree that it's over. I still have the option of talking to the seller and seeing if there's anything at all he's willing to do. Maybe he's a good guy and it really was just a mistake. Worth trying at least...

There's nothing you can really do.

Suggestions on what to say when I message him and how to go about confronting him.

You're pretty dense...you're assed out, nothing you can do about it. You can try to ruin his reputation but if people wants to buy shit from him, they will continue to do so. One bad feedback wont mean jack shit. Then, he could still have the rebutal that he sent you the right turbo and now you're claiming to have been given the wrong turbo a whole fucking year later. Who would regular joe-schemoe believe, specially since he wants to buy something from the guy?

You know what, I'll bite...I'm curious now who this person is now...

I'm gonna. What angle do I take tho?

I could say, "Hey listen asshole, I want what I was supposed to get!! "
Or I could say, "Unfortunately I think you sent me the wrong turbo a while ago and I just noticed it. Perhaps you can help make things right"

There are two extreme angles I can attack it from and a bunch in-between.

If there are two stores selling the same thing at the same price but one store has some random guy out front yelling about how the store screwed him over, who are you more likely to buy from? You don't know that guy outside the store but he's still gonna make the store look bad.

I realize it's not much but the "bad mark on your rep" card is really all I have left to play at this point if he winds up not being a nice guy.

This leaves me you did not bother to message him yet or if you did, wait until he replies rather than waiting for advice from other users. Majority of us or not all will say you're fucked, it's been way to long to do anything, have a friend shoot an arrow to your knee, go to court, lesson learned, and/or you're screwed.

Edit: I noticed the 3 posts before I finished typing this and I was right about him not sending a message, LOL!

You need to go at it like this.

Hey man I bought this turbo from you a year ago and I just realized its the wrong one.
Is there anyway you would take this turbo back for/toward the one I was suppusto get?
Obviously you need to tell him you've been using it, but its still in good condition.

Then add whatever you want but dont be a dick on the first message lol.
If you come at him calm theres better chance for a peaceful resolution.

What does it matter that I didn't send him a message yet? I said I would contact him shortly and I plan on doing that still. Forgive me if your definition of shortly is within a few hours... I was planning on messaging him sometime this weekend.

Also, he's not a member on Zilvia (at least I don't think he is) so there goes your theory of me waiting for him to reply to this thread.

Yeah, I definitely wouldn't be an ass right off the bat. Depending on how he replies to the initial nice message, the plan may change tho.
