Yes its the responsibility of the towing company to know how to tow an illegally parked car. all you have to do is look at the axels. There are probably stickers on the window that says awd or something like all the subarus. Of all the tow truck drivers i've ever talked to, they all knew something about cars.

Wow, I dont think theres any liable on the tow company since he was parked illegally to be honest. Maybe I'm wrong. If he can afford that car and wanted to park like a douche then he gets what he gets.

you do realize these are the same tow companies that pick up your car when you call triple A. Can the same thing be said if you were towing your car because there was an issue with the engine? you wouldn;t need to tow your car if your engine wasn't shitty.
can you say the same thing the tow truck driver couldn't tow the car so he broke all the windows on the car to put the ebrake down? I mean techincally none of the windows would have been broken if he didn't park illegally. The consequences for parking illegally is a fine. Not to break your car. Although i'd be all for it. Oh this is a good one How about rolling up to one of those mobile smog check's in your crispy new Carrera GT but you can't make it up the ramps because your car is too low from the factory. Do they forcefully make you drive up the ramp cracking your dry carbon bumper that cost 15k? Because its your fault that you bought a car that was too low. |

If the towing company can't determine the drive-train,
then I seriously doubt they're qualified to do any towing at all. Yet another reason NOT to drive in NYC (have no idea how ppl find parking there). |

Those are good questions.
Who would be liable for the damages in a situation like this? I can't imagine the individual being shafted. I also can't imagine tow companies being entirely immune to mistakes like this. |

I say it's the towing company's fault. Yes the owner probably did parked there illegally, but the towing company is still in fault for any damages caused. It doesnt matter if the car was being towed for whatever reason, because it will be in the possession of the towing company, thus they are liable for any scratch, dent, dings, and such. You need reasonable means of towing regardless of legal issues. IE, you can't just ram a car out if it's stuck and you can't force tow an AWD car. As long as it's on the lift, they such take their sweet time to get it dolly'ed up.

kind of reminds me of how impound lots are not responsible for theft/missing items out of your car , then who else did it? Its your fault you left your ipod in the glove box and its now missing.. lol

all you have to think about is, is it the tow companys job to tow a car: yes,
is it the tow companys fault to screw your poo up?: no they should know how to tow a damn car THATS IT, ITS THEIR JOB!

They didnt tow it for illegal parking NYC doesnt do that, he must of had prior parking tickets and never paid for them that's why they towed it. NYC will be liable for all the damage caused to that car unless the damage was present before it was towed.

This is a really common thing, it's not like some specialized GT-R only procedure they wouldn't have known about. It's not like they just destroy every AWD car they tow, they must generally have some procedure to determine how to tow that was, in this case, ignored.
Guy shouldn't even have brought that shit into Manhattan though. Was bound to get destroyed one way or another.
