dont they have cameras around the intersection? I know in vegas they do maybe you can get your lawyer to get some video or something maybe search youtube might find something on there.

Do all that and then you can talk to me.

Have you any idea how many insurance cases I've worked on with just about every major auto insurer in the US?

Unless you're aznpoopy or OptionZero, and maybe a few others, you wouldn't understand how tough insurance litigation is.

You need to get a more competent attorney.

Just general info below to help you.

1. Your case is civil (insurance claim is based on tort/civil rules). The arrest is criminal. One has nothing to do with the other, especially if she pleads no contest to the criminal charge(s). A lot of lay people get confused and think that if there are criminal charges in an accident, then they automatically win the civil case.

2. Don't hang your hat on the police coming through with criminal charges to help your civil case. The most you can use is facts obtained by the police, and even then keep in mind that cops collect evidence to prosecute. They're not trying to help your cause. Keep that in mind. So don't be surprised if the police ignore things that may be helpful or crucial to your case.

3. Yes, you have to share evidence with opposing counsel, but you do NOT have to share any evidence you don't intend to use in trial. You need to bring all the facts to your attorney and decide which pieces to use. Then you only share those pieces with the other side.

You do not and should not share every single piece of evidence if you don't feel it's relevant to the case because it can give the other party a competitive advantage over you. You need to talk to your attorney about this.

4. You do not need a witness to have a good case. The forensics should be more than enough. I've gotten win with less evidence. If your attorney is afraid to proceed without witnesses then you need a new attorney.

You should have an open and shut case for any competent attorney. Good luck.

spoken for truth. Judges in traffic cases in Los Angeles do not care if you can possibly prove the cop wrong. In fact they will rule based on the cops testimony. Why? This is quoted directly from a judge to me " my schedule is way to busy and the Police are more reputable witness's in my opinion"

So in other words what ever Gccvi6 says it does not fly in LA traffic courts. Like Eric said above, the faster the case is done the happier they are. So they tend to listen to the cops and DA and disregard the defendant and or their counsel.

Cops lie in court here and they win cases. I have seen it first hand.

traffic court = state v defendant. cali prosecutes crazy lady for driving like retard. OP is a witness at best and has virtually NO stake in the case.

civil court = op v crazy lady. OP tries to recover losses caused by crazy lady hitting him. there is no DA / prosecutor involved because the state is not involved with the case.

I would have went after the police with a lawyer.

Fuck that. Nobody will EVER screw me like that. I'd go apeshit the instant i heard "standard procedure when there is no serious injuries". Fuck that. Damage to your personal property by someone elses negligent hands i would have pressed charges right there on the scene. Contact insurance company, yeah. Not having a report? Damn.

Start puting the poor, welfare abusing gang banging basterards in concentration camps so productive members of society can benefit from their tax dollars.

im sorry about your loss. i had a similiar sitchuation, i was involved in an accident with some one hitting me at 60 MPH thankfully it was an old pick up i got for free from a friend.. but the driver that hit me had no lisence, no insurance, and i wasn't hurt some how but police never filed a report. we bugged them and eventually had my insurance company bother the CHP about the report and they filed one. but it never went anywhere. the people got off scotch free mainly because technically ( i was at fault ) but my point is the worst things happen to the best people. you lost something dear to you but you may gain something out of it. i wish you luck
