is this a dystopia yet? seriously look at this new police toy v. phone scanner thing

so seriously, if we were looking to draw the line somewhere, this would probably be a good spot, right? scanning peoples' phones without probable cause. fuck everything about this.

ACLU: Michigan cops stealing drivers' phone data | Crave - CNET

Quote:
The Michigan State Police have started using handheld machines called "extraction devices" to download personal information from motorists they pull over, even if they're not suspected of any crime. Naturally, the ACLU has a problem with this.
The devices, sold by a company called Cellebrite, can download text messages, photos, video, and even GPS data from most brands of cell phones. The handheld machines have various interfaces to work with different models and can even bypass security passwords and access some information.
The problem as the ACLU sees it, is that accessing a citizen's private phone information when there's no probable cause creates a violation of the Constitution's 4th Amendment, which protects us against unreasonable searches and seizures.
To that end, it's petitioning the MSP to turn over information about its use of the devices under the Freedom of Information Act. The MSP said it's happy to comply, that is, if the ACLU provides them with a processing fee in excess of $500,000. That's more than $100,000 for each of the five devices the MSP says it has in use.
if you're wondering why i post so many negative stories about the police, it's because the police keep doing horrible things.

I'm more concerned with your lack of punctuation lately.

In all seriousness though, I would sooner smash my phone than hand it over.

Pry my smart phone from my cold dead hands.

Probable cause is easy. Invasion of privacy is another thing.

Who actually said they have used it on someone who hasn't "commited" a crime?..or for anyone who is locked up. Their "personal" belongings then become part of an investigation, of course depending on the crime/offense.

My take on this is, its silly on one hand and just another tool for doing work on the another. Because let's not forget about all the smart phones that have apps for police scanner. Or the fact that every cell phone is a camara/video camara. Point is police use their "tools" and so does the general public.

100% agree . i could UNDERSTAND if it was only to be used if someone was suspected of a crime or matched the description of someone in a crime. but its horrendous that they are blatantly violating peoples privacy and ESSENTIALLY performing an illegal search everytime they scan a phone.

however, to counter that, couldn't you just throw your phone in your glove box or center console everytime you get pulled over...?

If they really wanted your phone records and text messages, they can get them straight from the phone company. Technically, they legally can search your phone for 'no reason'. The PATRIOT Act is still in affect.

But I'm sure every police cruiser isn't flying around with these things taking everyone's personal information off of their phones for the fuck of it. Granted, they could probably get your credit card information if they really wanted to, and there are shady cops out there, but if they would even bother to use this thing- it would probably be in support of a drug/prostitution sting or for looking for OTHER people's personal information because they suspect you of identity theft.

Really, the likely-hood of you being arrested or even getting a ticket for anything that's on your phone, outside of some serious felony, is slim to none. Cops don't give a shit that much. What are they going to do, see pictures of your friends smoking pot? They don't care about that crap.

Do you know why I pulled you over?

Is it because I'm drunk driving officer?

No, I want to scan your smart phone.

Uploaded a virus/self destruct mode to your phone and as soon as anything tries to hack it it turn into a brick and lock up/brick the other device. Or better yet it'll explode upon communication to the other device.

you could do that but it needs to be "locked" technically so they would have to get a search warrant. but i like the other guys opinion, be ready to record.

Kind of reminds me, They had a story in the local news paper about how the town cops had gotten a new camera that they strap onto a cruiser to take pictures or you licence plate so they can find out if you have any warrants, valid registration, or valid license.

The thing that bugs me is that we have a huge federal/state/town deficit and they are buying fucking toys, they can type in the goddamn plate number and look it up.

FYI man, alright. You could sit at home, and do like absolutely nothing, and your name goes through like 17 computers a day. 1984? Yeah right, man. That's a typo. Orwell is here now. He's livin' large. We have no names, man. No names. We are nameless!

some rich kid from the expensive part of town told me the cops there have this setup where they cruise through parking lots and they can automatically check every license plate they pass, and if any throw up a red flag it's party time. i can't show my work, you just reminded me of that conversation.

shit i double posted. my bad bros.

why not, i say...this would help the efficiency of the judicial system by leaps and bounds...no more lying felons/criminals that waste tax payers' money in court...no more crooked cops that say one thing, but raped another...
