View Full Version : How long would you wait for a business to give you your $1890 refund?

I've started this whole ordeal in August when canceling my order and haven't gotten the money back yet. I've been calling almost daily now asking for it and keep getting excuses saying they've mailed it out already and apparently my check keeps getting lost in the mail, even the ""insured"" mail they sent out, so they have to send new ones out. They charged my card before the item was even shipped out and had my order canceled and been waiting since. Of course I've been giving them phone calls; started out weekly but now is a daily thing. Brian, the guy who seems to be in charge of everything, becomes elusive and most of the time out of the building when I call. I leave my number and never get a call back. I consider myself a very patient man but 7 months going on 8 and still haven't gotten the refund. It's not little money either, Driftspeed owes me $1890 and it's getting rediculous with all their excuses and delays.
I'll keep everybody updated on the situation and give you a better story everything if things aren't resolved soon.

max i would wait is 1 month, call up your credit card company and get them to reverse the transaction if its not too late to do so

i dont think the credit card company will do it now after 8 months. ur suppose to do that within i believe 30 days most is 60.
call them and say ur gonna report them to the FBI or some shit haha then they will start haulin ass to get ur money back. mail does not take 8 montsh to get to you. and i HIGHLY doubt a company will keep sending out 1890 checks like it was nothing, they might as well go broke. tell him u never wanted a check and have them credit back to ur account directly or use paypal

They changed owners and can't refund it to the card so they have to do it by cashiers check. I know some guys on that board deal with them in person, maybe they can help me out, otherwise I'll have to get a lawyer which is my last resort.

Are they saying they used US Postal Service to send you an insured check? If they are saying they are using them to mail the check, but never really sending it in an attempt to not refund you and take your cash, they might be committing mail fraud. It's really common for shops these days to 'borrow from Peter to pay Paul' They'll take your money and order a bunch of other stuff (not yours mind you) and if they can't move it and are stuck with dead stock, they wind up in a pickle like this where someone is missing money.
One way or another, there is more to this story, or they are trying to totally rip you off.

I sure as hell wouldn't wait 8 months. I agree you are a patient man. I think you should call them with some FBI threats as was suggested and then possibly go with the lawyer but like you said that should be a last resort. At least now I know to stay away from those guys.

if youre in a different state than them, its fraud.

This is Driftspeed from the Westminster, CA area. I'm too far to take a trip over there in the near future so the most I can ask for is someone to help me out as of now.
I'm doing a few searches and it seems like they're been doing this whole scenerio over and over. I just want my damn money back.

1 month and the amount of time it'd take me to physically get there and demand it back unless i could get alocal lawyer to scare em bad.

u should tell the Bureau about this..... if u go to court about this.... u should charge them interste cause it was charged on to ur credit card..... damn reading this just pisses me off that people can do that...... Drift Speed just return the freaking money u bastard......

Yeah, I'd take them to civil court if you can and charge them interest. Talk to a lawyer too.

meeh 2weeks but i hoestly 1 week.... then i ask to talk to the manager.... or owner whomever... then if i dont get it the following week report report report... and get a lawyer and sue for 5k =) thats theyre bad for fukn up.....

5 business days is enough to piss me off. I would have flown out and met someone personally after two weeks of that chit. You need to press the issue using every possible outlet you can to ensure you get paid back, but it's been so long it's going to be hard. Hopefully you've kept hard copies of every piece of correspondence.

Always document everything. I've only been screwed once. Fool me once, shame on me, fool me twice... ya know?
8months... it's going to be a hard uphill battle to get your money back. But you're FAR past the being polite stage, you should've made the plung to seek out legal advice about 4 months ago. Whatever you do DO NOT GIVE UP! If you prove them right, they'll know they can get away with it and do it to someone else, odds are, you're not the first.

go there and demand the money, meet them in person that way they wont have a excuse that their checks got lost in the mail..
if they are not willing get a local police officer from that area and explain to them the situation, most likely a officer will tell you what kind of legal recourse you can attempt "press charges on his ass...".

just pay a lawyer/paralegal to write them a threatening letter, send it registered mail. You'd be surprised how far this goes in a company taking you seriously

8 Months?!? If I didn't get my money back within 30 days, 45 days MAX I would reverse the charges... without any warning.

Not as long as you apparently. I think the max a credit card company will let you cancel charges is 3 months, after that you are out of luck. After you have requested a refund, I would say it should take no longer than 5 business days to get to you. Sounds like you are getting taken for a ride. Good Luck.

I would be on there as like a fly on sh*t. I would call so frequently they would recognize my calling patterns and every employee would get to know me on a personal basis from jumping down there throat so often/frequently.

I think statute of limitations on stuff like that is 1-2 years.
Take their asses to small claims. It's easy and the best way to do it to get your money back. Don't do anything stupid just go through the legal system
