Ok on november 27, 2004 i was issued a wreckless driving ticket doing 83/55 and also improper exhaust. i deserve the ticket and am not excusing my actions but here is my question
on the ticket he put my court date as jan. 27, 2004.... seeing the fact that the date he put down has come and gone do you think that this is going to be the loophole i need to get outta this ticket?
I've heard some people say that it's a legal document and that everything on it has to be precise and others have told me that it doesnt matter and i'm fuxored...
thanks
I dunno, he meant 2005 probably, id go down there just incase, it might be in your luck.
i got a reckless driving ticket back in september for a donut
he put a date on it, i went to the juvenile court on that date, and they said they held traffic courts on wednesdays, cop put it on a thursday, so she sent me to another clerk and she said we were supposed to get a letter in the mail verifying something around that date or something, i havnt been called or anything, and my insurance has stayed the same, so i scored, that was rather unrelated though.

Your going to court, that minor technicality will not be thrown out. If you call the court in a week or so they will have processed the ticket by then and probably changed the date to 2005 like it should be. You could always (should) ask a lawyer about this, but I'd be pretty surprised to see it get thrown out because of that.

It won't get thrown out because of that. They keep logs on everytime they query your plates and that info in included in their daily reports.

fuckin shit man....that means the s14 is still up for sale...
Actually, it can (and probably would) get thrown out.
The ticketing officer is responsible for citing accurate
time and date, and I know two others who have had
tickets voided because of that exact same scenario.
They both used attorneys to do it though - so it
depends on how much it's worth it to you.
Personally, I'd pay the fine and take it as a well-deserved
lesson - there's a place to break the speed limits and
it's not in public. Good for you for saying you deserved
it though. :)

Threadstarter, don't get your hopes up. Always aim low and you won't get reamed when bad things happen.

the only reason i seriously wanna get it thrown out is because i wanna keep my ride... if i get this wreckless ticket then i can keep my ride....if i dont and probably wont have a drivers liscense then i'd be fuxored....

Check the Vehicle Codes for your state. It will give an explaination for the violation along with the punishment. Most first violations will not revoke your license unless there are special circumstances, (you were racing, you're underage, your driving was endangering the lives of others, etc). The vehicle code for your state will explain specifically what can & cannot happen. If you are already on probation for other moving violations, then you are probably gonna be screwed ESPECIALLY if you have to appear before the same judge that put you on probation the first time.
It's possible to beat the rap, but you're gonna have to do some research & find the answers yourself...No guarantees though...
Good luck!!

Depending on the state, an error like that doesn't matter. In Cali, its a big thing, in NJ, they just amend the ticket. Case law in nj has even held that if an officer forgets to sign the ticket, as long as he testifies that he can identify the driver, its still valid. If you don't go, chances are you'll get a notice in the mail with a rescheduled court date.
Oh, and its RECKLESS Driving, not Wreckless.

You don't have plea bargaining in VA? This is your RIGHT as a CITIZEN of the US of A.
In NY, you plead NOT GUILTY on the back of the ticket.
Do not ask for a supporting deposition.
Send it in.
Get a letter back with your court date.
Go to court.
Approach law enforcement officer that issued the ticket.
Explain to him/her the severity of your situation and ask if there is a lesser charge that you can plead GUILTY to: for instance, 68/55 (no reckless driving) and improper exhaust.
If the law enforcement officer refuses to deal, ask the court for a postponement and come back with a lawyer. Reckless driving is no joke.
Even if law enforcement doesn't always remember it, tickets are NOT PERSONAL. It's an unofficial tax levied on the middle-class by the state.
I like to picture the state trooper barracks just before they head out for a day of ticket writing: "Remember gentlemen, the governor of our state has asked that we increase revenue by 5% this month. To that end, I'd like to remind you that the top ticket writer will be awarded a set of steak knives and an all-inclusive trip to Cancun. Trooper Soandso is currently the top contender for this month's prize. There are 15 days left to put your name on the top of the list. Go forth gents, make money!"

^^^ I don't know about VA, but in NC, we do those such dealings with the DA, and they will generally do it if you pay a fine and the cost of court, reducing the ticket to improper equipment or some minor shit like that, as long as you are not violating a DUI or some other prayer for judgement... Of course, having a lawyer see you through some shit like this is the best method and in my case it has been ESPECIALLY cool if that lawyer is the former district court judge in your county and is generally well liked.

Yeh, I had a lawyer deal with my ticket here in NC. It's the best way to go. I got a ticket for 22 over and I got off with just having to pay the lawyer (court fees were refunded and everything).

I got a wreckless driving ticket some years back... Here is my advice, dress nice. shirt and tie, belt, slacks, nice shoes. be well groomed, give a sob story how your young and work hard ect ect ect, upstanding church member, (if your not and your going to feel guilty for this, work extra hard one day at work, and go to church that sunday...lol) pleaed not guilty, say you were not aware of the fact that you were going so fast, hell say you havent drove the car in a long time and that it goes faster than it feels ect ect ect, be very creative here son and you may come out with some luck, i got mine dropped to a speeding ticket of the highest speed possible at the time, i was going about the same speed you were doing as well. hope this helps. good luck, hope all works out. as for the wrong date on the ticket, go see a lawer and ask them about it, it dosent cost anything to just go talk to one.

Hey, yea, that's a minor detail and it will not be thrown out for that. Was it a state trooper or something, because they are pretty punctual on showing up. Maybe he made the same error in his schedule and won't show up! That'll be the best if it happens.
Your lawyer will probably try to get that ticket reduced to 69 in a 55 getting rid of the Reckless Driving part of the ticket. Now to my knowledge once its 14 or below, no points acrue on your license, but you will get a few insurance points. Anything is better than Reckless driving on your driving history.
Going up to say not guilty for 88 in a 55 is way better than mine :p I had to say not guilty to a 101 in a 60, right as I crossed the VA/NC border :) Too bad, I was in a ticket income dependent county.

in CA you would probably get that thrown out pretty easily.
