View Full Version : Finally got a REF ticket, but there's a twist...

1990 S13 with a redtop SR20

Back in 2005 or so, I had Butthurty Mcbutthurt (******* on many forums) take care of my smog test. The car is registered in Needles CA 92363 (not my home address). My car has not required a smog check once since then. I believe the car is registered in a smog exempt zone. I renew my reg at AAA, pay the fee, get my tags, done.

Today I got pulled over by Orange County Sheriff, was told to comply with an "inspection" ("not a search" I was told after I said I do not consent to a search of my vehicle). I was presented with some paper work listing the CVC's and a threat of a misdemeanor charge for non compliance. So I popped my hood, and 30 min later I have a Ref ticket. Officer took photos of my engine bay, I played dumb to all his questions.

The officer NEVER once asked to look at my registration. He asked for my drivers license and proof of insurance.

What are my options ? Can I prove my car is smog exempt ? If so, how ?(who would I speak to about this ?, what paper work would need to be produced by me or produced for me ?, would presenting this paper work to a judge get the ticket thrown out ?)

Hypothetically speaking, if my CA registration is currently "falsified", would pursuing this even be worth my time ? Would something like that come into question when fighting this ticket in court ?

your car is NOT smog exempt. all the smog laws still apply, certain regions of the state only require smog at transfer of title. all the same emissions laws still apply, you just arent required to submit to the biannual smog testing.

pay the fine, go on about your business.

and good job posting your smog dudes name online. i'm sure he'll be thrilled when he gets massive fines and charged with felonies.

His name and screen name are posted hundreds of times, on many forums. I'm not posting anything new by doing that. Besides, he hasn't been active online for 6 or 7 years. Chances are he already got busted.

What about the corrections to the vehicle ? I thought both the fine and corrections were required to resolve this ticket.

Negative. The first one you can just pay the fine without having to prove that you made any corrections. The second one, you MUST visit the ref.
