Seller's PayPal Dispute Statement;

Buyer contacted me via Text, inquiring about an item I had for sale on the message board on www.northwestnissans.comHe offered me a price of $130 and I countered at $140. He requested pictures of the item and I sent him the picture. I sold the buyer an electronic digital volt meter aka EDVM for short for the negotiated price of $154 shipped, a link to for sale thread can be provided it necessary. I purchased the EDVM brand new from the website POWERED BY MAX (http://www.poweredbymax.net). The link to the item can provided if necessary as well. The item was purchased and never installed or used, let alone taken out of the packaging that I received it in. After receiving photo of the item for sale, the buyer sent the payment. I shipped the item out the following day via USPS priority mail: 03102640000230925388 that is the tracking number. Upon receiving the item, the buyer was unhappy and said that the package was missing a sensor. However what I shipped was everything that I received when purchased from the original website. Nevertheless, the buyer requested a refund which I was happy to provide upon return of the items. The buyer shipped the item back, without confirming my preferred address and I have not received the item though the tracking number says it is delivered. Buyer is insisting that he sent the correct item to the correct address. I refuse to reimburse the buyer his refund without the property - he should have sent with signature confirmation and to the confirmed address. Buyer has threatened via text to come to my house and I will not accept that. I have been reasonable and in touch.


Before any transaction had taken place, buyer (Me) had verified with seller that it had both sensors via text “Just to make sure, it comes with oil pressure, and water temp senders? Sorry just wanna make sure haha”. The seller reassures the buyer all the appropriate items are included “Yup! That’s what I got ordered it ---(next text message) When I*”

Seller claims to have “never installed or used, let alone taken out of the packaging that I received it in.” in his paypal dispute comment contradicting his claims in his classified ads on 2 web sites. Image 1 and 2. Images and links are provided in Zilvia. Seller states in classifieds ads “all I did was put some teflon tape on the threads of the sensors.” which necessitates removing items from their box, clearly contradicting paypal dispute claim of “let alone taken out of the packaging that I received it in”. He also clearly states sensor"S", as plural.

In addition, seller agreed via text message “Once I get the confirmation number you will get your refund” please see image #3 in Zilvia. Once confirmation number is sent, seller refuses refund and changes terms of agreement. Please note image # 4 in Zilvia for proof of confirmation number communication time index in correlation to the times of the following quoted text messages where buyer states “Yo. When do you have time to send the money back?” seller responds with,“Once I get the package to make sure everything is sound”, changing the terms of agreement.

Seller also claims “without confirming my preferred address”, however, please view image #5. Buyer asks “same address as on the box?” without response for 7 hours. Seller also did not make a correction on address or notify buyer that the package had been shipped to an unacceptable or unreliable address. Invariably, seller in fact states, several text responses later, “Prob shouldn’t haven’t sent it there but that’s ok”. Please view image 6. Seller also verified “4233 9th Ave NE Seattle, wa 98031 Apt 109? “ which would logically imply that the provided address is obviously acceptable. Please view image #7 Zilvia.

Seller claims that “I have not received the item though the tracking number says it is delivered”. However, I contacted the USPS manager/supervisor, Dwayne, to confirm the package. According to him, he stated that "everything should've went well." But that was not enough proof for me, so I had him contact the postman responsible for Kelsey Apartment complex deliveries. He then put me on hold for about 5 minutes, later on, he said he was able to get a hold of the postman. According to Dwayne, from USPS , the Kelsey Apartment postman recalled delivering a single package to apartment number 109. In addition, USPS supervisor, Dwayne, specifically verified that small flat rate boxes fit into Kelsey apartment tenant mailboxes. Despite the seller stating, “I actually don’t think that box would fit in my mailbox so I don’t know what the post man did with it but hopefully room mates got it”. Please view image #9. Furthermore, I have also acquired information from the dealer that the Seller had bought it from. I went ahead and called PoweredByMax (PBM), and talked to the head person, Dan, and asked about the item regarding the Electronic Vital Digital Meter (EVDM), - the seller (Justin) refers to it as EDVM and he clearly states it as Electronic Digital Volt Meter, which is completely wrong. Anyway, back to topic, I asked Dan about the item to see if the EVDM that the seller had bought from them, really comes with two(2) sensors, and indeed yes, it does come with two particular sensors, in this case, the water and the oil temperature sensors. In his paypal dispute, the seller states "However what I shipped was everything that I received when purchased from the original website."
