Alright, I ordered an sr off ebay last month. Yes I should be shot, but it was cheap becuase the auction thing got messed up and the only way to view the auction was to click on another auction from the guy, and click view sellers other auctions, so only like 50 people viewd the auction and I got it for 1000 with ignitor and some other parts, tranny of cours was include, Well the guy had some good feedback from different people. but now Im getting pissed, we had talked through email so i trusted him, Now I try to send him email and it comes back to me, it says reason is "over Quota" so Im thinkin his mailbox is just full, but nonetheless I am worried, I finally got his phone number after I filed a fraud alert thing on ebay. So Iwill call on monday, but I typed the number on switchboard and whitepages.com, comes up no results, although some of my friends numbers wont come up either so maybe hes not listed or something, in the end I might have to go to small claims court, I have correspondences in email, and paypal reciept. I paid via paypal. The guy said he will send me a tracking number, now there are two things that could happen, in court I can say so wheres the tracking number that you said you would give me, he can say I never got a tracking number which means hes suspicious, or he can say I sent it to you. Then he should be able to tell me it, lets say he did send soething, and its an empty box. then that would obviously make him look bad too. so would that help me. I dont know im confused. but my parents say that If I can not make a good case then they will dismiss the case and im out another grand for court costs. can anybody give me advice on how to prepare and what I need if it ends up having to go to small claims court. I mean it took me 6 months of hard ass work to save for this money after all my bills and living costs, and im not about to let this bastard take it away from me.

Take him to court. Explain the the magistrate what the deal is and hopefully listen. I would definately read up on ebay's disclosure too.

Some advice would be to buy from a legit dealer with reputable feedback. :doh: Anyhow I hope shit works out in your day of court. :rant: I would hate to see you out 2k and also lose that SR you have worked so hard to get. :wackit:

i would take 35 bucks from a family member, buy a greyhound bus ticket, take the bus to the guy's city, knock on his home or shop door and be like this is what 1000 dollars feels like and give him a knuckle fist sandwich, even if its dinner time.

I sell on eBay, you already filed on eBay so thats fine. ( if you acually won the auction ) Then you paid with paypal you should file a claim with them, then file a claim with squaretrade . If you paid with a CC file a claim with them as well.

well I had my dad file a claim w visa. Today he tells me that he called, the lady asked him like 2 questions and they instantly credited him 1400 bucks. I dont know why I care since I got my money. But I dont think visa should have to bite the bullet, Wouldnt they look into this guy before they gave me my money back. My dad thinks that visa can go back into the account and take their money back if they chose to. basically Whos losing the money. Im sure in the 20 seconds that it took visa to put the money in the acccount, they didnt call the guy and tell him to give the money back. Sheit ive been trying to call the guy for a month.

Now you are complaining that Visa had to bite the bullet? What the hell is wrong with you? Just be happy you have your money back. Plus, paypal is the one who is going to bite the bullet because your credit card company is going to get the money from them because they are responsible for the transaction. Don't worry about it too much. Leave the guy bad feedback and let people know that are bidding on his auctions that he's a crook if you really feel you need to do something about it. What would be even cooler is if the guy actually came through and you get the engine for free.

there is a few websites you can file claims with, also you should contact this guys Local Police Station and let them be aware of what this guy is doing. That might now seem a lot, but if enough people complains about him....... maybe it will lead to something..

believe me when i say this, he's not getting away with that $1400 you sent. when visa gets a fraud complaint, and they refund your money they don't sit back and say "it's only $1400 we'll let it go". they will get thier money back out if it one way or another.;) i've always had excellent customer service from visa when it comes to being ripped off on ebay, and every time i've gotten my money back when i've used my card. so :fawk: to all those scamming bastards.

If he did send you the motor and you end up recieving it after you did the charge back, id return it... I used to work for a company, and people would order stuff, we would send it out, and then they complain they never got it and do a charge back, we would be pissed..

If you paid directly using the credit card, visa doesnt eat the cost, and the seller could possibly lose his account with visa.

If you paid via pay pal I'm not really sure.

a chargeback with visa should do the trick. visa in turn goes after paypal, then paypal will go after the seller. in the end if paypal doesn't get their money they lose out, but most likely paypal will get their money back if not then they will notify the authorities. ie..fbi fraud investigators

just leave negative feedback on ebay for him.
i'm figuring that he probably bought the motor from another company just to resale back to you, but his supplier probably didn't ship OR is late in sourcing the engine.

I was explaining why i got pissed off at what they were saying, they were just being assholes to me, if they wanted they could have just told me when they were at my house or somthing, they were just posting for the hell of it screwing off and it was pissing me off. im not going to go off on someone i dont know and tell em to lock the thread.( I know a lot of people tend to be assholes on this site mostly just joking around though) I just wanted some advice from people that may have had this happen before and the post wasnt going in that direction. I appreciate the people that had something to say that actually helped me.

I got lost towards the end of some of the post...but anyways...

VISA credited the money back to your dad's account...and that's a good thing. What happens is that VISA will tell PayPal that there was an "unauthorized transaction" and they want their money back. Then PayPal will take the money from YOUR account and give it back to VISA...who then gives it back to your ccard account. Now your PayPal account has a negative balance...and your stuck with limited access. What will evenutally happen is that PayPal will investigate the case and evenutally take the money from the seller's account and put it into your account so that you are left with a zero balance....thus you can use paypal again. Now if you do get the stuff....then your fucked because your going to get the money taken out of your account...plus your left with a shitty motor...sorry...BUT ITS E-BAY. I'm only saying this because I had something simliar happen to me...but it was thru my bank (did a bank transfer). I really don't see why your tempting to take him to court if you got the money back....your making it worse if you don't know what your getting into.

no im not going to court now since I got my money. but I was going to. after I posted the thread my dad did a charge back so everythings fine now. but I appreciate the info.
