View Full Version : Traded for stolen car case HELP!!

Hello zilvia.
I traded my BMW for 240sx with sr20det, sign over liability and pinkslip and registration. No cash was involved. I was driving fine, untill i got arrested by the police. When they arrested me, there were 5 police cars and tons of police officers pointing guns and shotguns. After they arrested me, I was told that vehicle i traded (240sx) was stolen vehicle. I happen to have all the documents that proves I traded my car, I was released.

After talking to many detectives and police officers, they advised me to report my BMW as a stolen and they found the car.

The BMW was molestered (damaged) and I called insurance to get it as theft recovery. I told everything, and showed all the paper works and everything.

Today, I found out that they denied my coverage because I intentionally traded my car for stolen vehicle.

My question is that how come this is not the theft case? police said it is stolen vehicle case and thats why they took the report and got my car back. I have documents that saying recovery of stolen vehicle.

The BMW that was found is still under my name and yesterday I went to DMV and got the pinkslip and registration back.

Any similar case, court ruling case or any input will help.

okay first of all since I've had experience with buying and selling a car...

I'm going to ask you this.

When you were trading your car did you ask for his driver's license to match the pink slip?

should have just told the insurance company that it was stolen. technically it was.

Yea but then they would also investigate on how the car got stolen. None the less, if you didn't cancel the insurance coverage and have documentations from the police incident... Then by all means, it should be fair that you're still in good term for the policy. What insurance are you under?

When I traded, I didnt match up his Drivers license, but I knew where he works, where he lives, phone number, and his wife or gf.

I traded my car last year November 6th, and car was found at Los angeles.

And I'm not planning to sue him.... but I want to see if theres any case that is similar to mine.

dang u should have match up his drivers license. i always do that when i buy a car. always got to be on the safe side.

1st of all youre dumb mistake for not checking with his license....

you just believed him and traded.. trust no one. YOU ALSO SHOULD HAVE JUST SAID YOUR CAR WAS STOLEN TO INSURANCE instead of telling them that you traded -.-'' you already have the police record of getting it under STOLEN.

I would also check with a lawyer and see if you need to have that arrest record sealed or expunged.

Easy solution. Get a lawyer, sue the guy for the damages. Then sue your insurance for not allowing you claim it. You were a victim (using this word loosely, instead of idiot) of fraud. First route will be the guy. If he is not covered, whoever he resides with that is insured will be targeted. Typically whatever they have unisured motorist or BI (bodily injury limits at max). I worked for a lawyers office for a few, its the route they took.

Go after drivers insurance first
Then anyone in the house hold
Personal suit towards small claim is done separte. Only shit you'd get if above claim OS settle in your favor would be suffering, wages if work was taken off, misc costs.

You cannot go after the perps household for damages he caused. Unless the dude is a minor?

Youre crazy. Yes you can try but you will not win.

You can't go after their household insurance but you can go after the auto insurance to whoever resides in the household. If its a Minor, it is a slam dunk case... Parents insurance gets raped. Hard to prove who resides in a house hold when it comes to unmarried adults, people can argue by saying they are in just visiting.

Talk to a lawyer, not a forum first off. Im kind of confused with the situation. SO what happened to the 240sx and did you not get a pink slip for the 240sx. If you did how is it stolen?

I have pinkslip right now in my hand but somehow someone went to DMV and asked for duplicate pinkslip. police said my pinkslip is the old one. and 240sx is impounded, and i cant ask anything about that car because detectives wont talk.

yeah,, and actually theres more stories, but skipped those.

Im talking to insurance and im having a hard time convincing them that what happened is not just voluntary trade but its a larceny which is a theft.
however insurance keep saying that under their policy, because i trade voluntarily... blah blah blah

Thanks for posting this. Good warning to those of you who might deal with shady people.. Lets face it here, the car world is littered with Sociopathic Egocentric Shady people who generally fuck people over constantly and some how find loopholes around or through their bullshit. They will overload you with an avalanche of problems so you feel like you are at the bottom and you can't do anything about it because all of the shit is at your end and you feel so overwhelmed that you don't know which direction to take. I really hope you climb out of this hole.

Being arrested and treated like a criminal when you are innocent is a situation that is constantly arising in today's society in america. Too many people are being forcefully put into the "victim" situation just for trying to exist in this reality that is constantly being tormented by low life criminals who stoop to disgusting levels of idiocy.

It is rather unfortunate that America as a society has to grow old knowing they can't trust their own neighbors. Telling their kids " Don't trust anyone". It is quite ridiculous as we are all humans sharing this space we call earth/America.

There is no Honor in America anymore, it is becoming more rare than the middle class which has shriveled up and been beatin to the curb flushing down the drains into the sewers of society.

Yes it is your fault, you are the one who is fucked because you chose to swim in the deep end blindly with out conscious of the sharks that swim with you.

My point is to let people know that hey, Soo many sharks exist in this world, yes even the car world that we all love so dearly is corrupted exponentially.

He can't sue the insurance he just stated he sold the car/ trade ... Meaning he signed the pink slip thus he transferred ownership legally!!! Regardless if car was stolen or not, it had intent... The insurance is not obligated to cover the car after the date of transfer, so I'm not sure why you guys would think the insurance has to cover him? Let's say the guy he traded crashed that BMW right after he receive the car, would u expect the previous owner to be at fault or liable? I think not.... So it's no difference with the insurance company... Suck it up, big boy

So yOu have possession of the BMW. Where is the 240? Impound? You keep saying that you had the pink slip? You mean the title. Did you go to the DMV and have the title put in your name? Or were you drive around with the previous owners title with his signature transferring ownership to you?
