View Full Version : Shop Lawsuit: Help with small claims court filing procedures

I am currently looking to sue a local shop due to the mishandling of an install, and refusing to refund money involved in the project. Can anyone offer me any tips before I proceed with the court process. The shop has yet to work on my car that they have had for 3 months and holding about $3000+ of parts and labor money. I have all receipts and proof of money paid.

Hey bro, I see that you're in GA. I've been trying to get info on the process of small claims court also because I'm trying to sue my damn friend (or ex-friend) who hasn't paid me for my fkn motor! Well here's a website I found

i took a toyota dealer to small calims court here in socal. it was very easy. it cost me about $60 in fees and that included a summons delivery by a sherrif deputy.

i went to court, explained the situation to the judge, showed my evidence, then 4 weeks later, i recieved a judgement in my favor. within the next week i got a check for $3612

It is actually quite easy to file a small claims court suit. I've filed one when i was in a hit and run accident. All you have to do is go to your local county courthouse and ask around till you get to the right place, and fill out the correct paperwork. You'll get a preliminary hearing date where they try mediation. If you can't come to an agreement then you set a trial date. Most suits are settled at mediation or before trial.
