A lady hit my 240 last sunday. She was behind me but i guess she changed her mind and wanted to go to the left-turn only lane. On the process she hit the left hand rear corner of my car, right on the rear side marker. I wasnt gonna report a claim since the body damage appeared not to be so bad but as soon i started driving the car home it started to swivel. It started to swerve randomly and i almost hit a parked car. So i went a head and report claim. I dont know whats wrong with the suspension yet, seems allignment was messed up or somthing. Now when adjusters comes and sees that my car is not stock im expecting all these BS from them. I have stance coil overs and im afraid they gonna try to f$&@k with me. I know i have the upper hand since it was their fault but dealing with them insurance/adjusters without lawyer is PIS! Im 23 but i look like freakin 15 year old kid so i know theyll try to mess with me. I know since my last car that got into an accident took them 4 months to fix. what should i do to get a rental car and get my car back on the road asap? Any body shop around LA that is more sports oriented that you guys could recomend?

I'd just have her insurance company deal with it... Idk how this stuff works in CA, but here in IL in order to have the upper hand on all of this and prove it was her fault and yadda yada, you had to have filed a police report and stuff, and then file the insurance claim. Don't know if you did that or not...

You did get HER insurance company down right? Don't go through this with YOUR insurance company.
1. You must have other persons license info (name etc), plate # and their insurance info.
2. You should have called the police
3. You should have made the police ticket HER (very important as it proves fault)
4. You should claim in to Her insurance company with a copy of police report

if you've already done the above mentioned... if you need a great body shop to go to, you can check out donlysonautoconcepts.com. they do a lot of show cars there and insurance claims. I got my track car painted there. they do really great work.

hmmmm i would think that when the insurance company comes to look at the damage they will not repair it since you decided to rivet over fenders on it.....im gonna bet they will deny your claim or at least most of it.
From experience from doing bodywork untill i quit. I wouldnt not touch a car with over fender unless a profession icar shop put them on. Gl and let me know how it goes.

I work for an insurance company. Based on your accident facts I doubt they would deny the claim however
Be prepare for them to possible total your car. The value of your mods will help but if you have subframe damage plus that body damage the insurance company will go off of shop rates to fix it. Parts plus shop rates probably are more than your car is worth.
Whatever mods you do have print out receipts or the new value of all your parts so that the auto damage adjuster can take those into account.

i got hit in my 95 avalon winter beater. literally a beater beat to shit and i still went to insurance and got 3k from the accident still fully driveable. sure the car is beat and ugly but still dude, you get in an accident you trade info and take it to THEIR insurance

So i got a call from her insurance and they told me that she is not admitting that she was at fault! Accrording to them i was the one who changed lane.. Wtf!! I was at full stop and waiting for the light to turn green. I have no known witnesses when it happened. No pic of actually accident either just the damages. Wtf should i do now?!

If there was no police report, pay out of your pocket, learn your lesson, suck it up and move on. Sorry but thats the cold hard truth.

^they dont even come unless u tell them somebody's injured. Which i did on my last accident couple of months ago. Took this one as karma trying to get as much as $ as possible. I told to myself, damn my car hasnt even come out of the shop yet and now this. So didnt even bother filling a claim at first let alone a police report. Fuck you try and do right stuff and shit like this happens..

Who? Her insurance? They might even be the one denying the claim since at beginning lady was offering $300 or claim it on her insurance and totally admitting that it was her fault..But what the heck am I gonna do with 300 bucks so i chose insurance.

you made 5 dumb moves there. Congrats you pay the price. For one. The damage to the "fiberglass" over fender is not hard. Hell there's nothing there but a descent scratch. Claiming subframe damage is pretty out there. Your rear toe is probably out.
Your options are as follows. File a claim with your own insurance company. Your rates will go up alot or they will drop you. You'll pay your deductible and get it fixed. The deductible + higher rates will probably be more than option 2. Pay for it yourself.
You won't get a dime out of her insurance. It's a he said she said thing now. Here's why you get a police report. Because when she gets fed up with her car being damaged or worse, it was her boyfriends car, and then she calls one of those 1-800-ask dave ghetto hoodrat hotlines and they run a 10,000 chiropractic/legal bill up on her and bill it to your insurance. You won't have any way of really defending yourself. Your insurance will "settle" and charge you the higher rate. Always get a police report.

I'm having trouble buying that story. If you called the police and they did not come out there, you should have filed a complaint against the police department (whichever one was closest to the scene of the accident). I have never had a problem getting an officer after an accident, even though they where minor fender benders where no one was hurt.

He is telling the truth. Certain PD departments won't do it on private property either.
Yes OP her insurance should investigate the claim. Are they a smaller insurance company? Mention to them the $300 she offered you.

^ me and my insurance agent did. But claim repressentative is being a bitch. We also mentioned that if i was at fault and I hit her, how come shes not filling a claim? Rep told my agent that her insurers car wasnt damged, which was a lie.

if you have her information just go down to any repair shop and tell her it this much and have her pay it if you dot want to g threw insurance
but if things are different just make a claim and go get it fixxed
but i didnt go threw insurance on my gf car got the money to fix it and then kept the money and sold the car, and got another car but im 100% sure you dont want to go that way i wouldnt either with my 240

It's not just CA, certain parts of IN, IL, and other states won't do it either. It is per department. If someone have a policy that won't cover a parking lot accident then that is a shitty insurance company. Any collision accident should be covered under collision coverage, or uninsured motorists. As far as the ticket goes it is always at the officers discretion.

Yes and no. It is easier to file through the other person insurance for the most part. If they are a good company they will inspect your damages pay for everything and that will be that. A person always has the option of filing through their own carrier, if they have the right coverage, and the carrier will attempt to subrogate (payment recovery process) the other ins company.
The only thing about subrogation is it is a long process with no guarantee of recovery. You still have to pay any deductibles that apply. So if you have a 500-1000 deduct you have to front that cash until your company gets thats money back, which I have personally seen taken over 3 months.
I advise everyone it is best to file with the adverse carrier (insurance other than yours), unless it s an accident where is a possible comparative negligence case (both parties share fault). In that case you can attempt to file but more than likely they won't pay all of it. Premie's have seen example of this with one of the staff in a premieland thread.
In cases like the one with the op where there is no way to prove your case it filing with the adverse carrier is stilll the best option and if they deny the claim, then file it with your carrier. The large majority of the time the larger the insurance company the better off your chances. I don't know how progressive works but I know my company would take recorded statements from both of you, inspect both vehicles if need be and try to make the best decision possible. At least that is what they should do.
OP have you considered legal counsel? If so let that be your last option as that is going to complicate the shit out of things and prolong the hell out of this claim. The lawyer may help, may not. Depends on the lawyer. I would strongly advise you speak to the adjusters supervisor and attempt to reason with them.

EDIT: Forgot to mention, anytime you are in a serious accident where there is major damage to your car or if a company damages your car, filing with your carrier may be best. If there is major damage to your car, it is your only means of transportation, if the other company doesn't accept liability(aka pay for your damages) within a short amount of time (as long as you can stand to be without a car) then file through your carrier. Even if the adverse carrier accepts liability in the middle of the claim it will still be easier on you than waiting on them.
If a company vehcle (fed ex, business, garbage truck etc.) damages your car. if your carry the coverages it would probably be best to find your carrier as companies have miles of red tape they have to clear first.

^^^Filing through my own insurance company is not an option since I only have liability. Yes, I've talked to my lawyer and he said that he'll take the case. I havent fully decided on going that route though.
