I don't want to post this in regional because I may not get many answers, and it may be the same in other states that I am unaware.
Basically, I got many tickets in under a year (well over 4 points). Now the DMV will suspend your license after you recieved your 4th point, and as they did mine, suspended for 6 months. Well I served those 6 months, and got my license back, and am now still on a probation period.
After the 6 months I finally bought another car as well as insurance, and had to file the SR22 form, which pretty much tells everyone that I'm a dangerous driver? Something along those lines.
Anyways, I sold the car, and don't have any car in my name, so I cancelled my insurance because I don't want to pay $120 a month for nothing. I recieved a letter in the mail the other day for a notice of suspension as of September 3, 2010 because the insurance notified the DMV that I cancelled my policy.
Do I have to pay insurance on a car that I don't have? I can't provide the DMV with any VIN or plate #'s because I have none. Do I need to pay money to keep an SR22 on file? I don't understand how the DMV can be that fucked up to make me pay insurance when I don't drive.
Any information pertaining to my problem here would be greatly appreciated, thank you guys. And for those of you that know CA DMV's, I tried calling and was on hold for 40 minutes.

It is meant for "teenagers" but the rules still apply, specifically "How do I get my license back after my suspension is over?"

*So pretty much you got your DL back under probation
*You bought a car and insured it
*You sold the car you bought and canceled the insurance on that car
*Now the DMV wants to suspend you DL once again because canceled the insurance on the car you sold.
Id go to DMV if i were you. Along with the bill of sale of the car you sold and straightened it out. UNLESS CA have a new law that if you have 4 pts, or on probation, you can't drive any car thats not registered under your name or insured by you.. maybe thats why they're suspending your DL once again??..

The basics of it is, you have to maintain SR-22 insurance for 3 years, lest it lapses and you got your license suspended again. Hence the link with the information.
If your driver license has not expired, you will need to:
Pay a $55 reissue fee.
Provide proof of insurance (SR 22).
You must maintain this insurance for 3 years.
If your driver license has expired or your driving privilege was revoked, you will need to:
Reapply for a new driver license.
Pay a $55 reissue fee.
Provide proof of insurance (SR 22).
You must maintain this insurance for 3 years.

I used to work for the Driver Safety unit at DMV lol..
SR-22 is basically insurance on YOU as a driver. You do not need a car to obtain an SR-22. If you dont plan on driving you can keep it suspended and the clock will continue to tick towards the 3 year end that you have to maintain proof of the SR22.
During probation be CAREFULL if you drive. DMV can suspend your L's again if you get in an accident even if you were not at fault, it is at THEIR discretion what they choose to do. So my advise is just be very cautious untill its over.

To OP,
When you sold your car, did you fill out the form that attached to the bottom of your pink slip? That form releases the liability and transfer it to the new owner on the day you sold the car. DMV only knows that you sold your car once you turn that form in or the other person register the car, otherwise the liability is still on you. So, you should turn that form in ASAP, it will solve all your problems.
btw, dont call DMV those fat asses never pick up the phone.

LOL, You can't read for shit either. OP never says anything about paying a fee to the DMV. the guy you said cant read for shit, can read. as for you, i cant say that
basically, if he doesnt have SR22 Insurance, he doesnt have a license. he cancelled the insurance, so the DMV sent out a letter stating his license was going be suspended.

Ill say it again, SR22 is NOT INSURANCE ON A VEHICLE.
It is insurance on YOU AS A DRIVER.
If you plan on keeping your L's you will need to have the SR22 regardless of whether or not you own a vehicle. If you dont want/need to drive you dont need to have an SR22. You DL will be un-suspended once the 3 year requirment for the SR22 goes away. I think the 3 years starts from the end of your 6mo negligent operator suspension, but i may be wrong about the exact date. I havent worked there in over a year and a half so i am kinda rusty on the technical stuff.

^^^ thats exactly what i was thinking. The car you sold still show up in DMV/sacramento that you are the owner of it. I've seen or noticed that many people that buy used cars from private owners dont right away register the car to their names and remain on the old owners name. So unless you send that little liability form attached to the title it will remain under your name. So when you canceled your policy ins company will automaticaly send a notification to DMV then they will send you a warning of your license being suspended.
Something similar to this happen to me when I got rid of one of my coupes. Junk yard picked up my car and I never mailed out that liability form. I canceled my ins policy since I didnt have the car no more and later recieved a noticed of my license being suspended if I didnt get an ins policy. I had to call some dept in sacramento not DMV and explain to them what happe nand paid a fee which sucked. After everything was cleared....
I honestly dont think you have to have an ins policy even though you dont own a car... doesnt make sense. Make sure you mailed that liability form first that might be the reason why this is happening. Good luck

Wow, and this is exactly why i hated working at DMV...
As for the OP, do yourself a favor and call Driver Safety first thing in the morning right at 8am, usually the hold time is considerably shorter.

Sounds like the answer OP was looking for. SR-22 is mandatory after getting a suspended license. Don't lapse or it will be suspended again. Talk to the broker that issued your SR-22.

Didn't feel like reading all the responses, so if it was covered, sorry. If you do not have a car anymore, you still need to file an SR-22. Geico does it for free and you must keep it filed throughout the duration of your probation.

Yea, i was just offering extra information that can be usefull IMO.
But yes, SR-22 is mandatory. Its just confusing when you look at it as something you get to cover your vehicle when in fact its seperate. Hence why it was canceled with the cancelation of the car coverage, you just have to make sure that if you cancel your vehicle coverage that you have them keep the SR22 on file with DMV.

Wow, perfect input guys, just what I would expect from Zilvia! (No sarcasm)
My question was answered in like the 2nd or 3rd post, but then argued a bit back and forth on various parts. Perfect for what I was looking for.
Thank you for your input, Limelite put it in super simple form. I stayed on hold for 2 hours on the phone with the DMV to hear I need to talk to my insurance about it.
SR-22 has to stay on file until 2013, I am going to check gieco as someone mentioned above files one for free. I guess when I canceled my insurance they canceled my SR-22 as well.
Anyways question was answered and thanks again for the excellent and detailed responses!
