So here is what I found out tonight...

There are 3 police officers on my hockey team, so after the game I said, HEY, fill me in on the info with these roadside smog station things.


One guy has worked them before, so he knows firsthand. :)

IF the police officer asks you to pull over for the test, you MUST do it. You cannot say no to pulling over.


HOWEVER.


The test itself is NOT MANDATORY





You have the option to say NO to the test and go on your merry way.

IF you do the test and fail it, you are NOT in trouble. You can apparently qualify to have the problems fixed up to a certain dollar amount(He thinks it's $1000) at no cost to you.







So, bottom line, IF the officer asks you to pull aside, DO IT.
If you don't want to take the smog test, You DON'T HAVE TO.

great info brian. hopefully it takes some stress off those that drive cars that will have smog issues.

I've never encounter such a situation before, but it's always nice to know ahead of time.

Nice info. Makes sense they can't force you to get smogged... would seem pretty draconian, even for California. They just rely on a large majority of people not knowing the info you posted, so they stick around and get tested.

But so you pull over and they see your shiny FMIC, and they ask you to pop your hood. Now what? LOL. I doubt you can say no to that without having them impound your car.

Do they hand out ref tickets at those mobile smog stations?

that's a reasonable concern that I would share.
the cops might not legally be entitled to 'smog' your car,
but it doesn't mean they can do other things to get at you.

Also, knowing your rights is one thing.
but being aware of the most effective way to express your legal rights to cops is another

I.e.

Cop "I need to smog your car, SON"
Sr Owner "You cannot do that!"
Cop "Ok, pop your hood then"

- I don't see that ending too well.
