Friend bought an S13 from Texas, now we have a dilemma.

Okay, my friend bought an SR'd S13 from a guy in texas.

He's been having trouble with it, here is what he just sent ebay about it:
'The car that I purchased as arrived to me but, not as it was described on the ad from the sale. The list of damages are:
- two chips to windshield, approximately 1-2 cm in diameter.
- holes where previous spoiler existed on the rear end of vehicle.
- dead battery.
- fuel leak
- crack rear tail light piece (center piece)
- front bumper chipped and stratched
- rear bumper scrapped and cracked where it meets the fender on both sides of vehicle.
- exhaust brackets broken cause it to hang lower than should be.
- fuel tank had wet spots, most likely due to leak.

I was informed by the seller of some of the damages two days after it was shipped so, I filed a dispute with Paypal. July 2nd, it arrived, but I refused it due to the damages that I saw when it arrived as paypal told me to. July 8th I was called saying that it was being dropped off by the shipper today, the 10th, with or without a signature. It was dropped off today without a signature, in the street, illegally parked in front of a fire hydrant, while I was not home. My younger brother, who is 13 watched them unload the car from the carrier from the window. He said the car was not started, so it obviously does not run either. I am having the police direct me with what to do with the illegally parked car, but I am informing you, that I would like a full refund due to the damages that were not disclosed at the time of the sale. I have hard copies of emails with my contact between me and the seller if they would be needed. Thanks, Brendan"

cliff notes:
-friend buys S13 for $3800
-car it being loaded onto a truck and is supposedly bottomed out, damaging the exhaust, both bumpers, and causing a fuel leak.
-friend tells shipper to fuck off when car arrives, and shipper abides.
-after fucking off, shipper now has dropped off the car sans title or keys, infront of my friends house infront of a fire hydrant.
-cops are here now to tell us what to do with it.

has anyone else had an experience like this? paypal told him to go to ebay, and ebay told him to go to paypal. my friend really doesn't want the car impounded, because then it'll likely have shit stolen off of it, and he doesn't want to get dicked with an already-fucked-but-more-fucked-than-before car. basically, what should we do?

guys, it's not mine, it's my friends. they didn't say it was perfect, but they also said it ran. my buddy is being a bit of a vagina about the whole thing, like scratches and shit, but the fact that there is a steady piss-like stream coming from under the car when we try to start it is kind of ridiculous. i think he's blowing it out of proportion, but at the same time, he's my friend so i feel obliged to help him.

we're putting it on a lift tomorrow to see what's going on with the fuel leak, and i'll get pictures up tonight or early tomorrow. overall, the car is in damn good condish. turns over and all when we jump it, i'm just sure there's no fuel pressure which is why it isn't starting. the gas tank leaked two gallons in about ten minutes, that's how big the leak is.

the "as is" limitation is not a blanket to cover all fraudulent vehicle sales by private parties. if the seller makes huge affirmative lies about the condition of the vehicle prior to sale, and the buyer relies on those lies in making his purchase, sellers may be prosecuted in criminal and sued in civil for doing so. of course, either takes a long time (years), and by the time you see any money (if any), you will probably have stopped caring.

the damage here sounds really negligible. and i don't think he made gross misrepresentations about the vehicle's condition. sounds more like the shipping agent fucked it up a little at pick up or drop off. take the car, spend a little TLC on it and enjoy.

It's the fuel hoses by the tank! Jesus christ that is pretty much THE single most common cause of fuel leaks on 240's! Who the fuck cares? And as for the rest of the car, waaaaaaaaahhhhhhh it has some chips, cracks, scrapes, and scratches. Oh noes! Only every single god damn modded 240 has almost all of those problems. Take your sandy vaginas elsewhere, your "friend" got a good deal as long as the chasis is straight.

That means nothing. How you drive when you get a more powerful car is the main point. If you tell me that when you get your 240, you wont try to slide it in a parking lot or a street, your lieing.

I just turned 19, had no tickets or accidents until jan 2009, got into 2 accidents this year, 1 at fault and got 2 tickets for speeding.

Take the car. Its his fault for buying the car on ebay without looking at it properly. Put some money into it. Fix and make sure everything is working good and accept the fact that he made a idiot mistake of not checking out the car properly.
