View Full Version : Borrowing a friends car...is this legal?

If I borrow and drive a friends car (only liability) insurance and I am not under a insurance policy am I legally driving? If I get in a accident or pulled over can I get in trouble or since the car itself is insured I am okay?

if the cop wants to be a dick. then yes. unless your friends insurance has "friend coverage" of some sort.

Technically no, if you crashed it, his insurance doesnt cover you. If you get pulled over, most cops only care that it is insured, they dont read into the policy to see if youre covered or not.

You would have to have insurance that covered you while driving "all vehicles." Most full coverage includes this. Usually you have to opt out to "own vehicle" coverage.
I doubt your friend has fleet insurance or will be riding with you all the time. So, a cop could cite you for not being listed on the insurance card and hit you for driving without insurance. Hitting someone/thing without your friend in the car, their insurance probably will not cover you ether.
If you are going to be borrowing the car for an extended/frequent period of time I would look into getting added onto their policy.

If both he and you have insurance you are good, but since you don't have insurance of any kind you likely are not. I borrowed a friend's dad's pickup truck and called my insurance guy to confirm I was good, and he told me as long as I was on my own policy and the truck had it's own policy I would be good.

This is not actually true. A lot of insurance companies in California specifically ask you if you are the only driver of the car because they do not cover all drivers. Same with Rental cars.
Unless your friend has full coverage like AJ said or has specifically specified a certain person other than himself to drive the car you are not covered. I.E. its your responsibility.
considering your friend has liability only I would guess that he is the only specified driver.
Usually what the insurance policy will have is an allowance for the insured to drive other cars. This is for cases of the car being in the shop or a need for a rental.
All but the basic liability have this provision. Though that would be your insurance not his. So if you're driving his car and you do not have insurance you are most likely not covered and financially liable for any accidents.

To be driving without insurance coverage period is a violation of law in California.
Like I previously stated the fact is your friends car most likely is not covered for you driving it. Unless you have insurance yourself,you are shit out of luck if you get in a accident or pulled over. I suggest you take heed of this.

Why wouldnt you be worried about being financially liable? If you're driving it and something happens, you're pretty much assed out. You dont have insurance on your own and your buddy probably doesnt have Rider's Insurance so you'll both be assed out even if you got hit. Insurance companies will find ways to fuck you over and not pay out...I bet if they find out the person who the truck is insured to wasnt driving the vehicle when it got into an accident, theyll make a fucking hizzy fit about it and not pay up.

You know what? You need to just do the right thing and stop reading the internet. Are those sights talking about California law?
Did you know Insurance laws vary from state to state? We have been trying to give you advice based off our own personal knowledge of the laws and polices, based on us being insured drivers in the state of California.
What part of that seems to escape you? Like Ray said you are not worried about liability?
Are you a Millionaire?
Do you carry a Surety Bond? If you cannot answer yes to those last two questions? You should indeed be worried about about having liability insurance.
In fact, if you are a Millionaire? You should be even more worried about having the most coverage you can get, so someone does not sue your ass and take your money.
Now, we know you're not a Millionaire because if you were you would...
A: not be needing to borrow your friends car, or...
B: not be stupid enough to be asking all these damn stupid questions about a basic issue that you should know better about, to begin with.
I.E. If you are going to drive a car you should have insurance period. Regardless of who's car it is. Period. Any question after that is stupidity begetting stupidity.
Sorry if this sounds harsh but we gave you the answers and you keep on asking the question over and over.
