You fail for not realizing what he did was fraud. He got off light for commiting fraud. Fraud is Fraud be it $15 or $15,000. It would be the same in your state and you need to take some law classes. It might do you some good.
eastcoastS14
03-19-2008, 07:38 PM
hahaha I am aware that he committed fraud....however, where I am from cops have better things to do than pursue the local taco bandit. I suggest you take more law classes or at least attend the ones that you missed where the discussed retributive justice which clearly went out the window in this class...you can google it if you dont know what it is. Fraud is fraud whether it be $15 or $15,000 if you really want to get technical about it but the fact that cops pursued the lead and actually made an arrest over this is kinda stupid. but i do understand it since technically it is their job even tho its dumb. but 3 years probation for $15 worth of tacos? give me a break thats incredibly disproportionate to the crime

I'm pretty sure more than $15 worth of food has been scammed off of them and other establishments.
He had his own production company and slogan and everything. Probably didn't help his case.
---
I was actually a manager at a fast food place where someone attempted to do this. What I did was ask for the time they said they came in and checked the security cameras to see if their story matches up. Easy as pie. You can also check the register for the receipt.

You are so correct. People like to take the easy way out and do what benefits them. This nation does not have many people left who are willing to give instead of take. This jackass sits in his SUV trying to scam a local taco joint. Seriously, the fat ass has nothing better to do? I am glad he got arrested. Also, I love dumb criminals. Who records them self committing a small crime and posts it on youtube. Oh I know who, this guy!
StaticX27
03-19-2008, 10:40 PM
I'm sure that if they just scammed the tacos the cops wouldn't have bothered. However, its the fact that they were flaunting it all over youtube.
I work at Best Buy where we had a customer steal a CD. However, he not only stole the CD, he took the case in the back and took a shit on it. That's just rubbing shit in your face saying "Not only did I jack your shit, I'm leaving you shit." Best Buy tracked the guy down and made an arrest. Its a $15 product and probably $50 in labor to a company that makes millions, but its the principle at that point.
ryguy
03-19-2008, 11:54 PM
Now they are going to be responsible for 100 other jackasses trying this shit, I think the sentence is appropriate. Its like how the RIAA prosecutes the people who upload music, not the people who download it. Its this spreading that they're worried about.

This is exactly the point.
To clarify to eastcoasts14....
I did not study law because I feel lawyers are dogs. I am a creative person and in the words of people I do know, that attended Stanford law. "If you are at all a creative person i.e. an artist of any sort be it musical or whatnot do not attend law school, as it will kill that creativity". This is actually true and I have seen it firsthand.
With that said it like staticx27 said they deserved to be pursued and arrested because though the crime may seem trivial to you they posted it on Youtube.
Thereby showing and saying people look this is cool go rip off Del Taco.
That actually is encouraging more fraud and crime.
Eastcoast you sound and probably are a product of the internet generation. A generation that is fast becoming amoralistic. A Generation that ignores intellectual property rights. See's perfect justification in self satisfying small crimes and crimes they feel do not hurt anyone. A Generation that has no understanding of personal property unless its object sitting in front of them.
Now unless a person has somewhat of a moral compass then things like this can lead to larger things.
You sit there and say why prosecute or throw the book at these people? It is the shear fact that once a person justifies a small crime it is only a matter of time before they rationalize the justification for a larger crime.
I personally feel they got off lightly for it. You personally admitted it was fraud.
Well like I said before fraud is fraud. With that they got what they deserved.
What they were conveying on you tube was a form of anarchy , IMO.
If you approve of anarchy then I suggest you leave the United States because most of us see reasons in laws and reasons for obeying them.

It's not like the cops had a lot to do... I mean he gave his real phone number.
They knew the vicinity he resided in.
Not that hard to track someone down.
Even a retard could track him down.

In the short film made on Feb. 19, the 32-year-old Echeverria — who is bald with a goatee and tattoos and weighs about 500 pounds according to police — calls the Del Taco in Rialto, about 50 miles east of Los Angeles, from the drivers' seat of his sport utility vehicle.
Biggie has to cut back on them calories big time!
I'm still yet to go to a Del Taco. MI doesn't have them like CA does.
"He was quite proud of himself there in the video, but he cried like a big baby back here," Rialto police Lt. Joe Cirilo said.
Errr, total humiliation.

Scamming is scamming, just like stealing is stealing. No matter the monetary value it's the act of doing something that is illegal that justifies punishment.
Although he did just scam Del Taco out of $15. He still has to be made an example of otherwise this shit would happen everywhere.
Personally if someone owes me $3 for a fucking bolt I expect them to pay for that bolt, not because it's $3. $3 ain't shit to me, it's the principle behind it.
The guy deserves to go to jail. Shit it might even be good for him. Lose some weight and all.

lol... very entertaining. I agree that they needed to be taught a lesson but 30 days in jail is pretty harsh. Now if they had prior offenses or were on probation then yeah, I understand.
But really all this does is piss me. I mean, you have this dudes scamming some nasty food but meanwhile poptarts like Paris or Lindsay Lohan have multiple serious law violations yet are allowed to roam free with harldy a slap on the wrist. Equal treatment is all am asking for.

too long to quote
In response to what you said I just wanted to clarify that Im not disagreeing with the principle that they should have been arrested for this scam. They flaunted it and the cops barely had to do any work to catch them, and the police were doing their job. I am however, agreeing with manonegra in the fact that 30days in prison is disproportionate to the crime that he committed. I can understand If he already had priors, which we dont know and would somewhat change my opinion. but the fact is that I know many kids who have committed much more serious offenses and not received jail time. probation I can understand in this case, but 30days in jail over some tacos, especially in the california prison system which is way over crowded is ridiculous. They committed a crime, they got caught which means that they will receive some punishment, but jail is unnecessary, they could have given him community service, just probation or any number of other alternatives. I also have a feeling the fact that he looks like a gangster had some affect on his sentence, I will be interested to see what will happen to the two white kids with him....or what would have happened if it was a white kid making the call...doubt he would have got jail time tho IMO
but thats all Im saying about this cause i dont wanna kill this thread

03-20-2008, 07:30 PM
Maybe they're making an example out of him because he posted himself doing something illegal on youtube, giving his name and showing his face, like a fucking retard.
Or perhaps because they thought the last thing that fatass needs is more tacos, so they put him in jail before he gets diabetes, has a triple bypass, and has to ride around in a medicaid funded Rascal scooter.

I just think that this is getting way blown out of proportion. 6 months in jail and a year of probation is cruel and unusual punishment for scamming a fast food joint. I think he comes off as very unlikable on the vid but this has to be treated fair. He doesn't deserve to spend any time in jail. a fine and a public apology sounds about right IMHO.
What happened with the two guys that picked up the food. I have a buddy who went to school with them in Bloomington HS and he said they were pretty decent guys, but he admits they look like dousches on the video.
video doesn't work anymore
sounds like reverse engineering to me
