Nissan Computer Company Vs. Nissan Motors, Who do you think should win the case?

Nissan Motors claims that they stole the Name.
Nissan Computers say that the name is a family name.

who should win, i really dont know who should win. i just wanna know other people opinions on the subject.

if my family name was Ford (which is a common name) and i made ford.com before Ford Motors did, it would be mine. all mine. technically it's just a last name. just like this guy's last name, nissan.

the majority of the lawsuit is not about the name but instead about the web domain www.nissan.com which is owned by Nissan Computers and has been owned by Nissan Computers since well before Datsun became Nissan Motors.  Nissan Motors is suing for sitting on the website or whatever.  go to www.nissan.com if you wanna read about it.  anyways, i think nissan computers has everyright to the website and i believe the courts will see the same.  this will all end with nissan motors making a huge payment to nissan computers to buy the website.

Nissan may have a chance of winning.  They had the name Nissan before computers were even invented. Only reason I bring that up is because WWF (world wildlife federation) won their case against WWF (world wrestling federation) now WWE.  If they can win that then Nissan his a chance. But I could care less either way.

The internet should be a tool where people can find what they are looking for.  If I was looking for a Nissan car, I'd think nissan.com.  If I was looking for a no-name computer company started by a guy who happened to have the last name Nissan - maybe I'd look there.  Somehow, I think the expectations of millions worldwide should trump the expectations of this guy and his three customers - okay - four thanks to that guy who wanted to buy a new Altima and decided to get a new white box along the way.

I read his background and he is generally an ass.  I owned a Nissan Sentra from the year he opened his computer company.  NOT a Datsun.  As for the tactics Nissan is using - I would too.  This guy is a drain and a confusion.  I'm sure he was offered a significant amount of money - which he fails to mention - for the name, but is blackmailing the corporation for more.  I don't think he's THAT attached to his name on the computer business!

Oh well - that's capitalism... if you can't beat'em sue'em...

Personally, I say first come, first serve. Nissan USA should have gotten into the game sooner, then they would have gotten nissan.com. As it is now, someone else took it completely legally, and is using it for business purposes, which in no way constitutes CyberSquatting. Nissan, this is one time I say shove it.

and as far as offering a large sum of money....who cares? He originally told him that it wasn't for sell, they didn't even offer a price, they told him to name a price, which he did out of frustration, and that's how they started the law suit.

they really need to just drop it, give the guy a 350z for goodwill, and use it to their advantage. For a company that needed outside funding (renault), they're blowing a lot of money on their lawyers. <img src="http://www.zilvia.net/f/iB_html/non-cgi/emoticons/crazy.gif" border="0" valign="absmiddle" alt=':crazy:'>  In fact, if I was Renault, I'd be pissed their wasting money on this.  That's profits going down the tubes.

well so far it looks like nissan comp corp is winning as 2 out of 3 charges have been dropped and the 4th still in debate.  i wouldnt think this lawsuit as much of bother if nissan motors were only going for the website but they are also seeking 10 million dollars in damages from nissan comp corp.  its just greedy getting nissan to take that one step to far

I think the $10M claim is a scare tactic.  Big firm lawyers like to throw around numbers to scare people into settling.  It's the old, you can have $1M for the site or you can risk $10M for the claim.  Otherwise, I agree that it looks bad for Mr. Nissan.

As for wasting their money on the suit:  I'd bet that Nissan did their homework on what it would be worth to own that domain for all time vs. the cost of the lawsuit.  The value was there.  Second, before starting large-scale litigation like this (likely costing a few million dollars), Nissan would almost certainly have offered a similar amount to this computer guy.  When a firm retains lawyers for a major fight like this - they know it will cost millions.  But before lawyers are hired in the *hope* of winning in court, they will first offer it to the other side.  Does anyone REALLY think this guy is so attached to the name nissan.com for his little shop?  Or is it more likely that he's looking to retire - very well off - from grabbing the website bearing the name of one of the most recognizable companies in the world?  Who's greedy again?
