Socal sr20det ticket help!!!!!!
So I have read a lot about this but a lot of the stuff i found is from a good 3-4 years back... simple, I got pulled over in La habra cop asked if i had an sr he poped my hood took sum pictures and told me to call the number in the back of the ticket to set up an appointment to have a reF test my car to see if it would pass smog.. now im down to pay ANYTHING i need to pay without having to swap to a KA .. Ive heard its as easy as just calling and paying? so do I not have to go to the ref if i pay? would a lawyer help me at all? This happened last night and I'm freaking out this S14 is my DD ANYYY help or info would be greatly appreciated.. thank you

If they took pictures of your car, you're pretty fucked. If they're building up a database over in la habra for one if another cop pops you and you have the motor still they can write you virtually the same ticket. it's 800-1200 dollars even worse. If you got that kind of money to keep paying then by all means. It's one of the main reasons I bought a new car with all of these smog traps up.
But this should've been posted in the so-cal section. I'd check to see if anyone else from la-habra ran into this issue. Good luck.

That's all completely up to the judge to decide how you're getting fucked. you don't have to take it to the ref, it will fail. then you can tell the judge you went, it failed, you're not going to correct it, whats the punishment and go from there.

I'm gonna try and go to the Court window and see if I can just pay a fine without appearing in front of a judge, if that fails I'll def get a lawyer to try and get me a slap in the hand I'm aware of the $$, rather do that then have to buy another shell and swap it all.. fml there's no way it will pass ever.. Man this is depressing as hell

I don't know what your laws are like in California but if it were me I would deny having any illegal engine modification. Then deny them when they ask to pop your hood and say the latch is broken or some bullshit they cannot enter your vehicle to pop it themselves. They would probably either not want to bother with towing it and let you off or they will tow it. In the meantime you get a lawyer to cover your ass. Telling them anything they want to hear or letting them see it automatically allows them to ticket/fine you for whatever you're guilty of... if you deny them the proof your lawyer probably has a better chance of you getting your car back without a ticket. You just pay $$$ instead of going through their systems and getting your VIN documented.
Again, IDK your laws there so take it with a grain of salt. In the midwest we can deny a search of our cars unless they have probable cause by seeing something incriminating inside your vehicle. Modified parts on the inside of your car doesn't mean they could check under the hood. It would be an illegal search if you don't grant them to the right to see it. So by that rule alone if they did pop your hood and find your SR the lawyer could get you off the hook because you denied them the right to search it but they did anyway. Once again, I'm not a lawyer or from California but thats how I would deal with a stop like that. TL;DR NEVER ADMIT TO ANYTHING, THEY ARE TRYING TO GET YOU TO INCRIMINATE YOURSELF. Get a lawyer for real and don't post legal problems on a public forum. |

I would move to Oregon before Floriduhhh anyday.
Anyways it is not the end of the world, just be happy they are not taking the car and crush it. Anyways you are going to have to go talk to the courts because not every county is the same nor every case. Some counties will be happy to see your triple or quadruple digit payday and others will not give a shit and tell you it must be fixed. S0apgun the search laws work like that here as well. They just pressure most people into it hoping they do not know the law or get scared and break. Protip: If you live in Cali with a swapped motor keep the OEM one just in case a situation like this happens. Unless you are driving some crazy track car on the streets its not hard at all to swap everything back over. Storeage units are cheap and there are ones that do not give a shit if you put a motor and transmission in them.

I want a fucking R33 really bad, I need to seriously get out of Cali.. anyways gonna wait to get stuff in the mail go to the clerk and see if I can pay that shit off and call it a day, Believe me when he asked if I had an SR BEFORE asking for my DL and insurance I knew what I got pulled over for, saying my hood latch doesnt work probably wouldn't of helped, he could easily see my intercooler and that's all the probable cause he would need def need a low key exhaust now =/

However, since the evidence is most likely suppressed on the case now your lawyer will do their thing and the ticket gets thrown out. Its all a buncha BS but its better to go through all this then swapping engines and such once a year for a ref check in my opinion. |

Sell the car to your dad or relative with a bill of sale, and show the car was sold. Show that documentation to the judge and you will just have to pay a fine. Only thing is when it's time to smog again you will be sent to specific smog station were gross polluting vehicles are sent. I went through this in 10' and the fine was 600~$.

what a ass hole.. its ok they all ways like my car and fucking fix it ticket me to death just this month i have 170 fix it ticket followed by the other 4 fix it tickets in the past year. not all cops are bad people but some times their just pigs.. dude gave me a modified exhaust ticket but put un correctable but did not ref me 200 bucks almost lol. get a layer and just destroy them dude id rather give my money to him then to a state thats cant manage money well so they gota pick on people.

You don't have to pay anything. If you don't know anything about cars from what it sounds like.
You bought the car and cop did his thing, explain to judge that you don't understand a thing what the problem is and what part of your car is illegal. You don't know anything about engines. They can't fine you for that. Then tell the judge you will either sell the car to someone for off-road use or you will bring it to a shop for them to put the correct engine in. |

I see what you mean.. and I do wish I knew my consent rights better.. tho a lawyer would probably be close to $1500 compared to the $900 ticket (if I'm able to just pay it) talked to someone who had this recently and they got away with just paying it off with the clerk hopefully my court thinks the same way

Man, Cali realllly as it rough with these laws. I actually put padlocks through my hood pins on both my hood and trunk for this reason. Good luck with this my friend.
