One of the many reasons I use TOR, plus it is fun to type in google and guess where your "located" based on the language google pops up in ... it's a good idea to not use it on zilvia though because if anyone was ever banned while using TOR and you just happen to jump to that same IP, your going to be banned/thought of as the same person... just a big pain and waist of the admins time.

if your worried about stuff like that though definitely check it out, TOR is free and works for Mac OS X, Linux and Windows but as far as I know Linux is the only one that allows you to also spoof your MAC address.

Now comes the real question. What do you do about cyber crimes?

For example, what if someone in WoW or Second Life commits a crime like fraud or theft by leading other players on and then jacking them? Can we prosecute that person in real life?

What about people who rip off others in the for sale section?

I think people who rip people off in inline classifieds or forum for sale sections should be punished by the law. And I say this having gotten screwed out of 200$ on here a couple years ago, and there was nothing I could do about it.

There would need to be some property taken. If it has even minimal value it could probably qualify as straight petty theft or some other theory of theft by fraud/false pretenses/etc.

Questions then become:

how do you prove it
jurisdiction

it'd be messy

stealing someone's sword on warcraft? Well, if they paid money for it and you say, hacked their account and got it transferred to yours. . . i could see that being theft. In reality i'd have a hard time makin that case imo.

We had issues with patent infringement in Second Life. The server is overseas but the user is in the US.

What do we do? Are laws applicable in virtual reality?

well if they bought any item in game with actual money then they broke the toc and would get their account banned, so nothing should be done. Anything involving th game besides time belongs to the game company so nothing actually belongs to the players. Its easy to get screwed unless you lose a significant amount of money.

Virtual reality is grounded in real reality. . . but I don't know how they'd sort out "where" the infringement occurred. Infringer would probably still be subject to personal jurisdiction wherever he is in the US, right?

Breaking a contract (the "toc") does not preclude criminal liability. If you sign a rent agreement for an aptment that says you promise to "obey all laws," and you sell drugs from your apartment, you have violated your contract and are subject to eviction (or other action by the landlord). That does not mean the local police cannot arrest you and prosecute you.

If a virtual sword, is bought with "points" or "nuggets" or wutever game currency earned solely in game, then I can't really see a theft there as proving its real world value would be super hard. If the sword is bought with real money (i.e. like premium membership on Zilvia), and it were stolen, then a theft has technically occurred. The only question is whether it'd be worth prosecuting and if sufficient proof could be found.

For example, you hold a patent for a particular software algorithm.

I want to use your patented algorithm, but instead of building a computer in reality, I go on second life and port your algorithm into a virtual computer.

The data is real. The calculation is real. I use your patented software algorithm to generate my results. When I have the results, I go and do something else with the results.

The physical server is overseas. Since I'm only connecting to a remote computer, should I be accountable?

This is really tough and I have no idea what should/would be done in this case.

I have no idea if it's ever been applied in such a manner, but perhaps a "receiving stolen property" theory is the way to go. It is a crime separate from the actual theft (although one cannot be charge with both theft and receiving stolen property).

The infringer has received the benefit from the infringement with full knowledge of the infringement and even intent to do the infringement. Even if the prosecution can't pin the actual infringement on him, they should be able to find the benefit he received: money, promotion, software, advantage, whatever.

I am thinking of this from a criminal prosecution standpoint, so I do not know how IP law would parallel this or not.
