I never tried using a vide camera, but I did record a cop giving me a hard time. I gave the recording to my lawyer. I put my phone on record while it was in the cup holder, the cop couldn't tell it was on. I ask the cop three simple questions, why was I stopped, what's his badge number, and the infringement of my civil liberties. The cop basically told me to go to hell and he could do want he wanted. I ended up with a sold hour of the cop being a dick. My lawyer made a copy of the recording and presented it to the Chief of Police and asked all charges be dropped or he will file a class action law suit. I never had a problem with the Oceanside Police again, but didn't at like jack ass or provoked him in any way.

FUCKING GENIUS. A K9 stopping you with it's mouth (which will cause you to need stitches) is legally the same as a Human grabbing your arm and holding you down. Don't fucking punch at them.

Anyway.

So yes, a K9 is an officer, thus, using his Eyes, Ears and Nose he too has the right to "plain view". So if he smells drugs, explosives or bodies on you it's as if a normal human cop smells or sees them as well.

Asking you to step out of your vehicle is perfectly normal. It is for the officers safety. It ensures you won't try and feel and you won't access a hidden weapon. If you sat there waiting for a while, while he talked on his radio, it's time to run a police report on your self.

Those long pauses and waiting is his controller running your info and getting hits. The longer it takes the more hits they have on you. So as your name keeps coming up they keep looking to see if you have outstanding warrants, pass due child support, bail/probation issues, outstanding speeding tickets, expired tags, expired insurance, pending hearings, etc. By your own admission this sounds like it happens a lot. Each time you are stopped it is recorded, who what why where and when.

So the cop now goes "hmmm... this guy has been stopped 4 times for traffic violations and 3 times the cops thought he was high but couldn't prove anything... and here we are again..."

1. Get a legit dash cam(your insurance might pay for it or lower your premiums). Record at all times you are in the car. It will cover your ass in an accident and if cops get out of line. They don't have to be informed it is there and recording.

2. The cops do not have the right to ask you out of your vehicle unless you are being detained. You have a right to ask if you are and for what purpose.

3. The police do not have to right to open anything or touch anything without consent or probable cause. Don't open anything. Don't offer anything. You don't even have to roll your window down more than is necessary to be heard.

4. Not all of us get to look like a clean cut white guy in a Polo ad. That's bullshit and the way you dress has nothing to do with your rights or acceptable behavior from law enforcement.

Cops don't know the law or your constitutional rights. They know they have a quota and bonuses on the line and they want access to you to get them. This requires that you be ignorant and them bully and mislead. Don't give in and don't meet them with hostile language.

^^^^^wow dude you are completely wrong and obviously you don't know the law or your constitutional rights. A traffic stop is a form of detainment, hence you broke the law and you got stopped. The cop has every right to request you step out of the vehicle. Plus, breaking the law, whether it is a traffic offense or anything else involving you inside of your vehicle, IS PROBABLE CAUSE. Plus if the officer can smell marijuana coming from your vehicle, the officer has probable cause to search the vehicle, especially if some is located. I suggest you do some research before sounding like a street lawyer that really doesn't know anything.
