CA, expired tags question

just bought a used car, has expired tags (08) can i drive the car legally for awhile?

No you can't. You can only drive it for 1 week max. With the "Smog" or "Repair" waiver. If you plan to drive it for more than 1 week, it's not possible. They give you a Day pass, few day pass and 1 week permit MAX. Depending on if you need to Smog, or car needs repairs or such incidents.

Without these permits you will get ticketed.

Or you must:

1. Pay registration renewal + Change of ownership.
2. (Seller of vehicle is responsible for smog in California) So, you should have gotten a smog paper with the car. If you didn't then you need to smog it.
3. Wait till tags come.

You should go to the DMV, get the car registered under your name and pay to update it.
They will ask for smog, but after you pay you will get a temporary registration card and smog can be done after.

But to answer your question, no you cant drive the car legally with expired tags.

They have a new law regarding extension tags. someone correct me if im wrong....

DMV gives you a permit if you've failed smog and tags are expired or
the biannual smog isn't due (tags still expired)

either way smog is due at transfer of ownership.

i had expired tags but the car was under my name already soo i was able to get an extension, i don't know if its the same when the car is under someone elses name.. good luck.

Go to DMV for questions like this. People get away with stuff longer than others, clear it up before you get in trouble. Simple as that.

But this guy just bought a car, he needs smog and registration paid first.
He can only get a limited extention if he fails smog.

YOU CAN'T JUST BUY A CAR WITH EXPIRED TAGS AND THEN GET A EXTENTION TO DRIVE AROUND.

All you have to do to get the extension is pay the all fees due. It used to be that you could get a temp op permit by just doing that and get multiples i.e. one runs and you go back and get another till the car is smogged. The law has now changed.

Each car is allowed one temp operating permit per 2 years. You also have to pay a $50 fee for that permit. If you pay all back fees and you pay that $50 fee the DMV will give you a temp op permit. If you get lucky someone may let you slide on the fee . Ya right LOL

The idea behind limiting the temp op permit is to keep down the number of cars running around not passing smog. I.E. fix it or take it off the road.

Damn Frank you posted right as I was typing LOL.

Oh I should add that depending on the DMV employee when you pay the $50 fee they have the option to give a month long permit. I know I have done this before . LOL

so my Q was do i have 7 days to register the car and get it up to date? i need to get to work and i dont have any other way but this car. If i got pulled over b/c of expired tags can i say i just got the car and show them the bill of sale? or does it not work like that?

You're supposed to register it within 10 days but that doesn't mean you can legally drive it.

If a cop pulls you over he can technically site you and possibly impound your car. the only way that you can operate your vehicle legally is by having a moving permit be it a month long permit or a day permit.

Some of you guys here really like to be spoon fed. The link provided up top answers questions, if you go to the DMV website it will answer your questions, the responses here answer your question...

... just call or go in person and find out for yourself. if you have enough time to read through this then you have enough time to call or visit the website at the very least.

no....the car is not registerd nor legal at this point to be driven any were..and u will get a ticket to goto court showing u did eventually get the registration....so basicly ull get the ticket pay for ur registration and waist time and more money..i suggest u start askin for rides lol...
