I just got a fix it ticket for my exhaust .... DON'T START... I'm new to this forum and I'm sure there have been thousands of fix it ticket threads, and especially about this topic but i would appreciate any help seeing as how this is my first fix it ticket thank god. i have an 89 fastback, STOCK KA24E motor, and Apex N1 Exhaust, bought the car that way. cop got me for 27151 cvc, noise/modified exhaust ticket. i just wanna know what to expect from all this. STATE REFS, the price of db testing, court fees, if i should just put stock exhaust on (which i dont have), if i should test with the N1 (pretty loud so i doubt it'll pass). I've researched all the codes so please dont start copying code descriptions from the dmv, or tell me to go to ticketassassin.com. everything is stock, stock airbox, still have the cat, just exhaust, car passes smog with flying colors, it even thanked me for having a car that exceeds state requirements ahhaha. but smog isnt the issue. so i just wanna know how much all this will cost me, and what steps i should take, if i should be a bitch and give in and pay, fight it, or what, im totally lost and broke. so any help is greatly appreciated! please dont bash, im not here for online arguments. oh i dont know if this helps but it was a bike cop

chill out.
the ticket is exactly that, a "fix it" ticket.
fix the exhaust, go to a cop station and get it signed off, take that ticket and goto the court.
court place should be on your ticket
it'll cost $10
put your stock exhaust back on, or borrow one from a friend.
if you don't fix it. i think it's $119 at court
well, thats how it is in norcal anyways.

I have the N1 dual, the silencer is 90 bucks(x2 for me). Get it, run it open, if and when you get a ticket put it back on and get it inspected. Meanwhile dont drive around with anything you wouldnt want police to see as you're rolling probable cause to be pulled over. As far as now get the court date postponed and source a stock exhaust and or arrange something to pass the police inspection in the meantime. Good luck. I've paid for a 240SX over again in court fees, not fun and in a small town you're destined to stand out.

don't worry 95zilvia im chill, haahah, but i just worry a lot since im flat broke. if i put a stock exhaust on do i still have to go to the state ref for db testing for the violation? i have a cop friend who could probably sign it off but would that be enough or is there more to it? thanks for the help on such an out-dated question guys. i dont have the silencer my friend ran it over while it was in my garage oh one more thing? if i do have to go to a state ref should i do it before i even get a courtesy notice or wait? thanks again

When I had my exhaust "fix-it" in California, I had my cop neighbor signed it off for me. I paid the $10 for the violation and that was the last fix-it ticket. You don't have to go to the state ref, state ref is for tampering with emission control stuffs. IIRC you could take it to the CHP to have them test it for you to see if the decibels (sp?) is within the legal limit, but I think that would cost you some change. Just have your buddy sign it off and call it a day.

i got this same ticket today, and it says non correctable offense, does that mean its not a fix it ticket? the cop didnt say much i really didnt want to talk to him cuz he made me pop my hood and i was freaking out cuz i have an sr and i wanted him to go away as soon as possible, but i got away with just the muffler thing, so do i fix it and pay 10 bucks or pay 119 and move on with my life? u guys know? 27151 vehicle code

im also wondering what are the laws on him checking under my hood because i saw that video on here about san diego police training which i cant find now but he did the same routine and told me that my exhaust was probable cause to check under my hood , i refused he said he would have to arrest me and check under my hood anywayz, im curious if i refused would the muffler be probable cause to screw me?

anywayz i got lucky in this matter he didnt notice anything im just curious for the future because if i get pulled over for something stupid, not racing he shouldnt have probable cause, he even asked me if i raced and i was like hell no this is stock haha....but yeh i got lucky.... let me know what u guys know or think

Okay so I go through this a lot up in NorCal with cops. The law states that it is legal to modify exhaust from the Cat back. It says that this is completely legal so long as it doesn't break the 96db limit. Also it is illegal for a buisness to sell exhaust that is above this limit without imforming the client otherwise, usually in written form. Finally as the modification is legal, and without substantial proof that the exhaust is illegal, you are innocent until proven guilty in the USA. His grounds for probable cause are not legal. If he continues to insist, via threatening ways allow him under duress. Make sure that you state that you are going to allow the search only under duress and that you will be filing a complaint because you believe this is a violation of your 6th ammendment right. Contrary to popular opinion, the moment he turned on his lights the entire conversation is recorded from a mike on him, and videoed by a set of cameras on his car. This is all part of evidence that WILL be used if you fight the ticket. Make sure that you get his name and badge number after the search and file a complaint with his reporting officer. It is constitutional right to privacy. Using exhaust as a grounds for a search and seizure is like saying because you have a lighter on you he can search for marijuanna or crack. He CAN'T cause a lighter is legal to have.

Also don't be dick, just state the facts, go down to the DMV and for like 6 bucks you can pick up the California Vehicle Code Book. It comes in really handy. My experience has been that cops assume that "kid's" (i use this term only to represent how cops feel) with modded imports aren't familiar with the law and are trying to take advantage. Every cop that I have told what the law states has backed off after he realized that I was informed of my legal rights.

Also last time I checked California had not yet certified DB testers for on street purpose testing of exhaust, yet! Also according to my friend (CHP accademy trainee) They have no training that teaches them to gauge illegall exhaust by hearing.

If the cop cannot provide proof that the exhaust is illegal, then you are innocent until otherwise proven, meaning there can be no search. He can write the ticket to be taken to ref to verify that the exhaust is legal.

Get the book and get informed about what a you are legally allowed to do to your car. Keep it in your car, that way when a cop pulls you over and says that something is illegal, ask him for the vehicle code and pull out the book and look.

Lastly, I've gotten all this info from the CA Veh Code book. As to how i've learned to deal with cops it's from two friends that are cops. Being a dick to them won't get you anywhere. Proving your not another dumbass with modded import, usually, does though!

PS The book is big and comes in handy for a booster seat and a bludgening tool, LOL!!

As for the no correctable violation part, it means that you have to take it down directly to the office of the issuing department. If correctable had been marked it would be correctable by any law enforcement. By marking non correctable it forces you back to them for the check and can't just have a friend sign it off.

Let me guess, CHP??? They are notorious for that cause everytime they have given me ticket that I had to take to them (usually I get them for no front mount liscense plate, or no liscense plate lamp on the rear) I've never had someone sign off on it, with a rank less than sergant. So I think that a ranking officer can only sign off on it. Could be wrong and it could just be coincedence.

ive gotten 3 modified exhaust tickets. all 3 of them were written off. my 3rd ticket also had an extra violation, REPEATED OFFENSE. i couldnt get that written off so, THAT add 1 point to my record.
