View Full Version : Has anybody fought back against highway dumptrucks?

Has anybody ever fought back against dumptrucks that drop rocks on the highway?

I was driving home on the highway and a dumptruck dropped rocks for a good 10 mile stretch of highway at 65-70 mph. Not just one or two rocks, about 2-5 pounds in many spurts. If I saw that it was dropping rocks before I actually got hit I would have fallen back and just let the truck go. But it came off of a ramp and was infront of me and the rocks put two cracks in my windshield and a bunch of white scratches all over the car. I then managed to get the liscense plates on the truck and the one in front of it, the company they were with, some camera phone pictures, and a rock that was jammed in my hood.

What can be done dealing with the trucks?

uhh, call the company and tell them what happened...i'm sure they'll fix your car

call your insurance company...if you had full coverage they might be able to help you out. If that doesn't work get an estimate and then call the dump truck company. That way you can tell them how much damage they did. If that doesn't work you caould try small claims court.

Some states require insurance to cover damages from falling debris from trucks ie Florida residents with insurance get a free windshield annually. If I were you I would not let the matter go and pursue it first with your insurance company.

how old are you? this will probably matter...

if you are like me, 19-20, then they will just laugh at you... get your father or someone older to call them up and threaten to sue them...

its amazing how they respect older people... the older you are, the more tight with money you are, the more likely to sue over little stuff lol

Even worse.. I'm 17 I guess they're gonna come and piss on my car when I tell them what happened. If I go through my insurance that will be -1 for the claims I can make before they decide to squeeze more money outta me. And for me to suck it up would mean I'd have to spend 150(or more) +labor for the new windshield so thats probably a little less than a weeks pay for me. So thats not cool.

This situation has been talked about on Raleigh's N&O newspaper in the last few weeks. Most of the police officers they have talked too said there isnt much that can be done, however, falling rocks and rock debris has been the cause of several fatal accidents in Raleigh. There has been lots of construction going on lately(for the last 10 years :P), so people are frustrated at this. With all the information you have, you might be able to report that to the police department. They are cracking down hard on truck drivers around here citing them for weight issues and carry their load improperly. Im not sure this helps you much, but they might be able to do something. Also, your dad could have been driving, so just act like he was when you're dealing with the police and the truck company.

You're also not supposed to follow those trucks closely, there are warnings on the backs of most of them.

in california, if debris fly from a in-dump trunk, the company can pay for it. IF you can prove the damage was done by them. Tell them the date, time, and the number of the trunk. If the trunk doesn't have mud flaps, then you automaticly get a new windshield. This is the trick most people use to get a new windshield and i'm going to do it soon. I'm going to get on the 710 or the 604 freeway and find the most ghetto dump trunk. Send them the quote for my windsheield and wait for my check. I know a few people that have done this and it works.

You're also not supposed to follow those trucks closely, there are warnings on the backs of most of them.

Too bad you're close enough to get hit by falling rocks if you're close enough to read the warnings.
