who's the prick? the seller or the buyer? its not the sellers fault that the buyer cant pay up, and its a hassle trying to resell ur stuff, especially something of value like that. im on the sellers side, make the guy pay for his mistake.

The seller is being an asshole. Can he just relist it. He aint going to loose money. It was a "buy now" not a bid so its not that bad i mean if he was bidding against other people and jacking the price up then it would be kinda bullshit.

he still had to pay for the listing, b/c someone "bought it"

"The lawsuit is seeking for Shepherd to pay the original bid, along with $150,000 in damages."

With a 240k+ selling 'price', it's going to be a nice chunk of change out of his pocket.
I guess maybe the damages he's concerned about is now when its going to be relisted, possibly buyers may be weary that something is wrong.

damages most likely = 'selling price' charge from ebay and lawyer and court costs.

The seller is a POS. I would make the mistaken buyer pay the ebay fees and then have the seller relist the item.

whats the percentage of ebay seller fees, out of 240k? its probably quite a bit. so yea, its understandable that the buyer wants to make the guy pay for that, and the lawyer fees.

Ebay should step in and do something. the guy shouldnt be fucked cuz of his daughter's mistake, but the seller shouldn't lose money either

Do you idiots ebay anything? When someone doesn't pay for an item, you report it to ebay. After 7 days, you get the final value fee back, and can relist the item for free.
The guy is saying that he won't get near the ammount of money selling it a "second" time. Which again is BS.

Ebay is not a legal contract.
That said ebay has made all there rules so only ebay wins in these disputes. The buyer and the seller both get screwed when things don't go to plan. I wish there was good competition in the US (like yahoo JP).

The guy agreed to paid the money. He should have paid the money. No excuses. If he can't afford it,he should have not agreed to pay the money. Period.
His daughter accidently hit a key on his computer? When you close an ebay page, even if it recognizes your ebay name, you have to type in your password, from there you would have to go to the ebay page, click on the 'buy it now' logo, then have to click on 'confirm bid'. Thats not a fucking wrong key on a keyboard...

Is it just me or is ebay like a self sufficient android server that needs no human interaction and sits back and bills people without flaw, delay, or human error. You can NEVER get a real live person to talk to you on ebay. Believe it or not I got through to a seller represenative to dispute some charges for listing fee delays. and in regards to the percentage on 240,000 it cost me 70 bucks to list my bike and sell it at 4,000. So it's pretty steep, especially on that much of a selling price.
