First off.... I hate Stupid people...ALOT!!

This is what happened, its an odd situation, but here it goes if anyone cares. I was on the Highway and there is a stoplight as it goes through the small town i am in. I am at the Light behind a 02 Volks Passat Wagon. We start to go when it turns green, I am following at the standard distance going a normal speed. The road was re-worked last year and it is quite wide, huge bike lane. We get up to about 25-30mph and all of a sudden the VW seems to have STOPPED moving, no brake lights to be seen!! I notice this and since she is still right in the middle of the lane I hit the brakes and try to cut into the bike lane.... But I didnt make it, I hit her rear pass. side corner with my front drivers side corner. Right as i was about to hit her the brake lights came on!?! Once we came to a stop I see her reverse lights come on!! and she scrapes back i bit more on my fender, i was like WTF! We pull off to the side of the road and i walk up to her car. She tells me "...it was making a funny noise and I just wanted it to stop, so I put it into PARK..." &nbsp; <img src="http://www.zilvia.net/f/iB_html/non-cgi/emoticons/wow.gif" border="0" valign="absmiddle" alt=':0'> &nbsp;OMFG!! &nbsp;<img src="http://www.zilvia.net/f/iB_html/non-cgi/emoticons/eh.gif" border="0" valign="absmiddle" alt=':eh:'> &nbsp;PARK!! she threw the damn thing into park and then hit the brakes when she stopped! she made no attempt to move the the lane sized bike lane, I was shocked.
So, the cops showed up, they heard our story, she told the truth thank god. And after the cops looked at everything (tiny skid marks, story and damage) they stated that she was clearly at fault. and They actually wrote her a citation. Thats good. But I am worried about the insurance saying it was my fault since I hit her from behind. even though the cops said it was her fault. &nbsp; <img src="http://www.zilvia.net/f/iB_html/non-cgi/emoticons/nervous.gif" border="0" valign="absmiddle" alt=':nervous:'>

Dude, I'm sorry to hear about that, people can be so stupid sometimes. The insurance company should realize that it's not your fault, even if it was you that rear ended her. If they try to make your insurance pay for the damages, then just have the cop make a quick statement, I'm sure he'd be happy to if asked politely.

When I had to make a statement to the guy who hit me head on (in a different car, not my 240), basically I tried to make it as clear as possible that he was in my lane. In your case, you should make it as clear as possible that she made no attempt to move to the side of the road into the bike lane, where there were no bikes present. On top of that make sure that you emphasize (sp?) that you do not stop in the middle of a public street for any reason, unless it's a stop sign/stop light. &nbsp;You should be able to get her insurance to pay for it no problem.

Ouch. &nbsp;The lady made a pretty stupid move, but she seems like a good lady. &nbsp;At least she told the truth. &nbsp;and i agree, if the police find her at fault, i dont think the insurance has a choice.

seriously, you are a lucky guy that she's honest... irrational (like many women), but honest at least. If she lies to the cop... it's your fault. Her rear and your front is damaged, that's per se your fault in traffic accidents.

Some people annoy me. I find myself in situations like that constantly, but luckily i've avoided all of the accidents. One of them I was about an inch away from (some dumbass that decided he was going to stop split second while he was turning off, I had to swerve around him) Then there's the usual person that's in the turning lane but decides they want to go straight with you anyway... If she had used her normal brakes she might not have been at fault... but she didn't. &nbsp;Failing to signal her intentions is probably what made it illegal (i.e. using BRAKES instead of PARK like a sane human being). &nbsp;
You can't say he should have been able to avoid the accident since he obviously made a good attempt at doing so, even though if he was paying more attention he might have reacted earlier. &nbsp;The problem is, with no brake lights, you can't really be sure what the car is actually doing, which then causes the brain lapse that is confusion, slowing down your reaction time.

been there had a old Chinese man in a Van stop dead in front of me after he started to go at Garfield ave off the 10 In Alhambra . it sucked . In Cali you are technically at fault anytime you strike from behind be it on the rear or the side.
I collected off my full coverage and am currently fixing the damaged bumper . Well, I will find out this week whats going to happen with the insurance and everthing. Tomorrow I am meeting with my insurance people and i will get some details, then get a copy of the police report, and head to the body shop. If it goes my way which it should I might go ahead and do the s14MC front end w/ the lip. I dunno yet though.
