I went to go pick up my baby from the impound lot today after 2 months, and i found it with the passenger window broken out and the door open......not only was everything scattered around my car(glass and stuff out of my glove box) but we had just got a real bad ice storm. so the interior of my car was covered in a quarter inch of ice. I realize i messed up and that is why my car was in the impound to begin with....but do you think the impound lot should be responsible for the damages??? Oh yeah nothing was stolen from it i guess i was lucky they were only after my car for audio equipment...(and i don't have any, just adds weight...imo)...oh yeah i also don't carry full coverage insurance because it is too expensive so that isn't an option....i guess i will be calling them tomorrow to find out...

Yeh the impound lot is responsible for the damages. Unless Minn is REALLY gay with the laws, the impound is absolutely responsible.

If you plan on filing a claim against the impound yard for damages to your car while it was in the yard, best bet is to play it safe and document EVERYTHING!! Names, dates, times, who you spoke with and the nature of the conversations. As your vehicle was broken into while it was in the impound yard, call the police and file a theft report. Before you confront the people at the tow yard about your theft, check the Minnesota laws regarding vehicle impound lots. Technically the impound lot is responsible for the safeguarding of your vehicle while it is in the lot..your state law will indicate what that responsibility is. The impound yard should have a sign posted stating what it's, (the impound yard's), responsibilities are.

Not sure if this applies to Minnesota, but in California you can legally sue a impound yard in small claims court for three (3) times the amount of damage done to your vehicle while it was being towed AND while it was in the storage yard. All you have to do to collect is show/prove that the impound yard was responsible for the damage.

Best bet is though before you proceed is to first contact your local police department and have them take a theft report for documentation purposes only. You can use that theft report at a later time to support your claim. It's gonna take a lot of research and work on your part, but the effort may be worth your while.

Anyhow, hope this helps.

thanks a lot folks...turns out they aren't gonna cover it because it was my fault that the car was in there...and technically it wasn't my car(i had to sign my car over to blue earth county) but the brighter side of the story is that i found a window out of a wrecked car for $110. Thanks for the info though..

sooo if your car had been completely destroyed and junked it would have been, "oh well, it wasn't your car while it was here anyway"...i doubt it...

way to go, i sense a divorce victim. did you check with your local police? i can tell you its not my fault too but its not always up to them to decide. did you just take the guy at the counters word for it or did you read any fine print, sign anything, or talk to the police?

I feel bad what has happened but screw them, I'd get a lawyer in a heartbeat and make sure to get the name of the person who said that crap. Like mentioned before, document everything.

You may not be able to go the lawyer route but don't let them get off that easy.

sounds to me like something might need to fall through several of the impound lots windows if they don't want to cover it. sorry but its their fault the impound lot is there in the first place right?

well no i didn't just say oh..well.....i talked to both my attorney and the police...i filled out a police report as well as a report with the impound...and to me no it isn't worth forking over any more money for my shitty attorney to sue the impound for a window....everyone i have talked to (police, attorney, and impound) say that they are not responsible for what happens to the car while in the impound...and personally with all the legal trouble i am in at the moment...i really don't have the time nor the funds to do anything but bend over and take it in the @ss. On top of that i am lucky to have even got my car back...In the state of minnesota felony fleeing is automatic forfeiture of your vehicle...and as far as the $100 for a window...my car is currently parked outside in town...so the fastest way to get glass in the whole, for security reasons, was to shell out 100 bucks(and i find it hard to believe that you could find a door for $50 in minnesota....i could find it in another state but then after i pay for shipping it would end up costing way more than the 100 just for the window)

nokeone....sorry about that, i didn't mean to come off as a dick...i was just trying to state that i have tried and am getting no where....and 240's around these parts are pretty hard to find in the salvage yards. as it is they had to order the window from bum f*ck egypt.

werd...and to be honest..sometimes a $100 is easier then the hassle...i know i've elected to shell out a lot more then that to avoid the time and effort it would take to get something done through another course of action...

sometimes it really is better to just let it go, chalk it up to experience, and move on..:)..gl with everything..
