View Full Version : Accident/abruptly cut off by motorcycle

Quick rundown...
So I pull out of my neighborhood from Superstition onto Chandler Blvd, making a right hand turn onto chandler. Chandler Blvd is 3 lanes each way at this point. I accelerate to 45 and remain in the right hand lane. Just as I get to the texaco station on the right, a motorcyclist with a passenger makes an abrupt turn from the far left lane (right next to the median) and cuts directly in front of me across 2 lanes to turn into the gas station. I swirved and hit the brakes but clipped his rear end.
He got cited for an illegal turn, and I got cited for "speed greater than R/P to avoid collision". The speed on my citation is 45mph and the speed limit is 45. My 50ish yr old neighbor was with me and confirmed all of the events with the police.
The motorcyclist is in some motorcycle club and the first thing he did was call his lawyer or some motorcycle club guy!!!!!!! NOT 911!!!! his passenger was on the ground bleeding and he was yelling at me and calling a lawyer! Both people on the motorcycle were flown to the phoenix trauma center even though both seemed to be ok..
So anyway, looks like I'll be getting the paint matched on my front end :rolleyes: ... Wonder if they will cover the navan bumper, CF hood???
Anyhow this is a sad day for Zenki's around the world :angry: !

take your ticket to court, if you dont i'll slap you. you also might want to get a lawyer lined up and be ready to counter sue to recoupe your funds spend on the lawyer and the time in the court room. dont forget to point out the fact to the judge that he called a lawyer before 911. sorry to hear of the bad news = (

* looking at the "navan" ( AKA OEM AERO) in the back.. muahaha
im sorry to see that happen to your zenki s14, well if it makes you feel any better.today,my friend and i were going down this road and his wheel snapped off his g20 and his wheel flew 40 feet down a cliff, and a few days before that they were driving their kouki s14 thru a intersection and a kia taking aleft turn pull into them and totalled the car, talk about bad luck.

Dude, definately get a lawyer. How weird that you were going 45 mph and got a speeding ticket in a 45 mph zone!?!?!? Makes absolutely no sense. Keep us updated on what happens in court. I could already imagine the long drawn out battle. But I'm sure you'll come out at the end victorious. You have the right of way.

Hmmm....guy on a motorcycle turns in front of you from two lanes over & gets clipped from behind, officer cites him for illegal turn, officer cites you for doing the speed limit & neighbor sitting in your passenger side seat witnesses the whole thing.
Damn bro....that's like any attorney's wet dream....you are SOOOO in the clear that it'll be pretty damn stupid for the guy you clipped to sue you for HIS fuckup!! You could probably countersue him for damages to your car & whatever other expenses you incur while your car's getting fixed.
I wouldn't sweat it bro. You didn't do anything wrong & you've got the proof to back you up. You might want to play it on the safe side though by contacting YOUR insurance company & letting them know what happened. Chances are dumbfuck on the motorcycle is gonna say it's your fault. Your neighbor's statement however will contradict that....Any who knows, if there's another independant third party out there that witnessed the accident, his/her statement will only back up what you & your neighbor have already told the police.
Anyhow, good luck with this mess...unfortunately the insurance companies & the personal injury lawyers are gonna drag this shit out for the next 2 to 3 years. I hope your ready for it.....

99.9% of insurance companies will only cover OEM parts. now I'm not saying they won't fix damages but will only pay the price of what it would cost to repair with OEM. now since its not your fault you have the upper hand. demand they pay what brand new nissan parts cost, not aftermarket reproduction parts. most nissan brand new bumpers are in the 350-400 range, same if not more than what an aftermarket "upgraded" bumper would be. same as hood and shit. a brand new GT mustang hood for a 2003 mustang is $1200 from ford. a fibreglass cowl hood is like $400....

YES, dont let the police or any of the other party's officials spin you around. i was involved in an accident a year ago that was not my fault. due to my lack of understanding the situation and what i could and couldnt do, i got the shaft.
i was originally given a ticket taking fault for the accident, but got it dropped in court, and ended up my insurance company already paid out the other party. when i couldve easily made an appeal, and sued the other party for all damages an financial loss, as i have found out recently from a very reputable attorney.
dont get screwed, dont give up! be ruthless, its your or them! :nono:

i think isurance companys perfer to pay straight to teh shop repairing your car, unless you can talk to them about just cutting you a check for whatever you where qouted.. good luck on it.

yeah but you can usually also work with the shop if its a "tuner specialized" shop. go to a shop that specializes in body mods and shit and a lot of times they'll kick back any "profit" made from the different prices. just make sure they are ICAR certified

Sounds like you are in the clear. Wouldn't hurt to talk to a lawyer asap to get an idea about what may happen next.

That suck on the accident but like everyone said take it to court and you shall win this case.HyperTek i think isurance companys perfer to pay straight to teh shop repairing your car, unless you can talk to them about just cutting you a check for whatever you where qouted.. good luck on it. Most insurance companys wnt cut a check unless the car is totaled or the vale you are asking for is less then the what repairs would be and I think you will have to take it in to get inspected and then you can run into a problem because I know alot of companys don't insure modified cars.

i car certified doesnt mean shit anymore. a few (old) employees of our shop were i car certified...did the biggest hack work ive ever seen.needless to say, they got fired. ive never gone to any school for body work(i work in paint) and one of the guys working at our shop, i could probably do as good if not better(or atleast, less hack-y) work than him(hes I Car certified, went to collision school for two years, etc.) . he doesnt even fucking sand where he primers. :bite: so i end up fixing all of his primer all the time. you need to check out body shops very thorougly before going with them. see if theres any way you can get ahold of a customer of theres from a year back(to allow any rusty-hacky) work to show through. you'll either find three different shops...1-people dont care so anything goes out the door(as long as the customer says "wow..looks good", 2-they dont know what their doing so they think "it'll be alright" 3-the body men are well educated, know whats wrong and right, actually give a damn, the manager actually gives a damn, the painters spot things that may happen to be wrong and fix before paint, and they have a warranty on their work. im not exactly sure how long our warranty is but i know its ATLEAST two years. i think its the lifetime of the car i believe, as long as it would be attributed to our repair, not to new damage.
ack sorry for the rant, but i cannot stress enough. after seeing some of the cars that come into our shop that were repaired by other, and we have to do our repair ontop of fixing their mistakes. find out if the shop has a warranty(longer than 1 year!), talk to the manager about their processes/products/paint type/etc. etc., find out about past work. id just hate to see a 240 get hacked on, it aint a pretty thing. :hs:

I meant to make sure the shop is ICAR certified, or backed, or whatever it is. I don't know, its been a a while since I've been in the body loop but IIRC I think ICAR had their "choice" shops or whatever.

oh no i hope you didnt take that as a lashing towards you haha no harm intended its SUPPOSE to mean that its a choice shop but...like some of the people who went through the icar program, passed, and then came to work for us...they just hacked things out anyways its a game of money making, and they'll do it the quickest way to get the job done usually, and that means HACk! haha its hard to find a quality bodyman who takes his time and does it right. luckily we got two at our shop now.

I understand exactly where you are coming from, kind of like how being an ASE mechanic doesn't mean you're all that good a mechanic, or that you don't cut corners and shit. just means you have the knowledge to do it right.

my brother and his financee are bike riders and have told me about those that think they are above the law.
Same thing with handguns...
