if it hasn't been more than 30 days, contact paypal and explain to them what happened. They will try to contact him and if he doesn't respond within a certain time period, they automatically take the money out of his account and refund you.

No worries. You're protected under Paypal pilocy. It'll take a little time for them to investigate though. It's happened to me once and I got my money back after about two weeks of process.

This is why you never "gift" payment to anyone. Period.
