Ok long story short im going to court for a spedding ticket. This was on a mtn road at 11 o clock at night.
My argument is how can you estimate a speed on a road that is ever changing. From the officers point of view at the top of ___ he only saw me travel an estimated one half to three quarters mile of the seven mile road. On top of that it was night, in which you dont see the car only headlights bouncing from one side of a mountian wall to another. The points in which he was able to see traffic was anywhere from 200 all the way up to 500 yards away from his standing point. That is a wide range of viewpoints since the road looks like it comes in then moves away from you. An estimated speed is really hard to come about since you see the car for about 3 seconds before then it is hidden agian by trees ora mountian wall. It may look fast but its probaly just as fast.
Basic info: reccomended speed 35 speed limit 40 "estimated" *no radar* 45+. Please any help i go to court tommorow. Any good questions i can bring up to the officer. And one last thing im looking for the avgerage distance someone with 20/20 can view (in feet) *worth a shot* thank you

that would be total BS if u get a ticket for that. Where is the proof? I thought they had to use the radar gun for proof. Otherwise, he can just say anyone is speeding.
In a freeway if there were other cars driving with you and u zoomed right by them, then they got something to compare. Otherwise u can be going 100MPH and a cop at a distance wouldnt' be able to tell your speed.... we'll it'd be hard.
I hope you win man. That's BS IMO.

Reason? The cop is a professional in judgement of speed. What he says is LAW to the judge. Any excuse or rebuttal by you will be met with a higher fine and court cost. Best to just go in there and take your medicine. Throw your mercy on the court, apologize for poor judgement, imply that it will never happen again and you will be far more careful in the future.
The truth, they got you by the balls. Fight it, it will cost more.
Sorry, I call them as I see them. They have a license to be wrong actually.
The result, you may just get off. Anything else...OWNED!!!!!

tell the court you were only touge racing and that everyone is japan does it so its okay. if the judge says no to that, ask him if he likes being racist and how he feels about japan being a better country then ours. if that doesn't work use the takumi defense, i.e. "I was just trying to deliver my tofu on time."
this should have so confused him that he will dismiss all charges and throw you out of court for being crazy. anyways, speed limits are mostly bullshit imo. the only place for them is residential and surface streets.

well, the first question that i think everyone should know is were you actually speeding? if the answer is yes, stop whining and don't waste the judge's time. if not, then it looks like you're pretty screwed.
since you never said that you werent speeding, i'll assume that you're just trying to avoid taking responsibility for your actions.

get a (good) lawyer, it may cost more initially but to get it out of you records will save more in the long run

windy roads, were there any cars around etc. how does he know if he pulled the right car over at night, is it possilbe there were 2 cars and he pulled over the wrong one, he couldn't keep an eye on the one car, was it visible all the way til he pulled you over, or did u dissappear through a turn or 2 for a second, which another car coulda been speeding and wrongfully pulled u over instead...

Yup I thought of this about an hour before I went to court. Good stuff to add to my other arguments. I came up with a pretty strong defense too bad the officer didnt show =D haha fight the system. Oh yea to everyone thinking of fighting your ticket, I would highly reccomend it. Even if you are guilty fight it. By the time you get to court they tell you if the officer is there FIRST then you can choose guilty, not guilty, or traffic school. FYI too, there was about 15 officers and 45 people in the courtroom.

Congrats!!!!! I'm glad you got out of it. Next time, just call a friend when youre getting pulled over and they'll call "Code Blue" :)

5th or fizzzifth..... and be glad that he did not show, cause if he did you would have been assraped by him. first cause you were speeding and second cause hes a cop, congratulations though, wheres the wine.
