www.NM240SX.org (http://www.nm240sx.org/default.asp) is our baby, and we're all very proud of it. For those of you who aren't familiar with New Mexico, the centerpiece of the site is a spin-off of the zia symbol, which can be found on our state flag:

Wow. What can I say. We were under the impression that this was our site designer's original work. That's just effed up. Kinda breaks my heart. Thanks for bringing that to my attention. Not sure what we're gonna do about it, but at least now we know.

Although I the aesthetic never really suited my taste, I can assure everyone that Monique, our club founder, paid someone else, who seemed to be a legit web designer generously to design that website. Monique puts alot of work and her own hard earned money into our local chapter and naturally wanted the best possible site for out group. So she paid someone she heard was good to design the site. The ripoff had nothing to do with our club.
Mike S13 although I don't tolerate stealing of other people's designs (I am a designer and artist myself) perhaps you should have thought about the possibility for this and not just assumed the club members are the ones plagiarizing the designs before you go off trying to tell on someone. I understand your point of view and feel the same way about stealing of designs, but the members of our club are veru dedicated 240 enthusiasts just like you, and thanks to your busy body actions now WE have to deal with the copyright crap instead of the designers. I hope you felt important for a minute or something. Not only did Monique get ripped off and our club get a bad rap for something we could not have known about, but now we have to deal with your bullshit. Thanks alot. :mrmeph:

First and foremost, I sincerely apologize to the members of the NM 240sx club for this minor confusion concerning our web site's graphics. Steps have already been taken to remedy this matter and our site. I assure you that it will continue to be an exceptional expression of our pride for our cars. We most certainly do not need to piggyback off the ideas of anyone else and I have made this clearly understood to those that needed a bit of lucidity. I will continue to strive for excellence and integrity always; for you, fellow club members, deserve all this and more.
To you (and you know who you are) that brought this similarity to light, I thank you for it has solidified us in our strength as a group. Personally, I think it is a shame the manner in which you attacked your fellow 240sx’ers. Instead of being civil and seeking investigation or explanation if indeed you did really care, your words in fact sought only to hurt those that are innocent. I was and still am surprised and dismayed at the ease with which those of you seemed to jump onto this bandwagon. Please direct any further remarks to me and not my members.

First off, i'm not a dick. I'm a professional web site designer who makes their living creating ORIGINAL web interfaces and graphics. like any professional that has a vested interest in the value of commerical art/ design and services associated with such, I dont tolerate copyright infringment in any shape or form, whether it be artwork, music or otherwise. I will not hold back from raising red flags when i see this type of activity occuring. In my post I promised to alert the true owner of that design, eyeball-design.com. In fact I did not do this, but I can, and will if you make another personal attack on me. THis isnt a threat, it is an honest statement that I intend to hold true to if youy dont pull your head out of your ass. It is NOT my fault or responsibilty in any way for your actions in either copying this design or hiring an incompetent firm to do so for you. YOU do not hold any responsibilty for the copyright infringement, unless that happens to be your name next to the blatantly displayed copyright notice on that graphic. Dont blame me for warning you of breaking the law before a cease and desist order shows up at your office/ home.

Mike, I understand your intentions as a designer and like I said before, I don't approve of the ripoff either. I apologise for insulting you. I felt insulted myself as you chose to associate our 240sx club with something neither of us like.

How do i have my "head up my ass" when I'm just a member of an automotive club and had absolutely nothing to do with the design of that website? There was no way in hell I or anyone else in the club, who are just other 240sx owners like you, could have known about the ripoff. And how is that not a threat? Are you going to only consider silence or my grateful congratulations for being such a "valiant designer" as "pulling my head out of my ass?" I already said nobody in the nm240sx club had anything to with it.
I will repeat myself and say that I DO NOT approve of the ripoff and am not defending it, but don't think that you need to be so rude to our club in general, and I AM defending the club, not the website design. Once again, the designer was NOT a member of nm240sx.
Just because you are a "professional web site designer" doesn't disqualify you for being a dick, as indicated by your attitude above and in every post on this thread. Big deal, I am a designer too. And based on MY knowledge of copyright laws, since I am more than just a cocky designer who needs to feel for important or "professional" by being a jerk to people who don't deserve it (like you), I'll show you what the part of my head not "up my ass" knows about this...
Copyright infringement is only applicable if the design is more than 80% similar. Granted, the version that was on the club's website was 20% crappier, but still 20% different. Our website is not used to create revenue, and the guy who ripped off the IMAGE only copied the IMAGE (yep, just the .jpg of the blue and grey shape, and still changed it) NOT CODE, FLASH OR ANYTHING ELSE, and it was still different.
In addition, eyeball's website pretty much explains exactly how to create the exact same design in their tuorial section. I will agree with what is obviously your opinion that he should have used this to create something more original, but YOU HAVE NO PROFF THAT HE DID NOT DO JUST THAT TO CREATE WHAT WAS ONLY A SIMILAR IMAGE. The fact is, he very well may have.
No matter how lame, bearing resemblance is not copyright infringement.
All of these factors are strong legal defense against that big term you like to throw around -copyright infringement.
All I am trying to say Mike, is that you have gone out of your way to attack our club and automatically associated US with the copyright infringement, when you yourself just said that we are not responsible. So the fact that you KNOW we are NOT the ones immediately responsible for the supposed copyright infringement but still clearly act as if we were says something.
Even though I respect and share your desire for originality and integrity in the design world, I don't understand why you care so damn much and are willing to drag our club's name through the mud just because you think you can hold so much damn power in the design world, or as this suggests, feel some inadequacy in it, and need this too validate yourself as a member of the design community. Well here's an idea, try having a little bit of sense of integrity in the 240sx communuty. Anyway, I'm back to my own big, bad design job now. I wish you the best of luck as a designer without having to tread on others, and maybe some positive realization in what could be your friendly national automotive community.
