I dont know if this belongs in off topic but ill just post here.
Well today after school my car got hit by a jeep cheroke :bash: .A girl backed into me while i was parked.Me and my friend had just got in the car and i had closed my door and all of the sudden SMACK. shook the whole freaking car. well anyways what had happend was i guess the girl was backing up and not paying attention and she hit my rear passanger 3/4 panel nice crease and dent busted my tail light and took a lot of paint off my bumber. I called the cops got a police report and everything.BUT the cop wrote on there that i wasnt in my parking space all the way the reason why is though my parking spot is right next to the main road and its either get my front end taken off by another car or not being in the spot all the way SO is she still at fault i mean she chose to back up and everything i hadnt even moved yet, i have witnesses. I was just wondering if i was at fault b/c i dont want to have to pay to get my car fixed.Just wanted yalls guys opinions. Thanx

wow that sucks...fuck that stupid bitch, Its obviously her fault. Get a lawyer and take her ass to court. It doesn't matter if you were in the spot or not she hit you, whether you were stopped or you were both driving.

that blows! I almost hit a saturn similar to that,I went to back into a space,and the guy nailed it and flew behind me right where I was backing into.....anyway how bad is the damage? Did you get the witness' contact info?(hopefully)
Just think,you should be able to get a new paint job out of it (not like you proble need one,but still)

UPDATE: well i went and got an est. on my car today and its gonna be 1400 to fix it.We still have to get intouch with the girls parents that hit my car to see what they wanna do

same thing happened to me....some fucker was backing up there car while I was in the middle of the parking lot...completely stopped because of a line of cars. Anyways...he hit me in the rear 1/4 panel and missed my taillights. The cop said that since its on private property it has to be handle by us. There were a shitload of witnesses and the guy admitted fault on the spot. Basically..all I did was inform my insurance...and tell them that all this ish is going to be handled by the person at fault and they (my insurance company) does not have to make a claim. So...I call the guy's insurance company to file a claim and eventually they gave me an estimate, contacted their client and cut me a check. :)

Not being hot alone is grounds for murder. If I were you, I would so be down for skipping during a period, jacking that shit up and unscrewing the oil filter juuust a tad...if it's a Cherokee you may be able to just slide right under. Being both an ugly woman AND a Jeep driver, she would call a repair shop...if she asks you if you did it, say you didn't do it, and give her one of your friends she doesn't know's cellphone number as a repair shop. Have your friend say that the problem is her "transductive oil chamber ejection port," and you can't get it from a dealership because it breaks so rarely, only in accidents. Have her pay $500 for that shit, tighten up the oil filter, chill for an hour, come back outside and split that with your friend.
Oh yes, revenge is sweet.

damn that sucks man...I feel you on that one. I got rear-ended by a wrangler with a mean ass brush guard. The damn thing seemed to damage everything on the back of my car...lights, trunk and bumper.

Just call her insurance company and put a "claim" out. Out of curtosey, you should call her and ask her if she would liek to pay for it out of pocket and not go through insurance (but get a GOOD estimate first), or if they would like to go through her insurance.
If you were parked, it was her fault. Plain and simple.
If, and only if, she starts to balk, then explain that you can bring legal action into it. but, this doesn't sound necessary. just call her insurance company and put out a claim.

report it to insurance...this is why it exists...they have lawyers...they deal with this everyday..leave it to the experts...don't waste your time, money, or energy...

sorry to hear about the damage. bottomline if you were not moving and she was, its her fault. i have a feeling the cop felt sorry for her b/c she was a girl and put that down to appease her a bit. as other ppl said, contact her and ask if she wants to pay out of her pocket (and have costs on hand and ready); otherwise just report it to her insurance company.

yea were trying to get intouch with her parents first to see if they wanna pay outta pocket so her insurence wont go up.But they havent called back yet and im starting to get fed up.
