View Full Version : Sold a car but buyer hasn't picked it up yet.

So I sold my s13 to a guy on July 7th. He paid me in full and a bill of sale was made that he signed and the title was handed over. In the bill of sale we had agreed that he would pick up the car within 30 days after the purchase date. If he failed to do so I would then no longer be responsible to store the car in my garage and park it on the street and I am not liable for anything that happens to it then. His 30 days are up on the 5th and I haven't heard a word from him. Does anyone know what I should do?
Try contacting him and see if there is a valid reason for not picking it up yet. I'd personally see what the issue was before I threw it on the street.

I really don't want to put it on the street but I really don't want to keep storing it in my garage. I don't feel it is my responsibility to contact him. I'm just wondering what I should do after the 30 days. What are my rights if I keep it in my garage after? What are my rights if he never picks it up? Can I keep the car, can I resell it. Just taking extra precautions. I read that I can charge him storage fees for not picking it up after the 30 days agreed upon.

Sorry I should have stated this before but the reason why I agreed to hold the car at my place for 30 days is because this guy travels alot shooting videos and stuff so it was hard for him to setup a pick up date. Due to his traveling it is hard for me to get in contact with him. I have tried calling him and haven't been able to get a hold of him. So I stopped trying. He told me that he would pick it up within 2 weeks after I sold it to him.Unfortunately, I don't think anyone here is going to be able to help you with this situation. What's wrong with just calling the guy to see what's up?

Interesting situation you are in. im not sure what you can or cannot do but i would atleast hold it for a extra month. If anything charge him a extra fee atleast if it goes well past the date. If he still doesnt pick it up after a while I would get a new title under you name and just try selling it again but it seems like the guy is really busy or very careless. I know that i would atleast keep in contact with you if i paid you in full for a car.
The only similar problem i have had was when someone left a deposit but didnt come after 2 weeks so he lost his deposit on it, but i didnt give any title and it wasnt the full amount lol.
Id try contacting when convinient over the next few days since its getting closer to the final pick up date. After that Id assume the care is still yours. Go buy a fast title and keep it. Just make sure whatever you decide that you have a few things handy: Copy of bill of sale with terms (dated), Call logs/text record of contact attempts, and a new un signed title sometime after the 5th. That will keep you safe for any legal action if that were to occur.
Were there any other verbal terms that were not documented?

and there you have an answer. Its funny how common sense just makes things work out. Seriously dude you should have just called or texted him in the first place. Its the decent thing any friend would do.
Oh and really storage fee of $25 a day? What are a damn impound yard? That is a little on the steep side of things. IMO

Hell, Parking at the Airport is cheaper. LOL Long term parking can be had for anywhere between $6 a day to $10 a day which will get you covered parking and valet service. LOL

I'd charge $25/day too for garage space. You are putting off storing/working on your own car because of it... Hope you get rid of the car soon.

It just so happens as soon as I tell him to I'm going to charge him $25 a day to store the car he texts me back all quick when other times I've texted him i hear nothing? I already have given him 30 days to pick up the car and being more than reasonable with him. Who let's someone store a car in their garage for free? He is not my friend nor do i know him personally. It's my property and I would like to use my space.
Anyways its irrelevant now. He said he is going to pick it up Saturday morning. Let's see what happens.

i think if he didn't mention something like that, the buyer would have just brushed him off until it was convenient for him to pick up the car.

Honestly, the buyer has some few screws loose. I concur that he's just taking advantage of the situation. I, for one, would let him deal with the impound lots after 30 days...and a couple street sweeping tickets.

if you new owner didnt pick the car up yet, he probably didnt register it yet either, which means you would get any tickets and storage/impound fees, not him.

^My grandpa sold a car and a similar deal kind of happened... Buyer paid via paypal (through ebay), and he never heard from the guy. He waited over a month, still never heard anything... So eventually he ended up pocketing the money and re-selling the car. There was no title transfer, or bill of sale or anything in his case though. He did try contacting the guy numerous times, it was really weird.

If he has put it in his name you can lein sale it back into yours. Without the dmv being able to get a hold of him, the lein sale should be easy. Then youre free to do what you want with it.

When i sold my coupe i held it for 2 months for the guy but i did this knowing he was stationed in japan and couldnt come get it. He even had parts shipeed to my house and i installed them for him just to make sure as the seller it was everything he wanted.
If the guy has proof of sale you can not sell the car again without being taken to court about it. Plus its morally wrong and karma's a mean bitch.
Nice to see you got ahold of him but to be a nice guy i would wait on charging him. Thats just me though.
Not to get off topic but how is Redondo i miss that place so much lived there for 4 years. Want to move back there or Hermosa i miss that place a lot.

I see that your situation has been partially resolved and just wanted to post my ramblings....
Honestly, i wouldve kept to my word (esp if he had signed on that writing) about the part where i would put it on the street if he hadnt picked it up within the timeframe.
Doing business with folks who cant get right is always risky...But its just a plain shame when they work against themselves.....:blah:

Im kind of in the same situation... Someone bought my old car minus transmission, wheels, suspension. That was over a year ago. Guy never answers texts/calls

i would just put in on the street it isnt your problem anymore after 30 days if you have a statement signed by both of you guys. but thats just me!

i had it happen to me called dmv filled out some paper work mailed to dmv 30 days later they said they have heard from to person take it to small claims court, 30 more days had an public sale. no one showed up car was mine got title back in my name. sold car a second time never heard from guy. double my profit. it take a while to do but it was worth it it my opinion

dave, 25 dollars a day is commonplace when it comes to people leaving their shit at your shop. time is money, space is money, it all costs. people need to pick their shit up or get the fuck out.
when my car sat at the body shop, i thanked them for the 2 weeks my car sat while i was sorting out the final details with my move. they didnt need to hold the car for me.. i specifically asked if that was OK with their permission.
