so for anyoone in socal anyway make sure you got carb stickers under the hood for everything you got on your motor.  i had all mine but i am just saying it could have been bad if i didnt.  so just a reminder to all, make sure you have all the carb stickers on yourcar in case a cop makes you pop your hood. and it was cool because he let me off with a warning:biggrin:

He told you pop open the hood? I would tell him t go Fvck himself! i didn't cops had the right to look into your hood and give you tickets.

thats actually not true (at least in texas)
supposedly they can search any car at any time they want because by operating a moving vehicle you can put others lives in danger...so they can search
they cant search your house because whatever youre doing on your immobile property is your business unless they have a warrant

But the point is can they write a ticket for having a non CARB turbo? I don't think it's police business to write tickets for engine mods i think it's DMV's business only.

zephyr

ya...i dunno about a ticket
we dont really have carb laws as much as y'all here in houston...although we are the most polluted city in the country

I also got pulled over this weekend and got off with a warning. My speedo is not working and I never know exactly how fast I am going. I usually just estimate from my tach. I guess I was off because I was doing 72 in a 55.

yeah well i had to open the hood and everything because he said i have to do it myself. &nbsp;they askif they can look and you can say no if you want but tehn it probalbly means you are hiding something. &nbsp;so i just agreed because i knew everything i had was legal. &nbsp;they only have the right to search if you agree or if they have a warrent i think.

of course cops can give tickets for non carb legal parts. &nbsp;its part of their juristiction because i has to do with a motor vehicle. &nbsp;they can also look into your hood if they have the slightest suspision you have something illegal. &nbsp;so if you have a crazy body kit you better hope you got your stickers. &nbsp;and dont think theyre that stupid because even if they dont know about the car they can find out using the vin number. &nbsp;like if you took off your steering wheel say for a momo w/o and airbag and your car came with the airbag thats illegal and all they have to do to check if it came with an airbag is look up the vin

actually to anything like that, they need a search warrant....this doesnt mean theyllcome back in 2days to do it....they jst get on the radio and they get one in less than 5 mins. and then u got a prob, they will search ur whole car now bc of suspision (spelling)...US Gov. Class told me this. might as well let them, they will let u go anyways if u have nuthin bad, jst dont let them think u got something...my 1 cent...or is that 2

#### yeah, cops in Cali can pop your hood and write tickets for you having a Non Smog legal car. &nbsp;

My cousins get written up all the time for there cheap aftermarket parts that don't have carb stickers on them. &nbsp; *

Teampulse is obviously stationed in Cali, so i'm sure that's why the cop asked him to pop his hood.

that's some funny shit. i've never been to cali, but i'd have to move one state over. doesn't every car there have their ECU tuned for less horespower (maybe 10 at the most) and you all get tickets for having your car too low? carb stickers??? lol. &nbsp;&quot;hello officer why yes, my air intake is carb approved!&quot;

legal lesson 1: CARB is California Air Resources Board. It only applies to those living in CA. I do not have to have CARB anything, as I am not a resident.

legal lesson 2: For any law enforcement personnel to look inside a closed space, such as a trunk or a hood requires a warrant unless there are certain exceptions (exigent circumstances, plain sight, etc. - not too many). You can refuse and they will accept that or they can call to a judge in chambers and get a warrant authorized. Note - this is a rare procedure that they are not likely to pull for a friggen header or something.

legal lession 3: &nbsp;Probable cause is a Constitutional requirement. &nbsp;IIRC, despite the Richards and Bush governorships, the Constitution still applies to Texas <img src="http://www.zilvia.net/f/iB_html/non-cgi/emoticons/wink.gif" border="0" valign="absmiddle" alt=';)'>

yes I agree with Hippo he's done his homework but here in FL for example we have Department Of Transportation cops pulling people over left and right due to the fact that their idea of probable cause for you being out of regulation can be a loud exhaust note or smoke they can claim esaping your vehicle. &nbsp;Fascist pigs hard at work violating our civil rights.

Question, what if you have a bunch of parts on your car in annother state and then move to california. Do they make exceptions for you or do you have to get inspected or what.

exactly - they now have probable cause
its so easy for them to have probable cause
and you can get a ticket for your lights not being 22&quot; off the ground

They definitely have a right to check and see if your car has passed emissions, yes. I never knew there was a law that said that no, they can't just tell you to pop your hood and open your trunk. As far as I know, in Chicago, they'll make you get out and search your car for any illegal substances if they feel like it. I mean, how do you tell some cops no. Most cops I've come accross are real pigs.

IMO
its all a trick if you say yes to search the car they can now search it
now if you say no, now they have a reason to search cause of suspecion that you are hiding something

so ether way then cansearch if they want

In florida a cop can search your car without permission. &nbsp;They can't search a house or anything immobil, but have the right to search your car under resonable suspicion without a warrant. &nbsp;(mostly because if they ask you to sit pretty while they file for a warrant...you will go away)

i dotn care about warrants and shit,

the cop can write anything he wants in that #### computer he has and every single cop from day 1 to death day minus 1, can read about every incidence you have ever come into contact with a cop, and if you give flack and getaway, you have not gotten away with anything, because the next cop will see you were a prick and now the game is over, he will take you out of your car, bend you over and insert.....

if i ever find a way to get around it and hit back, ooohhhhhh man.....

well i am a guy first of all so i have no advantage there. &nbsp;but that was my first time getting pulled over so i dont know why only got a warning, i was speeding after all. &nbsp;but he did ASK if i would allow him to check under my hood do to the fact that i have a 5'' exhaust tip coming out the back. so that is where the sispicion came from. &nbsp;of course i do not feel like telling a cop &quot;no you cant look under my hood&quot; becuase that could only cause things to get worse. &nbsp;so as long as you know it all checks out then let the guy waste his time looking other wise either dont live in california or have a great escape plan, right grant?!:biggrin:

Dude, never let a cop search if he asks! Saying yes throws all your rights out the window. If you say no and they really didnt have probable cause it will never stand up in court. What if you forgot about a little nuggy you left on your back seat or something. If you say no and they search anyway at least you have a leg to stand on. Lawyers really come in handy sometimes. You never need to have another ticket on your record. My lawyer gets me outta everything. They got me on radar twice doing 90+ in a 60 in my old escort(BAD IDEA) but the cop forgot to specify exactly when the gun was last callibrated so I got off. If you're in the Seattle area get Michael Jones. $225 per ticket, saves money in the long run...

Don't know where you heard that from but it's a lie! You do need a warrent in Florida. I don't care if my car is clean I'm not letting a cop rip apart my car (with me I don't see were they would have probable cause)

4th amendment. Probably cause is search or arrest resonably based to believe the person or place is linked to a crime.....another words, in details. this is ussually used for homes. so either way for private property to be searched-need search warrant- and probably cause will be in detail,like lookin for drugs but they find a deadbody...they cant do anything about the dead body, jst wat they are lookin for. but search warrants for car is very general, im sure. seen it happen to a friend..not tryin to prove anyone wrong, jst dont wanna see someone get misled

Heres something I've heard before about IL. If you get pulled over, you could refuse the search by the cop and request the dog. Does anyone here know offhand?.... Last time I got pulled over I called the cop by his name and asked to see the radar gun. The gun was right and he went over my car finetooth and gave me 2 more tickets after I got a sobriety test.
