So the story goes, when I tried to register my car back in march, dmv mailed the tags to my previous address. This was after I made an address change to the new address. Called dmv a month after, wondering where my tags were. They said that it was sent to an incorrect address, and they didn't receive the paperwork on my insurance, and if they don't get it, they'll suspend my registration. So I send my insurance to sacremento where they had told me to send it.
During that time, I have had several chp officers pull me over. Checking my Reg, and saying the same thing....yeah I don't know what the deal is, but you should call dmv.
Well it was in may, when I was getting my wheels put on in orange, that I was pulled over. This time the officer gave me a fix it ticket. And told me all I had to do was mail in the insurance and 10 bucks. WTF REALLY?
I've been trying to do this. So there is that story. Now I don't get this ticket in the mail "guessing he mailed it to one of my previous addresses (4 years ago...and 3 different addresses ago). I keep the ticket, check online....call dmv....they can't find a record of it. No sweat...probably was lost in the paperwork...it's happened before.
I get this gut feeling in july....keep in mind...car has been parked outside my house with a cover over it. haven't driven it since...it had some car problems.... so to continue...I go online...and check dmv...and blamo...my ticket is there...and there is no info...it says call dmv.
I call court, and they say the ticket is almost going to collections and it's now $600. I let them know that this has been an ongoing problem. I let them know my situation, and they said to schedule an appointment with the court, and see the judge.
Now I know the judge is going to ask for some type of information...so last week....while i'm at the dmv.... I get a phone call from my neighbor stating that there is a cop at my house saying he's going to tow my car for no registration. I get on the phone with the cop...and he says that he checked my registration...it does show paid...but pending...so he says I need to leave something in my window showing that i'm taking care of this.....so i ask dmv for a reciept showing I paid my tags FUCKING monthes ago....I get home...cars still there..whew...put the "PAID REGISTRATION TAG" in my front window.
My appointment to go see the judge is tomorrow. I get a phone call from my neighbor, and he says...this cop is here...and now 4 other cops are here....3 tow trucks tried to tow my car...but it was too low. they've been scraping the bumpers....and trying and what not.
I get another call.....and they got it on the truck...they broke off my front bumper to get it on there....and I have FUCKING COURT tomorrow morning at 8am to take care of this ALL!
Here's my bigger issue....before all of this happened....My wife calls me about 5 months ago...and says there is a cop driving by our house.
She calls me later that day, and he's writing down my license plate number (which he had to lift up my car cover) which my wife saw him doing....and after about 15 minutes of looking over my car...he left.
Now...before they towed my car today....the cops told my neighbor they noticed my car driving by....and saw the tags...and they said it hasn't been registered in two years....and they are towing it. (i have a fucking cover on my car.....how did you see the tags)....neighbor then said he saw my cover laying on the ground....cops told him it must have blown off.....
the cover has a nylon lining that hugs my uras kit....no fucking wind could take that off.
so there is my story....I really pissed off. I don't have time to deal with this bullshit everyweek. I've been missing work for it, taking time out of my day, fixing shit just to look presentable.
Now I know...this is what I get for having it take this long...but really. Is this how things are taken care of...what rights do I have? They can just come and take my property...even though they can see reg is paid?
Looking for any lawyers/ law officials that can give me a good idea on what to talk about tomorrow morning in front of the judge.
Thank you all for your help in advanced.

is the car parked on the street or in a car port ? if its on the street they ahve a right to look at the plate. Thats why they make car covers with windows for the liscense plate. If I remember correctly.

yes it's on the street...i don't get to park in my driveway. That's why the car cover. And I know if it's on the street...they can inspect all they want.
just found out...they legally can't tow my car till reg is expired for more than 6 months...
guess what...that's this week.

This. And depending on laws where you are, if a covered vehicle is in view from the road I believe they can check it for theft even if it's on your property. I remember having an issue with a ton of cars at my old house, and the cop that was cool with me said it didn't matter if it was covered or not, if it was visible from the street, and not say behind a locked fence, just in the driveway, a cop could check it to make sure it's legit.

well car is on the street...i know. that's my mistake. But I can't park it anywhere...it's my daily. I don't have a garage....or a driveway for that matter.
I just talked to my wife. She says my ticket is what fucked everything...becuase of the ticket...it put a hold on my license. So even though I sent my insurance in, because of the ticket...it denied it...and kept it on hold. registrations can't get validated till my license is good...license can't get validated till my reg is good.
i don't get it........i'm fucked.
on a side note...anyone know any info about towing companies damaging property to tow a vehicle?

Yea, its kind of a fucked loophole situation for you with the whole reg/insurance/license situation, but a vehicle parked on a public street is completely allowed to be investigated whether it's covered or not.
As far as the tow company, if you for say had a break down, and had AAA and they came and damaged your car trying to tow it, then you may be able to make a claim out of it. But generally if a vehicle is repo'd or is towed for a violation, illegal parking, etc.... you can try and fight it but I've never heard anyone win in those instances really. More than likely they'll just state it was like that prior or say they couldn't get to it properly because it was illegally parked or whatever.

it would be really hard for them to say that since one...it's on the street in front of my house...and two...i don't even have curbs...just sidewalks....(it actually really nice...never scrape rims)
Okay, so now I realize i'm pretty much fucked...and there's really nothing I can do other than bend over and let the nice california law....fuck me with no lube.
according to the sherrifs station. in order to get this thing fixed. I have to go see the judge tomorrow morning....show him proof of paid reg. Go to the dmv show proff that the ticket on my license will be lifted...go back to court to prove that both were taken care of, and then back to the dmv so they can give me my tags.
How the fuck can this be done in a day. Oh, and if it's not done in a day....wife said it wont be released.

Yea, just saying from experience. I knew some people who did repo/had a tow company and they said when it came to cars that were "illegal" or needed to me removed liability was more or less placed on the person at fault for having parked there when they shouldn't of if that makes sense.
Good luck though man. Stories like this are the whole reason I'd never move in with my couple of friends in California.

10-27-2010, 05:42 PM
yeah I feel ya....would make sense that they could do whatever they want to it....
since you know about the repo stuff....what happens when shit is stolen off the car?
cause i'm pretty sure if they can get away with breaking shit...i'm sure misplacing my expensive wheels won't be a problem.

10-27-2010, 05:48 PM
Honestly, when it comes to shit like that, I think it depends partially on where it gets stored if that makes sense? I know the guys that I've known that did towing had their own storage lot for towed vehicles and were legit about what they did. But say it gets towed to a Police yard or something like that state related being that it all had to do with registration, it could be something that is just done like oh.... well this guy said it wasn't there, it wasn't there when it got here, so.... I dunno??? and they just play dumb with you. But I think if you have pictures of whatever it is that was there/witnesses that can testify that it was there, you may be ok. But again, I think a big part of it will be where it's stored.
I'd say just do what you can to get it back asap which is what it sounds like you're doing anyways to try and ensure it doesn't get moved around out of your possession and limit the potential for anything like that.

yeah....thanks again...i appreciate any help i can get. talked to my father who owns a tow company....and he said be prepared for a lot of fees.
wonderful....
so should I start a new poll... keep the 240sx/ or get married and keep the wife....lol..cause getting this car out...will not allow me to pay for the other 1,200 i have left on a 8,000 dollar balance for the wedding. haha...and yeah..i budgeted a wedding to 8k. a lot of stress. lol
whitepony22
10-27-2010, 06:20 PM
Damn man. That's alot of money/choices all being tossed up at once. But I didn't think about that before though. The storage/tow/misc fees are going to rape you just the same.
Sometimes though they will work out payment plans, liens on your car note even I think is sometimes worked out? All depends again on where it is and all though. If it's at a state impound yard I'm sure it'll be far more of a pain in the ass to get it out as compared to say Joe's towing service.
But I doubt a 240 is worth more than your wife lol.

this is true.lol
yeah...i was also reading...that since there were four tow trucks called...i may be charged a fee for each one....because they all had to do some type of work.
the ticket had already reached 6 bills....so i'm pretty sure i'm looking at over 1k in fees....
this thread now should be changed to..."how much can CALIFORNIA get out of me for a 10 dollar fix it ticket". lol

10-27-2010, 06:27 PM
Are you getting a hearing for all these fines? You could maybe take a plea bargain and try and get your shit lowered and in a payment plan like I said. That'll probably be your best bet.
And yea.... the tow truck/s issue is just going to suck. No real way around that.

so california pretty much committed grand theft auto due to their own incompetence and then pretty much doesn't have to be responsible for their stupidity. When gov't utilizes it's police to steal from the people is when the people should rise up and kill them. No amount of legal lobbying will ever fix the system. Bodies in the street will.

sorry to hear of all your problems and how its snowballed out of control...i know this isnt what you want to hear, but your initial problem and each individual one after could have been easily taken care of...
as for your car being towed and damaged, youre SOL...though it was covered, its still parked on a PUBLIC street without proper reg and in the end, its also a LEO's job to investigate and get rid of hoopties (not saying yours is) and disabled cars off the street...also wouldnt be surprised if some neighbors complained about your car being there over time...youd be surprised how meddling and annoying some neighbors can be...
i had a similar issue with one of my past bikes...i was lagging on reg and left it covered, moving spot to spot...one day i noticed the cover was put back on half assed and parked at a different angle than i usually park...not only that, someone obviously dropped it, cracking most my fairings on one side...i suspect (and am pretty positive) a cop was snooping around and also attempted to tow it, but dumped the thing...like i said SOL...
and the cop was right, you could have easily went to the courts and show your proof of insurance, then pay $10 and have it cleared...ive had to do that on a few occasions...annoying, but so simple to fix...literally takes 5 seconds with a clerk to clear up...
in case you were wondering for future reference, if your registration process is ever being stalled for whatever legitimate reason, you ALWAYS request for a temporary sticker...its those colored squares with a number you put on your rear windshields...if there is a hold up in the process and you need to drive or park on public streets, those are life savers...
remember, in order to drive or even be PARKED on public streets, you are required to have paid and current registration...otherwise, you should temporarily register it as non-op and have it on your property...sucks, but there are really no exceptions...
like i said, you probably dont want to hear any of it, but a lot of things could have been easily prevented...but now that everything has happened, from my experience (and other peoples), youre SOL...although its likely theyll either reduce or expunge some of your fines, the damage you incurred is definitely a lost cause...especially since your car is modified, they might even charge you more for "the extra effort and equipment" towing it! either way, good luck with everything...

Oh and just to add to what SW20 said. If a car sits idle on the street unmoved for 72 hours in LA county it can be ticketed and possibly towed if the registration is out.
I am sorry to hear about what happened to you.
Though you should never leave a unregistered car under a car cover on the street.
That is just common sense.
As far as the tow goes you should not have to pay for the tow trucks that came out if they did not actually put your car on and tow it.
Expect the tow to cost around $160 and expect storage to be about $25 a day. Seriously do not freak out over this.
Go to court take care of the shit. Get community service for part of the fine if not all of it.
They do have it in Los Angeles county. You can make it through this if you manage to keep your head and not go off the deep end in a freak out.
It will not cost nearly as much as you think either as long as you approach it will a cool head.
Good luck man and consider selling the car or the parts when you get it back. At this point with the money you're spending on your wedding and whatnot its not the time to be sitting on the car anyways.

thanks everyone for the encouraging words. Unfortunately I don't have the luxury of not parking on the street. I live in one of those front houses...where the other address is the rear house...and the landlord owns it...so i've always had to park on the street.
thanks for the info about the parking tag...didn't know I could get one for it just to sit.
and thanks...all my neighbors are really nice. The first time they tried to tow it, a bunch of them came outside and told the cop that i was at the dmv getting this taken care of.
unfortunately based on my situation, I took the easy way, dmv said to mail the insurance..which I did twice. and to no avail...nothing. It was the fix it ticket that actually put a hold on my DL, but again....always could have been taken care of quicker.
drift thanks for the community service advice...i will definitely request that since my situation would demand it.

And If my stepdad wasn't in Chile right now. I'd show him this to see what he would recommend. He's a Lt. in the LASD.

yeah so I found out how this all became a problem from the first place. I guess last year, they suspended my registration cause they didn't have my insurance on file. So there was a 14 dollar ticket to reinstate my insurance.
so everyone knows...if your reg gets suspended because the dmv was incompetant to keep it on file, then there is an 800 phone number you have to call once the dmv recieves your insurance. This 3rd party company that the dmv uses...will remove the "hold" within 3 days. I can't get even a temporary to get my car out of the impound till this "hold" is released. So I'll be going to the impound to remove the "police" hold on my car so that I can atleast get it out.
Oh, and this 3rd party insurance has the ability to prevent you from getting a temporary.
so impound doesn't charge lien fees till after three days. fucked by the man once again!

remember this isn't about his mods, it's about some registration thing. even if he had a stock ford focus , he could be dealing with a similar problem.
True, I actually went through a very similar situation with not having my updated insurance card about 4 years ago. I got pulled over for expired tags which isn't a huge deal in Ohio, and after I gave the officer my info he said my insurance card was expired. I had insurance at the time I just didn't have the new card with me. He said I would be sent a letter with what to do about submitting the insurance info. After receiving the letter and sending in my current insurance info along with proof I had insurance at the time of the ticket I thought it was cleared up.
Well, wouldn't you know, I get pulled over on the way home from picking up my grandmas truck for her because a headlight went out on the way home. Officer said I didn't have a valid license and I was forced to leave the truck 20 miles from my house (after already driving 4 hours). They even went as far as to drug dog the truck. I was PISSED! I have never had a single misdemeanor or anything, ever. Luckily my friend who took me to get the truck was able to give me ride. Come to find out, the DMV "never" received my insurance info so I was fucked. I knew I sent it and even had the copies of everything with dates of when it was sent and my insurance proofs were signed by the insurance company with dates as well. I had to resend all the info and check back frequently to make sure they got it. Well this time I guess someone wasn't jerking off at work and all was good on that end but....
I still had to go to court in that county and bring all the evidence with me proving the DMV was at fault. I had to plead guilty that I didn't have a valid license at the time of being pulled over, and the Judge threw out the case based on my evidence. I mean WTF, I had to pay all the court fees and find a ride an hour away during a work day just to get it thrown out.
I know I should have had all my current info with me at the time of being pulled over so I do take some blame, its just things like this seem unfair. At least they could have waived the court fees.
Sorry for the book, it's just this is a similar situation that happened to me and it sucks. They made it seem like I was gonna go to jail or get fined all kinds of money just because of a paperwork issue. Remember, if it isn't on paper, it never happened. Especially dealing with the state. Hang in there!

man, really bummed to hear about your situation, especially with your wedding in less than a month...sell the car and get some of that burden off your shoulders, there will always be more in the future...
FYI, if anyone has any holds or in progress registration needs, dmv's site is actually very helpful...you can get holds cleared online within a few hours now...all you have to do input your license plate number and send a scanned copy of your proof of insurance...cake...
if anything, everyone should learn from killerbees experience/mistakes cuz this could happen to anyone thats not proactive enough or left out of dmvs bureaucratic loop...
best of luck to ya bud...

lol....yeah...california's fucking stupid.
so i went to the impound lot today to request the hold be released on my vehicle so that I don't have to pay the lien fees if it sits for three days. cop tells me untill I can furnish "TAGS" he won't let my vehicle out. I told him dmv wont release tags till this 3rd party company releases the hold on my insurance card. I also had to pay them 14 dollars to remove this bullshit hold that caused it all.
So I told the cop, alright, I can't drive it out, i'll call a tow truck and tow it out. It wont' be driven, and will sit on private property.
cop said no. I don't trust you. and he won't waive any fees cause he's not the DMV. he didn't cause this problem. he said I can take it up with dmv. DMV can't do a fucking damn thing!!!!!! aaaaaaand. I checked my front yard...i have green fiberglass marks on the ground...and what looks like a 8 foot piece of metal was dragged (tow hook?)
so sue the city of whittier for damaging my vehicle? can I do that? and what kind of process should I expect...
and did I need 4 police officers and a meter maid in front of my house watching my car get fucked with till they could put it on a tow truck?

Holy hell man. I have also felt the long sand-paper'd lubeless cock of the law.. It is completely fucking ridiculous. The greedy bastard-filled system is completely flawed, and is so damn vaguely intertwined that the people who enforce the laws don't even know the proper procedures the majority of the time. Unfortunately, there is absolutely nothing that we can do about it, short of a rebellion.
On a side note... you should set up a paypal account, and put a link to donate in your signature, with a link to this thread. I'm sure a lot of people here would toss a few bucks your way to help you out. I'd really hate to se you lose such a beautiful car, just to see it come out of impound.

thanks for all the good info. My wife is starting to see me loose myself because of this car.....i watched her start cutting cotst, and asking family members for any giftcards that people don't use. We returned over 200 dollars in shit....so that always helps.
this car may not end up being sold after all. but then again...i haven't found out what the police are going to charge me till i show up with my tags in hand.
i'm not for beggin...i fucking hate bums...and that is how I would feel. Get a job. don't be lazy. if hispanics can sell oranges on the freeway, you can plant a fucking seed and do it too. help society..not become the burden.

i been in your situation once luckily i was able to get the tags and all that jazz. But best bet for this car would have been to have it stored in a storage facility cause after all the shit you go through and money dished out you could save a lot. but that's to late for that but i believe at tow facility's you have a certain amount of time before they are allowed to sell it i wanna say 90 days before they can throw it on the other side for the public to buy. However since it is in their lot they could do whatever they want and not have responsibility if the car has been vandalized and shit was missing etc etc.
Most of the time with cars like these if the tow yard has no idea what there selling they could sell it for cheaper than you put into it. But then there could be the guy looking for a car like this you may have to haggle to buy from. ehhh this whole situation is a mess. i wouldn't be able to sleep. Its like wondering when you were drunk and that girl you fucked if you remember if you strapped up but she was so hot you impregnate her ass anyway until you woke up sober. lol.

yeah, well I kinda live in a small city....where everyone really is extremely friendly and watches out for people. When my car was on the flat bed, my landlord then said...just put the car in my garage.
yeah.....little to late. I live in a house with no driveway and no garage. it's setup for the back house. Oh well. hopefully I can raise enough money to get this car out and not have to sell it to fund my wedding. lol. although my wife is also doing everything she can to save even more on an already budgeted wedding. Sucks. Lesson learned though...don't trust what anyone says. Double check, and even triple check things.
Cause I've been to the dmv a few times, and it was the last time that I was told what my actual problem was. Bunch of fucking bullshit...but what do I say...california is in the business of making money.... only state that has a BAR....and one of the only states that care about smog...so i can only imagine what the state is looking for next...fuck.

well..if i can't get it out...i'll auction it off to the highest bidder...better than a thief cop getting it. lol
just watch out there is this ass named edmin from Pick your part he has a thing for orange wheels, dick kept bidding up my car cause he wanted my wheels.
another thing, the Beverly hills Police department specifically told my parents i had 90 days to take my car out of the impound, and they auctioned it off last monday. oh and apparently the tow yard contacted the previous owner of MY CAR, to notify them of the lein sale, but they sent the piece of mail certified, when i was in the hospital, it was never delivered to me, I would have had no prior notice of the premature sale of my vehicle.
go to the tow yard pay the bill, keep the receipts, take the county to small clams court, about your bumper the tow company has an insurance policy, use it... and this ass named wayne might chime in after my post, as he has no life and does so after everytime i post up info. so be aware, only i can tell you from my experience what happened.

Finally waited for the insurance thing to clear. Picked up my tags at the dmv. Went to the police impound to pay "their" impound fee. Now i'm about to go to hadley tow to pick up my vehicle.

thanks guys for the continuing support. I hope this shit never happens to anyone! I was also sent a pm from another guy stating that there was a newpaper add talking about how police are impounding cars, and buying them back. I have been finding out that even some cities are being sued for the amount of vehicles that are being impounded lately.
baldwin park made 1.2 million dollars in impound fees last year?????wtf!!!!!!! half of which came from one towing company, the other half was court fees?!? and why are they applying for grants to set up these checkpoints if it's making the city 1.2 million?
