The car is a 2000 BMW 323 Ci Forest Green with med tint all around n small dent right under left taillight.

Meaning looks like he set up a payment plan with someone and they didn't follow through.

My advice to you buddy, is if there is no signed documents, you're shit out of luck and it would not be considered stolen. If there is signed agreements and such, then you could use that and take it to the police and get your car back, kind of like a "re-po" type deal I would assume.

There is a signed agreement between us but it cant b a small claim cus its a value of over $7500 :/ n if i do sue hom he needs to sign the paper work. n hes sumwer in the (562) or (626) area code has a son named josh i believe

Why don't you try contacting police in that jurisdiction? What if you report it stolen, just so they can find him -- and then you can serve him the papers then?
