ok so i got cut off on the freeway about a month ago by a van and rear ended them in my s13, i didn't have insurance because i was in-between jobs and i was on my way to my SECOND day of work... but anyway i asked for the receipt of the repairs and there trying to charge me for the damage that i caused in the rear AND the damage of them hitting the person in front of them
so theres rear damage on the bill and front damage like front headlights, fogs lights n stuff
so my question is can they do this? do i actually have to pay for the front of the vehicle to because me and people i know think i should only have to pay for the rear, and i dont have money for a lawyer =( please help
anybody experience this and have any advice or have the number of someone who does? any help would be highly appreciated

If the insurance decides that it was your fault that caused the car in front of you to hit the other car in front of them...then YES, it is your fault and you will have to pay for the damages on the other car.
Your best bet is to be able to prove that you were cut-off....

I know you're not in Texas but here as in most states if you hit someone from the rear and cause another wreck you're at fault for everything. Being cut off is a hard one to prove cause it's your word against theirs and the only way to win this is in civil court which will end up costing you much more money then the repair bill.
Quick run-down, you file a suit (there's fees included with that for time and paper work) they make an answer, you go to trial (court fees and lawyer fees) if you win you're out thousands of dollars but don't have to pay their damage. OR you take them to court and lose then you have fees dmaages, and it opens them for a counter suit for other damages incurred (medical, emotional, and other bs).
It would be best for you to just pay it off, and bite the bullet. If you don't mind me asking have you requested them to get quotes from other places? And how much is the quoted damage at right now?

Man, sucks to be you. The person they hit could also file a lawsuit against you to get you to pay for their car too. Every state is different. I know in CA if you hit somebody and that car hits another car, you could be liable for both or only for the car you hit. Depends on the situation.
Your best bet is get a lawyer. But either way you look at it, youre fucked just for not having insurance...

My dad was in one of these a while back.
He was stopped at a light when a car rear ended his truck, which caused his truck to hit the car sitting in front of him.
The police that came to the seen determined he was not at fault for the car that he hit's damage because he had left a proper amount of space between the cars.
In your case, your only angle would be to say that the car you rear ended was following too closely to the car in front of it. If you win on that angle then you'd only be paying for the vehicle you hit.

freeway accident? did the police come? should be a police report. was there one? if so, get it and read it. if the report is not in your favor, you are shit out luck.

you were driving with no insurance? in america? this isnt 1910, this is 2010. doesnt every state just about require the minimum of liability, to protect you from situations like this? then again, we have uninsured motorist coverage to protect US from people like YOU
seriously, imagine it like this.. if your car was NOT on the road, you would not have rear ended the other car and the other car would not have been pushed onto the other other car.
well, look at the bright side. your second day of work will quickly become you're third, fourth, and fifth week so that you can pay those repair bills..
assuming you dont fuck that up.
word of advice, leave more space when you drive. this is how responsible drivers avoid accidents in the first place.

they already did the repairs, they did it apparently 4 days after the accident happened, and right now the total that they want me to pay for the van is 3800 which isnt really bad but when im looking at the receipt of the damages and the how much the repair was, i only caused them to get a resprayed rear bumper and thats it for the damage in the rear but hey im fine with paying it all because i know i fucked up and im ok with biting the bullet for now because i know i was in the wrong

in washington you are liable for the car infront of you nomater what happens, if you hit the person in front of you you automaticly get a ticket for fallowing too close no matter what.. so if what your saying is true i could just say " obviously its not my fault they hit the car in front of them because they got a ticket for fallowing too close?"

i understand that i should of had insurance and i WAS planning on gettin some on my first pay check because ive had insurance on ALL my previous cars.. i am a resposible driver and i do leave a lot of space between me and all the cars around me but when your in stop and go traffic and you look away for a second shit happens.. but i guess theres only one thing i can do but drive more carefull and pay more attention like i should have been doing that day

I was in something like this a while back. same law in Las Vegas about car if front and if you smash into them its your fault unless you can some how prove that they brake checkd you. I had insurance tho so I just paid deductable($500)

let me ask you something how bad was the damage on the van that repairs cost $3800??? They might be taking you to the cleaners check the actual repair bill not the estimate. They can be sayin they paid that but only the real original receipt will tell if not it might be a quote/estimate and they paid only $900...

who is reading this...if u buy a new car...CALM DOWN after the your "sweet car" purchase and wait til you can pay insurance. Patience is a virtue. I mean really...a paycheck comes what?...once every 2 weeks?

You don't need a police report for a small accident.
Most of the time, cops don't even respond to accidents where nobody was hurt.
And depending on what he hit, damage can easily go in the thousands for quality work and oem replacement parts.

When you rear end someone, 99% will be your fault unless there already was an accident in front of you which you couldnt avoid. Now you have to pay for every party whom involve in this accident. You're lucky that you didnt go to jail or 1000 fine for not having ins.
Lesson learn, always drive with ins or dont drive.

problem is, youre 19.. that doesnt help your situation. theres no reason for it, you should've left more room.
pay them and get past this. consider it an expensive lesson, the end.
think for a sec how much more fucked you could be if you actually injured someone, you'de be liable for the vehicular damage and medical-related expenses..

Wow...you weren't looking in front of you for 4 seconds!? You can run over a bunch of people in that amount of time. You really shouldn't be taking your eyes off the road for more than a second even.:cops:

i always make sure i leave plenty of room ahead of me in case some dick decided to rear end me. shit, i almost got rear ended stopping as i saw the light turn from yellow to red on my way to work at 7am. looked like the fat ass in the van behind me shit his pants as he swerved and slammed on his brakes.
anyway, yeah, ur like, proper fucked.

wellllll i was on the freeway so i thought i was solid but also it wasnt like 4 seconds it was enough time to glance to the other side of the freeway to see a mexican woman standing on the side of the road yelling at some other guy in her car waiving around like shes crazy...........lets just say it was totally not worth the 2 seconds of my life i spent looking

well i hope your glad to hear ive been a frequent customer on the 161 metro bus to get to work ever since......if i would of done that for the first 2 weeks i wouldnt have to do it for 2 months

I know it was stop and go traffic. But consider this, if you're going 60 mph and you close your eyes for a second, you've traveled around 80 feet without looking.

damn that sucks,but atleast u didnt get a fine/jail time.i bought my zenki in march and now im just driving it ,because i just insurance for it/going back to work.i been in 3 accidents i cant afford another one .this last one cost me thousands of dollars.but yeah its better to be insured than to have to pay an ass of money for accident if it wasnt your fault.

if you rear end anyone, its usually your @ fault and if its a chain re-action, you are also liable for the damages on front of the car and the car ahead of it.
My sister was in an accident similar to this, but she was the on that got hit and her car hit the car in front of her.
