So while I was at school today I realized I didn't have my Human Sexuality homework. Luckily enough I have a 4 hour break inbetween classes and elected to just drive back home and get it. On my way back to school on Twin Oaks Valley Rd. I was stopping for a yellow light, I reached my complete stop and about a second later the light turns red. About 1 or 2 seconds after that I look into my rear view mirror and see a Red Nissan Versa with it's brakes locked up coming into me.

I didn't really have any time to react, except brace for impact. Sure enough she gave me a thorough pounding from behind. She pushed me a good 10 ft into the intersection and my car was stuck because the rear bumper was entagled under the wheel. So I immediately got out and ripped my bumper off all the while yelling obscenities and the like.

Finally, we pulled off to the side to assess the damage. Her car was fucked. Most of the drivers side crumple zones... crumpled at least slightly. Couldn't really tell how bad her cars damage was till she popped the hood, and her car wouldn't start etc... My Subaru has a dented exhaust and dented/nicked rear bumper. Everything else appears Jim Dandy. So I guess the point of this thread is that I had to deal with a crying teenage girl for about 45 minutes and she fucked my brand new car today and need some outlet. Also, that Nissan Versa's suck ass and Impreza's are stallions.

Yeah man, that definitely sucks hard. There's a good possibility that it will start to suck even more once you have to deal with her insurance company.

My car got rear-ended last Monday so I definitely understand your frustration. The insurance company wrote me an estimate that was nearly 2k less than what the dealership gave me. Luckily the dealership was able to get it fixed correctly, but the whole process is just a pain.

I wish you luck in the coming days.

Yeah, I think what saved our collective asses at least in part is that when I instinctively braced for impact, I let off the brakes. I feel if she would have hit me and my brakes were on it would have been a much different story.

Yeah, she told the cop while he was taking down the report that she just wasn't paying attention. Then the cop walked over to me to take my statement and was like "well. it's not your fault" and then laughed haha.

I honestly won't care that any of this happened if I can get a few extra bucks out of it and replace the stock exhaust with a catback which would probably be cheaper and get some Rally Armor mudflaps so I can stop scratching my paint.

How's the paint durability in those newer Imprezas?
My 06 held up pretty well.
Hope it isn't as bad as the Mitsus (learned the hard way apparently).

Paint is holding up quite well, save for a couple minor scratches from pebbles flung into the body by the front wheel.

Even the paint on my bumper wasn't so bad, after being hit and then dragged under the car.

I did the same thing in my Camino....

Cept the guy was in a moving truck and stopped 10 ft into the intersection, I couldn't see over top of his truck, and 24 year old brakes don't like to work as well as say...abs ><

Luckily he was nice and it was a work truck so no moneys exchanged.

Pretty sure the legal system doesn't work like that. Anywho, I'm way too lazy to sue anybody anyways. I made it out ok, my car (for the part) made it out ok, it was her fault, and she has insurance. An accident couldn't go any better.

I do want some mudflaps though lol.

she had 'back pains',
and is apparently trying to sue past the $100k health coverage from my insurance.
property damage is usually not that big a deal.
medical compensation more or less has no limits.

Well... Then I guess I'm just not that much of an asshole. While a free 100k does sound great, I'd rather go "Widow Shopping" then sue someone for it.

Think I can get an out of court settlement for my Rally Armor? I think I deserve that much for my troubles. :keke:

So lets say the person who hit you has insurance and all your medical bills and all your property damage is covered.

Why would you sue them? Because they "deserve" it? Or is it because you "deserve" their money more than they do? What legal reason would you use to sue them for?

Let's apply this to a different situation.

Say you're at a fast food joint and some person spills their soda all over your "Mercedes Benz Gucci Guido Tracksuit Uniform of Shame" because they weren't looking and tripped into you.

Would you sue them for additional cash and clothing even though they cut you a check for a brand new douche bag uniform?

I believe that after her insurance adjuster comes out to appraise the damage on your car, they'll cut you some sort of check. From what I've read, this value is generally more than you would need to get it repaired at an economical body shop of your choice. Use the remaining amount to get your mudflaps.

Another option which would enable you to get your car repaired but forgo the purchase of mudflaps would be if you let her insurance handle everything for you entirely.

You'd most likely drop the car off at an approved body shop from some sort of list they'd give you where you car would be fixed and her insurance would pay the body shop directly.

I haven't dealt with an insurance claim like this in awhile but I think Falkon240 or some of the other guys can fill in the blanks.

Oh and I'm totally down for an angry mob section. Or maybe we should have a weekend where the Zilvian community is given the opportunity to police itself. :D

get repair estimates at collision centers.. dont bring the rear bumper jus say its gone than tell the insurance company you want them to cut you the check. you repair the damage yourself, get your bumper repainted somewhere. and than have leftover money for the parts you want.
