Car Impounded need help with court etc

tonight my car was just impounded.:bash:
i got a ticket saying that i was
"speed contest" which i was going at like 55 which he put down 60 at the 40 mph street. and not having a front license plate. any ideas i can argue that i was not racing. and helpful hints i can tell the judge or what i can do to take my car out of the impound?


p.s. he also said come back in 30 days to pick up my car.
cant i pick it up asap? i miss my s13. or is he just lying and want my impound fee's to grow?

The best advise that I can give you is to go and see the judge. I have never gotten a speed contest ticket or known anybody that has, but I have gotten a pretty bad ticket before. In most cases it seems that if you go to traffic court to actually see the judge he is usually nice and will lessen the fine or even the reduce charge of the offense. Back in my young and stupid days I would go to traffic court and see a lot of people have their fine reduced, but only if they were respectful. As soon as somebody gave the judge any attitude they got pretty much ignored and charged the full amount of the fine.

The judge might even give you the opportunity to go to traffic school if you are lucky. Just remember that if you decide to fight this ticket and you lose you are giving up any reduced costs or chance to go to traffic school. But hey if you think you can win or the cop doesn't show up, go for it.

I've only been pulled over for not clearing an intersection before the light turned red (was written up as failed to stop at a red light) and for failure to pull over for a patrol car (cop car was speeding without siren on and with roof light on but not flashing. cop almost rear ended me on a street that dipped under a railroad track which blocked my view of any traffic behind me) so I have no experience with this, but I'd suggest you find out if its possible to go take pictures of your car while its being held at the inpound lot. Make sure the date is present on each picture you take. Indoor, outdoor pictures and good clear pictures of your engine and exhaust to prove it's all stock. That should prove any loud exhaust or engine noises that might have caught the cops attention were not coming from your car. Accept your mistake with the judge, but clarify that you were speeding and not racing like the ticket suggests. Let the judge understand that you're there to man up to your mistake and are ready and willing to comply with any "punishment" he/she feels fits your mistake provided that they "punish" you for the correct penalty you made. Like some of the guys said, be curtious and polite with the judge. Don't make the judge feel like you're there to expose flaws within the system.

I've also heard that here in So. Cal. your chances of a cop not showing up to court are better then 50/50, but i'd imagine the more severe the sitation is the more likely the cop shows up.

The sad part is that, doesnt matter if you win or lose, that 30-day mandatory impound will fuck you over. Not like the county will pay you back what you owe to get your car out of the lot. Just that alone, will be over $1k to $1.5k depending on the towing company. Then the fine, depending on the county youre in, you're looking at another $1k, on top of that, expect you car insurance to double. Also, you could lose your license. All this happened to me in Norcal, Solano County. Again every county is different, but being your in LA, I doubt itll be much different to what i went thru...

Law states that you are innocent until proven guilty. If you are not guilty, and they cant prove it. You wont be charge with speed contest. Especially when you say, I know I was going a bit fast, but I was NOT street racing or anything. Whatever you dont, do not talk shit about the cop. Just give your UNBIAS statement. but it will be kind of hard to fight it...since the cop 80% of times do show up...and cops word is always right over a civilians in judge eyes

ok...now regarding your car...go to the police department or chp which ever enforcement gave you the ticket..and check out to see if your car can be taken out of the impound. you will know there if its 30 day madatory or not

get a fucking lawyer, the idiots on zilvia cant help you here. you need a lawyer to fight against the speed contest and drop it down due to a technicality make it a speeding ticket or get it thrown out all together.

did he pull over the other vehicle? if so, then there would be more evidence of you two having a speed contest. he needs to have proof of what you were racing and the overall situation, not just that he saw it out of his ass.

well cops get paid more than what they will most likely get paid to testify during that day and some wouldnt wanna go waste ALOT of time just for 1 ticket...i got busted buy the gang unit here in LA couple years ago and they gave 6 of us the same ticket "suspicious cans, destruction of public sidewalk and destruction of pedestrians right of way" cuz they saw a trail of beer coming out of the bushes, and i was hanging out with the wrong ppl....well anyways i went to court pled not guilty, which i had to wait for 4 hours just in line, then wait another 2 or 3 months i think to go back, and waited another 4 hours just knowing the cop wouldnt show up. its a long waiting game so mostlikely the cop wont show up, IF ur lucky lol

I got a engaged in a speed contest about 6 years ago. i was racing a Mustang in my Civic. my car was not towed, my hood wasnt popped, i got an engaged in speed contest ticket and a 95 in a 40 ticket.

when i went to see the judge, he dismissed the 95 in a 40 because he said it was redundant. i got an $1106 fine, 6 months informal probation(if i was caught at street races i got 6 months in jail), 2 points on my record and my insurance doubled. so thats kinda what your lookin at.

btw i was lucky, the judge i had was into cars. he even told me he had a WRX. so that may have helped me out.

I'm feeling all warm inside reading this. You're young, you have a car that screams immaturity, and you broke the law. Sad to say but that's what happens. Sure the cops are assholes, we all know that, but if you're going to provoke them you're going to get pulled over. If the speed limit is 40, you drive 38. Period. All the time, every time. 1) LAWYER LAWYER LAWYER!!!! They are just as dirty as the cops but at least you can have a marginally better chance of getting it knocked down to speeding they know the loop holes. In addition the lawyer may have the ability to get the car out of impound early because of personal or financial hardship. You WILL end up paying the same amount or more in regards to cash but once a speed contest is on your record its a big red flag to your insurance company to rape you in the rectal area with high grit sand paper AND to every judge you stand up in front of in the future!!

2) GO NOW to the tow yard and take pictures of your car including the mileage and tire condition (They WILL F' UP YOUR CAR), hide the camera in your pocket, and tell them you need to get something out of the car for school or work or... they will usually let you get it and some times unsupervised just act relaxed about the whole thing. Its just a normal contracted tow yard it is NOT run by the cops, so don't get nervous, its some guy that sits on his a$$ all day (usually dirty, fat, and toothless in my experience).

3) Swallow your pride and be a man; if you were racing ADMIT IT. Not to the judge, or even to us Zilvians (because everyone will flame you on being dumb.. BLAH BLAH BLAH..) It doesn't matter what we say, but the lawyer needs to know the truth of what they are up against, if the ticket is going to stick they will approach it completely different, looking only for loop holes like, prolonging the ticket going to court to high vacation season for the cops, which gives you a better chance he won't show up.

P.S. If you decide not to get a lawyer, do the work the lawyer would have...

1) Dress like you're going to church, and if you dress retarded when you go to church or don't go at all, dress like that nice kid that has straight A's and goes to church. SHOW RESPECT! Sit up straight, speak with proper english, practice what you want to say (saying 'umm' is annoying to the judge (the person deciding your fate)).

2) DO NOT ADMIT ANY INFRACTION IN COURT (you will immediately be guilty in the eyes of the judge) You MUST have exact numbers (write things down, request the citation file and officers' notes, have pictures of your car or location (if needed PRINT THEM 8x10" the judge will NOT look at your camera phone)) If the judge asks how fast you were going have an exact number and distance traveled at that speed and that you had just looked at your speedometer prior to being pulled over. YOU are a novice playing in the judicial system, any mistake spells guilty.

2) How did the cop get your speed, pace/radar? IMO It sounds like he didn't get your vehicle speed and needed a citation that would not make speed the primary infraction (obviously don't say that in court) but find out the distance traveled by the officer while pacing you or where he was located when he approximated your speed (and see if there was anything obstructing his view by going to that location) or when was the radar gun last calibrated and ask for the evidence (paperwork) of that calibration? If he doesn't have it, you've got a better chance
.
3)You can also 'try' saying that while AT A STOP you were talking out your window to your buddy about going to dinner (reason you were driving next to each other and why you were together in the first place) and that you understand that it would look like a speed contest because of the kind of cars you were driving (which alludes to 'Profiling' on the cops end but doesn't say it so bluntly to make the judge mad) but you were in no way trying to race.

The speed contest law is so vauge the officer can write it for almost anything. You do not need to be going over the legal limit, it just needs to appear that you were engauged in a speed contest and that is up to the disgression of the officer....bottom line you are screwed. Like others have said get an attorney. 30 day impounds cost a bunch.

Next time you are pulled over and it seems you will be getting a ticket, ASK TO SEE THE GUN!!!
It is mandatory that they show you and if they come to court they need to bring the proof that the gun was also in functioning order.
If you were really going 55, and asked to see the gun, he would have written you up for that speed, not 60.
(i have seen cops get away with that paceing bullshit in court, but rarely).

Lawyer for sure, set up a payment plan, its gonna hurt, sorry.

I also now make complaints against officers involved in any incident and BS ticket now.

Read my first post...I paid $1k in fine, plus the yard fees ($380 since I didnt get tagged the 30-days), see if you can go to traffic school so the points wont show up on your record. If you cant and it does show up, either your insurance will drop you or charge you double what your paying now. My insurance went from $170 to $320 a month...my insurance company loved me :kiss:

speed contest means you were trying to show off to someone,burn tires, speeding, or racing in a contest of speed.. Your court date is on your ticket. They will not let you see the judge earlier, theyll make you go on the court date on ur ticket. Your car is in the impound lot for 30ays, you can get it on the 30th day. You have to go to the sheriffs station first pay $93 county release fee, and the head watch commander will sign a paper of release that you will show to the towyard. It will be around $1200... if you cant pay it, they will sell your car in public auctioning!!! start saving your $$... Then when you get your car back, save $$ for the court date ticket cost.If you plea guilty, Its gunna be around $600, plus its 2points to your driving record, but you can do community service which is about 48hours instead of paying $600.. If you plea not guilty, the judge will set anotehr apointment for your hearing trail case. The judge will have the police report. The police report has all the details of everything that happened the day you got impounded,including notes"quotes" of what you said. So stick to agood story,be wise. I would say such like "I was not racing, or participating in any contest of speed" " Judge: "So how fast were you going?" " I was going 55mph, the limit is 45mph" Judge: "Then why did the officer pull you over and cite for speed contest?" " Because the car next to me was very loud and seemed heavily modified, and it made the officer think we were racing. Iwas simply just speeding 10mph over, not trying to race." Something like that, dont ever mention that you were racing, or you knew that guy... act inncoent, and never admit the truth, if the judge will look at your story and the police report story.. he will decide from there, and setup a trail date with you and the officer. Just be smart.. if teh cop doesnt show up u win automaticly... p.s. youll never get your $$ back for the impound fee and county fees.. Wow bro i feel you... I got a speed contest citation back in 98 at some street races. I wasnt even racing i was just spectating. That night they did a roll block and got about 100 cars and kept us there for like 3 hours. I had no insurance at the time and did not get my car impound. So i got cited for the speed contest only. So then after i decided to fight the ticket. My girl was with me that night so i was like cool i might be able to use her as a witness. Anyway so i showed up to court thinking the cop was not gona show up that cited me.... The day of the court before they closed the doors and began he walks in at the last minute and i was like dam! So i had already talked w/ my girl and made up some bullshit story and we went along with it at court. They questioned me and then my girl. After they questioned the cop and he said that they had been doing an investigation on street racing in that area for a few months and that i was guilty. Well the cop didnt have any evidence that I was involved in the street racing or that i was infact a spectator... I had said that i was in the wrong place at the wrong time and that i didnt even know what street racing was. The cop kept trying to prove me guilty but failed. Judge dismissed the case and i was off the hook. Didnt have to pay anything and didnt get any points on my record. Judge just said next time dont be out late at night and that if i would ever get another citation of speed contest that i would pay the consiquenses.

Cop showing up to court is a big possibility bro. If you pleed not guilty and want to fight the ticket you will have to pay the full bail amount up front. If you win the case they will refund you the money but it takes a long time for you to get it back. In my opinion if you have a clean driving record go for it fight it. Chances of cop showing up is 50/50 chance. Most judges arent dicks and will knock it down from misdeamor to an infraction. If the cop does not have legitamet evidence he wont be able to acuse you of speed contest. Having my girl as a witness probably help and also me having a clean driving record at the time helped also. You definately have to have a good attitude dont act like a dick cause they hate that. Speed contest is not only street racing it can also be something else even just burning tire can be speed contest. Regarding the 30 days impound theres nothing you can do about that.

and traffic school can easily take it off my record.

Dude I'm glad you're getting this sorted out. I'm sure you feel violated knowing the towing company and police went through your vehicle.
There is probably an unlawful search that took place so if you can get the 'tow guy' to testify that might help you.

I already covered this. Read my post on page 3. The search was pretty much guaranteed, and if you're questioning the "evidence" angle, the presence of a performance modified car/engine, illegal swap, or nitrous oxide is pretty damning evidence in a racing case. Therefore, it is in the state's interests to check for such mods.

I'll go ahead and give my credentials as to why I have such information at my disposal, I managed a towing company that the Virginia state police use for most of northern virginia, and in that time I had a LOT of cases such as this pop up. I had numerous occasions to talk to investigators, State police officers, and owners, as I was obligated to escort them on these searches, and inform the owners what the scenario was and what little rights they had when it came to police impound.

i went in for a small claims paper to get the impound fee, but that's guna wait til i see my lawyer again. i went they dismissed it even the judge didn't say any thing, she was on my side saying i was probably just off the line pretty fast and cop thought i was racing but i wasnt etc. she gave me 3 choices, 1. Fight it and come back another day, 2. Plead guilty and pay the fine (she said it was a hefty fne and a bad charge and didnt recommend it) 3. was to talk to the DA about the case. talked to him and said i'll dismiss if it you take a DNA Collections for me. i did, took finger prints and cotton swab of my cheek, and that was it. and cop didnt show and lawyer was not needed,

i went in to get my stuff, took out my center console out, so the car doesnt have a shift knob etc and other things they cant take so anything else in there is useless.

theres cops there that wont give me a hearing so i can request for it to be removed earlier. so its going to be there for 30 days unless i go to court and get it reduced to reckless or speeding.

so in the end thats 1600 for impound fees and idk how much will the fine

if the car is registered under your name, you have to wait the 30 day to get it out of the impound. if it belongs to someone else, they can pick it up by the registered owner. this happened to me once, i had to pay close to $1500 (price depends on which city impounded your car), and my buddy got his parents to get his car out the 1st week. I paid for a lawyer and all i got out of it was not having my license suspended.

w/ public defender you will most likely receive:
1. Suspension of license for 3 months.
2. informal probation for 2 years
3. ~ $1300 fine and community service
4. misdemenor on your record + 2 points on dmv record

DAMN man I don't mean to offend you but, it's hard to believe that you did nothing. Let's be real no one here is going to testify against you in court saying he admitted to his offense on Zilvia. You had to of done something to catch the cops attention other than being a 240 that was next to a couple of other cars that were racing. The only reason I say this is because I have been in a VERY similiar situation, but I saw the cop made sure I didn't rev and made sure the second row of cars in the lane next to me passed me. Im not trying to bag on you and I could be wrong, but it's your second offense within a year or so's time and a judge will see that. the first case was dismissed cause i won that case. so only the judge themselves will know what i did, && i didnt admit to anything son.

i guarantee you, your fine will be less than 600 with no community service, license would not be suspended, and would not go on informal probabtion at all! i work for riverside county and i am 99.9% sure that would not happen. just plea not guilty to the racing part because like you said you wasnt racing right? lol

one of my friends was pretty lucky, driving on suspended license and was going 110mph on a 65. got his car impounded(not so lucky there) lol cost him 1800 hundred to get it out went to court pleaded not guilty, went back for the second time with a public defender and they dropped the speeding and instead of getting him for driving on suspended license, they dropped it down to driving without a license. he ended up paying about $400 with no probation and no extension to his suspended license! but like i said it all depends on what county you live in. this happened in san bernardino county, he also got into trouble with riverside county, but their conviction rate is at 99%(highest of all California). i believe you can look up your county or court conviction rate

will do, talked to some other guy that had a speed contest ticket in newport and he never got his car impounded nor license impounded, he plead guilty to a plea bargain. dont know much details but thats all i know.

Woah that's pretty close to my house! I got pulled over for having a "unusual exhaust note". This was on Bolsa and Magnolia. So that gives you an idea of how silly of a reason it might be for them to cite you.

Anyway, I had a friend get pulled over for the same thing. Listen to the guys screaming "get a lawyer!". The court appointed lawyer will most likely get you into more trouble. If you weren't racing (not saying you're lying, doesn't matter) then fight it and make it a priority. Racing tickets are HUGE fines and they'll destroy your driving record. Speeding tickets are like 200 dollars? I just got one :) Fees will be extremely pricey after all is paid for, but it'll be worth it. Take this as a learning experience and move on.
