View Full Version : I fucked up :(
boss called me up today to start my first day of work, tomorrow at 10am. I decided about 30min ago to go get some gas. I hop in the car and head to the gas station, so I don't have to get gas in the morning.
wrong fucking choice! :nono:
Friday night.. bored
going on a long street no sidestreets, for some reason I decide to downshift to 4th and accelerate.. like I don't know how slow my KA is.
again wrong fucking choice!
as I start slowing down, slighty applying the brakes..
I see two motorcycle cops just chilling waiting for some douchebag like myself
pass him.. definitely going over the speed limit (45mph ).
I know I'm getting pulled over, make a right at the first light and stop.. he flashes his lights
I pull over, turn off the car, turn off the radio, rest my wrists on the steering wheel. Cop asks how fast I think I was going, I know he radar/laser'd me I said I was speeding but "if I had to guess 50 at least".
asks for my license and registration, I give them to him
wait about 15-20min.. asks me to come out of the car, he confirms my address and phone number, and my employer.
I was going 78MPH :wtc:
I'm left with a "Criminal Traffic"
I have to appear in court, on the same day I have class... the cop said the range would be within $250-350 ( fuck my life ).
my first speeding ticket..
moral of story: don't speed
so my question... HOW fucked am I? I just got a job as a lot attendant, where I was asked if I had a clean record.. they will probably see this information and hopefully it won't jeopardize my job :-/.

clean record as in any misdemeanors, and criminal charges such as drug trafficking you know shit real criminals do.
I had some shit like that on my record, exhibition of speed, first time I ever was duped into a stoplight street race. showed up as a misdemeanor for 7 years on my background check.
your bullshit speeding ticket will get reduced, ask for an extension and see if you can get a free legal adviser to reduce it for you.

I don't think it works that quick. You have like 30days to call and set up a court date, and then its like another 30 days after that. And the court actually has to make a decision before it shows up in your record. I would get a traffic lawyer to get it dismissed.

I'm not sure, I know since it was 20+ It's now a "Criminal Traffic".

I already have a court date, it was assigned when I received the ticket.

I know this sounds stupid to you.. but it's the most trouble I've ever been in, prior to this I've never been pulled over in my life.

I believe ^this is for a civil traffic ticket.... he got a criminal traffic ticket. It's really up to the judge what the punishment could be.
More than likely you will get a misdemeanor with fines and a driving class... probably get some points on your license too because you were going so fast
Get a public defender and talk to them about it... let them know you work at dealership and cannot loose your license. They will more than likely work around it for you.

OMG same exact thing happened to me last week. I was going a bit too fast in what appeared to be a 45 but ended up actually being a 35. I see 2 motorcycle cops waiting for someone just like me. I immediately pull over and on the ticket he gave me he put down that I was going 57. BS but oh well. I'm a minor so i have to show up in court. blehhhttp://zilvia.net/f/../images/smilies/bang_head.gif

I know in WA you can deffer a ticket and pay small fine (about 75$), It doesnt go on your record, But if you get a speeding ticket within a year then both end up going on your record. But its also best to save it for what you think will be the worst ticket and use it for that. I would say try talking to a lawyer about it, probably your best bet.
For the most part driving jobs are the 3 strike rule, 3 speeding tickets/wrecks and your done, Its because then its a higher insurance for the company to employee you. You say lot attendant? If you are not leaving the parking lot I know its even less strict than 3 strike, I worked with a Technician that had horrible driving record and wasnt allowed to leave the lot with customer car because he wasnt covered by insurance.

^this is not true.... it depends on the circumstance....
I got busted driving with pot twice in the same week a few years ago and was confronted with this decision... I went to a lawyer and he tried to pressure the shit outta me asking me if not getting a felony was worth 8 grand in lawyer fees.
Went with a public defender and everything was all good. Got a misdemeanor and 1700 in fines.

Been there due to state ref issues...
It's funny when people are explaining their real serious driving crimes then it comes to your turn to say what happened and you say, "I was going the speed limit in a modified car and was pulled over."

If the judge recommends suspending your license, ask if you can atleast have it restricted to go back and forth to work. You might not be bad off since it's your first. Yea whatever you do show up for sure. Also whatever excuse if any used when pulled over..stick to it in court or admit to speeding, cause I think the cops keep record of that too. Atleast when I got pulled last time, he remembered lol
Also does your job require driving, otherwise i don't see why your ticket would ruin your chances. I can see if you got jail time..but I mean come on it's your first ticket. You did pretty get imo if you made it to 19 b4 getting one lol. I think I was 20 when I got my first ticket. Also if things look pretty bad I would bring up the fact you just got a job, your really trying to keep or if you get someone to represent you ask if they will mention it.
Good luck

if its your first ticket itll get bumped down. my first speeding ticket was 75 in a 45 and it was something like a $450 ticket. but since it was my first the judge let me off with a 10 over that was something like $250. just go to court and tell them you dont believe you were going that fast.

Best bet for you is to request a continuance a couple of times, its pretty easy actually, just go to the courthouse as soon as you can and request it. Keep doing that until your pretty solid in your job, and also will give you more time to figure out what your going to do. Also the court date just means the date you have to go in to the courthouse by, its not actually a date you appear before the judge iirc. I got a criminal speeding ticket (was rolling with some freinds and they decided to race, I was only going like 55 in a 40, they were going like 120, when the cop turned on his lights, everyone took off but me, I just pulled over and he wrote me a ticket for 55+ criminal I think.) I went in and they let me take the class. Go in at least a week before the date on your ticket, see if they will let you take the class and if not, request a continuance. Just type up some reason, work is always a good one.

In va they remove like 8 points, In az, they drop the offense if you can do traffic school. All you have to pay is the cost of the school, ticket gets dropped. BTW, getting a traffic violation in va is so much worse than in az.

nah man in Va they drop 5 only if you go voluntarily or if they dmv sends you, and you can only go twice every 2 years to get points back and only if you are over 18, but most of the time if you get a cool judge they will drop the ticket if you take traffic school if the ticket isn't outrageous

but my first ticket was a 84 in a 55 and my second was a 91 in a 55 and they took my license for a year and a half after that one lol but i deserved it in all honesty. They dropped my first ticket because of my lawyer so I still believe that a lawyer is worth it. I don't know about where you live but where i live a decent lawyer is around 300 to 400 dollars for a traffic ticket but the ticket you got is probably going to be around that area, maybe a little less but if your job requires a clean record then i believe if you like your job and you want to keep it then i would spend the money for a lawyer, even if you do have to spend a little bit of money in order to keep your record clean.

if you already turned in your driving record, than your fine you have nothing to worry about unless they ask you for another one. so you should be fine.
First off, why are you going to go out of the way to get gas, just to waste it there and back to your house, instead of leaving early on the day of work and getting gas than , while you are on your way?
oh well, the biggest problem was it was two motorcycle cops, as if one did not mean your getting a ticket, two def seals the deal. If they have to get off there bike they are giving you a ticket for sure.
It is like when you're a kid and your dad yells at you from the other room, " Don't make me come in there!!!!!!"
You knew if he went in there your getting beat.

I've gotten a ticket like that for going 4 mph over the speed limit.
As for OP, since you were speeding excessively over the speed limit, that's why you were charged with a misdemeanors. So saying that you haven't gotten a speeding ticket might not help a whole lot. But you might be able to go to traffic school level 2 like said earlier, but that will only take 1 point off.

dawg u can probably fight this ticket and win.
i got a ticket for doing 71 in a 55 in CA on labor day, fought it and won.
there are a bunch of loopholes in the law that will allow you to fight this and win.
heres some stuff in CA that applies that i dont know how it applies in AZ but you should look into it.
1. Speed Limit - were the traffic conditions such that you were endagering anyone? because a speed limit is basically a safe speed for the conditions.
2. Traffic Survey - i know in CA if the DOT has not done a traffic survey on a given street within the last so many years, then all the tickets there using speed measuring are legally speed traps and must be thrown out in court if they do not provide the proper proof of the survey. Additionally if the survey shows the posted speed limit to be too low, tickets can also be thrown out or at least reduced.
3. Radar - if the cop used radar find out if the calibration is up to date, and that the cop was using it correctly. a radar that has not been properly calibrated or used is evidence that can be thrown out in court. i.e. what distance did he clock you at? the further away, the larger the margin of error.
4. Lidar - has not recieved judicial review in most states and is evidence that you can usually get thrown out. also subject to errors if the cop does not stay exactly on one part of your car as he pans to keep up with you. especially hard on handheld units. again you can get your ticket dismissed on lack of evidence for this.
so yeah, do your research, you might be able to beat a BS ticket liek this.

I don't know about AZ laws, but here in VA that would be considered a misdemeanor aka "Reckless driving" and if it's your first offense, you usually get it reduced to a "speeding" ticket...of course this is VA and not AZ. :keke:
I think you will be able to have the ticket reduced to something lower or even dropped since it's your first offense....ESPECIALLY if you have a lawyer.
As for the employer..as long as they don't recheck your record they won't question you.
charkid
03-01-2009, 09:57 PM
no idea if its the same in AZ as CA but fight it through a trial by declaration. ticketassasin has all the forms for you to use, just keep extending it until you cant anymore, then do a trial by declaration. pretty much you just copy and paste the template and add in your own account and mail it to the court. if the cop doesn't write his own declaration, then you win automatically. The good thing about this is that if you go to court to fight it and hope he doesnt show up, they usually will because they get paid overtime to show up. They however, dont get paid to write a declaration.
