Hey guys i got my car towed today and i didnt get any notice or anything stating that my car is in danger of being towed. It was sitting on the street for 3 months and someone complained but that is not why the code enforcement dude said he towed it. He said my car is a hazard because it was missing interior pieces and that he doesnt need a warning label. I did get my car back from the tow yard, but can i fight this and get my money back? And if i can how do i fight this? Do i have to go to court? This is some bullshit because it was sitting fine but since my car is "missing more than one component" its dubbed as hazardous and they had to tow it away no matter what anyone said or did.

sounds like a lot of bullshit to me but then again most of what code enforcement does seems that way to me anyway.

after Florida after we got hit by 3 hurricanes in like 2 months or something code enforcement came to my neighborhood (not a high income area) and tried to bust our balls because a massive trim piece partially fell (think hinge, its the part that comes down from the side of the house like an "L") on the side of our house. It had only been about 2 weeks since the hurricane and we had just finished taking a massive 40+ foot tree off of our roof, by hand, which just so happened to be the reason that the piece fell in the first place.

I'd say try to fight it, as long as you use logical reasons I don't think a judge wouldn't side with you, especially since as far as I know code enforcement HAS to warn you before they can do shit.

just for reference what exactly are you missing anyway?

Thats just it, i really have no idea what to research. I was missing my steering wheel which is a freaking quick release, also was missing front seats and some plastic pieces, and he said it was a hazard. Also i have an s14 dash in my s13 and he though it was stolen while i was waiving the title in his face.

Just to start go to the impound yard ASAP to get the car out! DON'T let it sit in the yard untill you figure out how to fight it! Impound gets VERY expensive VERY quick. You really should have followed the towtruck to the yard and gotten it out immediately. If they suspect that the car or some of the parts have been stolen then a detective will have to look it over and check all the numbers before you can get it out and it can be held for a month if they want to. A month of impound is over $1000!!! AFTER you get the car back home you need to talk to a lawyer and find out if there is even anything you can do. A lot of lawyers will look over your case for free so that you can at least find out if you have any reasonable chance of a positive result. Asking a bunch of dumbasses on an internet forum will get you nowhere. I think it is a bunch of bullshit, but I am nothing but another internet dumbass. Get the car out, like TOMORROW, and talk to a lawyer. The impound yard will be able to tell you what exactly is going on with your car and if a detective has to look at it you can call the automotive detectives and bug the shit out of them till they look at it. Before the car can be released, if a detective has to look at it, you need to go to the police station and get a release form filled out. Trust me about all this, my car got impounded because it had a different vin on the dash than it did on the chasis. They still impounded it even though the dash vin was from a car that I OWN, and they can legally arrest you just for tampering with the dash if it has a vin plate on it.

go the other route, look for any and all street signs, photograph them. photograph where the car was last parked.

play dumb and ask they court why the car was towed.
"why would my car be towed for no reason?"

let them start and you rebuttle

a lot of times if you come out firing, you'll end cutting your own throat by saying something you shouldnt of...i.e. its been sitting in the street for 6 months cuz i blew the motor...blah blah blah

GL with it.

i dont think a lawyer is necesary give it a go by yourself the first time around, dress sharp, be clean cut and speak to the judge only when spoken to, always a safe bet!

well i got my car out in 3 hours from when it got towed and i had shit missing in just 3 hours, they took my test light which was a snap on one and my god damn shrink tubing. I didnt even bother asking about that shit because they all looked shady as hell and i decided to move on with my life. But one thing bugs me is that the driver said there's a new law in cali that states they dont have to give you warning, a warning is just courtesy of the driver? What the hell?

They didn't give me a warning when they towed my car. I thought it got stolen until i called the cops.

they dont have to give you a warning per say.. but thats if it in a no parking zone, handicap, ect ect. they should have gave you a warning on this though. a hazard because of missing interior is a bunch of BS, wtf where they doin lookin in ur car in the 1st place?

anyways Loveskylines has his shit down +1 for good advise. id do exactly as he sugested but "you can lead a horse to water, but you cant make him drink" its your choice. good luck.

I parked my truck on the street for a couple of weeks periodically Id move it but I didnt for a period of 2 weeks maybe 3 but I always drove by the check it when i can home. One day it was gone so I was like fuck yea!!!!!! Money Money Money MONEY! Until I called the police and they told me it was not stolen it was towed. So I was like WTF you mean it was towed, well thier was a city ordinace that states no vehicle can be park in one spot no longer than 72 hours. If it was towed buy the city they have a reason. More than likely you broke some rule you were not aware of. And they do not have to warn you before hand.

it could be a scam.. i remember 20/20 did a segment on tow truck companies. some of these companies tow your car for no valid reason so they can charge you towing and impound fees. their line of business is slow, if people's cars don't break down or no one needs a car moved companies don't make any money, so tow truck drivers spend their idle time circling different blocks to find random cars to tow.

For example, if you're in a time limit parking for 30 mins and as soon as you walk into the store to get something they get to work. some tow trucks just follow cars like hawks, and as soon as people park and are out of sight, they tow your car to their impound lot.

sounds like the same type of scam. they fed you some bs excuse so they could tow your car and charge you tow and impound fees.

its against the law to have a car parked in the same spot for more than 72 hours resulting in a parking ticket and towing the car. i know it happend to me with the same situation. a dumb neightbor complained and called parking enforcement and took the car. check your tires for chalk. if it has than they were watching youre car. 45 bucks plus towing fees. pay it and be done with it.

Exactly. Any street. For any reason.

Also, a "non-functional" car cannot be parked on the street... it's gay, but that's teh lawzzz.

Yeah didnt really know about the 72 hour thing since it was parked right infront of my girlfriends house. And i had to pay 60 dollars to the city, plus 200 to the tow company..... that hurt my wallet a lot. Worst thing is i live in an apartment and have no place to store my car, so i have to keep moving it, its retarded.

funny story how he would do that because it was missing interior.

awhile back, my friend had the same situation, one of my friends went to another friends apartment to chill, he parked in someones spot and when he looked outside the window, he saw the tow truck about to tow his car, he tells his friend, and his friend tells him to go down there and tell him not to tow it, and if he has trouble he'll be down there in 2 minutes, so my friend goes down there and tells the guy hes gonna move his car and not to tow it, yadi yadi yadi, and the tow guy said no, and my friend gets pissed and tells him off like wtf, just let me move it, the tow truck guy didnt back off, so his friend comes down, and starts telling the guy down and the tow truck guy still didnt back off, so my friend lifts up his shirt with his pistol right there, and finally the tow truck guy "alright sorry guys, i dont want no trouble" and he leaves. HAHAHAHA.

i was so pissed but i thought about how much time and money it would cost to take them to court and its just not worth it. just learn from it and say FUCK IT.

No offense but if a neighbor of mine had his junker parked in the street for more than a few weeks I'd have it towed too. Most of you probably wouldn't understand unless you are home owners yourself it makes the neighborhood look like crap and yes it can drag down the property value, keep it in your driveway or garage.
