Are these shocks blown?

I am sure they are leaking, but when I showed the pictures to the manufacturer to see about a warranty claim, they told me they didn't think the shocks were leaking.

They are inverted shocks so the thingy at the bottom is the adjustement knob, it looks like that's where they are leaking from. The dark stuff is oily.

That's only one spot where they would be leaking from, and the least likely one at that. What do you see under the dust cover? Thats where the seals are.
