HELP!!!!-sold my car a year ago, guy never registered, towed

I had an 86 rx7 a while back, sold it a year ago to a guy, then today i get a call from my mom saying a towing/collection agency wants us to pay like 400+ dollars, because it towed, it is still in my name, he never registered it

i still have the dated, notarized, bill of sale with all his and my info on it

it got towed in a 954 area code, so im assuming its Broward County Florida

can anyone offer some advice? will the bill of sale clear me? anything? call the police?

Well, it might not end there- if its legally under your name that means YOU must have beefed it when you were supposed to send in the bottom section of the pink after you release liability, good luck man- at least you have a dated and signed contract, that will hold up in court for sure if it comes down to it. But this might be a narly headache for you...

just tell them you sold the car , to ________ on______ date and give them all of his info, and theyll ask you if you want to keep the car you can pay this much or surrender the car to them.

Umm, or you could buy the car back for 450$, Thats how I see it. So now you have the money the guy gave you for the car-450 and still have the car. That would be the obvious answer to me if the guy never registered it.

That release of liability thing must only be in California, because I have bought and sold cars in Indiana and Illinois and theres nothing like that on the title.

I don't see how it can affect you if you have the papers. However I left my car with a friend while in Iraq in 2006 during that time his roomate borrowed the car without telling anyone(so the story goes) and gets a parking ticket. April 2008 I get a final notice for $160. ticket. So I call and find out the story and thinking ok thats simple I was in Iraq with official paperwork to prove it right? Wrong I am responsible because its title in my name.


CA blows moral of the story(maybe your state also) call the DMV, city,tow or whoever to find the official word. Honestly the tow company is out to make the money but if you don't pay they will sell it eventually to re-coup. I'd ask the DMV since they will probably be more non-bais'd

Mississippi doesn't either, if you sell a car you just sign the title over and get a bill of sale. the bill of sale releases you from anything that happens after that date.

he cant legally go buy it back, if he does and the other guy still has the bill of sale he could just come pick it back up without paying the $450... just call them back and say "hey, i sold that car to so and so... if he doesn't come and pick it up you can keep it."

also with that bill of sale being notarized, it will definitely hold up in court... and why would a collections agency be involved? tow companies make their money off the cars if people don't pick them up... clean and clear if someone doesn't pay for the car they could get $100 for it at the crusher.

I guess this is common, because that is how they do it in NC as well.

At the end of it all, to the OP, the RIGHT thing to do would be to show them the bill of sale, providing them with the new owner's information.

You ARE well within your rights to pay the bill, get the car back and sell it again (or hell, even KEEP it), in my opinion.

Like mentioned, if you live 7 hours away and you don't want to pay the $400 to get it out of the impound, tell them you don't give a fuck and they can auction off the car. Whats it matter, I mean, you got your money for it so who cares.
