View Full Version : California Overtime Laws....Help

So I have been working for 8 days straight and I'm scheduled for the next 3. Now I know the basic over 8 hours is time and a half and I know about the seventh day rule but my question is... Does it continue on past that? I'd like to know because I want to know if my work tries to screw me or not. If you know please tell me and if you have a link that explains if time and a half continues past the seven day mark, please post it up for me.

but unless im reading this wrong, on the eighth day, you are supposed to be getting double pay. its 3AM and iono whats going on right now...

That's just one of my jobs. I have 2 and I clean fish tanks on the side. So if anybody knows anybody that has tanks and doesn't like to clean them let me know. Petco and Forever21 just aren't paying me enough. Lol

as far as I know... a week is a week. doesnt go on. but thats here in oklahoma. I get payed every week

I'd say it would depend on when ur company has the cut of on the payment.

after 40 hours is ot regardless. If you work Mon-Sun then Sat would be OT (if over 40 hours already) and Sun would be double time because it's your 7th strait day. Then, Monday it starts over.

I recommend getting a higher-paying job.

You can work half the time if you make double the money. Petco and Forever21 are not known for being great career choices.

In 1 day anything beyond 8hrs is time and a half. In a week anything over 40hrs (saturday) is a time and a half. Sunday will be a complete double over time day only if you worked the passed 6 days. If you didn't work on Saturday then Sunday will be time and a half.

If youre over your 40 hrs for the week already, its automatically time and a half. Once you hit over 8 hrs during that day, then its double time.

Lets not throw holidays in the equation at this point....

Damn, California has kick ass labor laws. Indiana and Illinois you can work for 39 hours in a day if it were possible and still get straight time for that day.

8hrs+ on one day is time and a half pay for the time past the 8th hour.

If you're 40hrs+ on one week then the extra hours are time and a half. Over time is only applied for the one week or your weeks pay. So regular weeks starts Sunday and ends Saturday. All pay weeks are different.

You can request a time log at your work by law to keep track of your hours. I do that all the time because at my work, they edit our times so it doesn't seem we passes 6 hours without a lunch, when we really did.

I'm not 100% about the 2x pay for the 12hrs+ shift. Too lazy to check and confirm. :jerkit:
