View Full Version : speeding ticket story and Q's, CA

today at noon time, i got a call from my brother who informed me that my house alarm went off and i should go home to check immediately as dispatch was sending squad cars to my house (my home got broken in once in 2003). so i ditched my class and tried to get home asap (15 miles away, 15-20 minutes driving). As i was passing a little town, Grand Terrance, I got pull over by a cop who claimed i was doing 54 at 40 mph zone. I apologized and told him exactly what happened, he took my ID and came back with a speeding ticket. I explained to him again that i did not mean to drive fast but it was an emergency situation. He didn't care much and said he already do me a favor by writing 50mph instead 54.

After i got home, i found my door that access from the garage to house was slightly open but nothing was missing in my house. I guessed it got blown open by the gusty wind because i didn't close tightly this morning when i left the house. 10 minutes later, Riverside sheriff arrived and checking around my house, i told those cops about my ticket and they even felt sorry for me with surprise. They thought only highway patrol would be like an ass like that.

So now my questions are:
1. If i contest in the court (i probably will get a ticket for false alarm and i can use it as evidence) for the emergency situation, will the judge dismiss my case? If not, what will happen if i lose? can i still go traffic school?

2. I tried to find errors in my ticket, and didn't find anything significant. only two possibles but i am not sure.
a. the cop recorded my "class" as "C" instead "CM1",
b. Another one is the "Race" section, he put down "OTHER". i am clearly an Asian with chinky eye.

speeding, in cali, in a 240, and youre asian?
you were bending over before you got in the car.
solution: start a career with the CHP or police department.
at any rate, id still take it to court and dispute the matter.

don't try to justify what you did
don't try to say you didn't do it either

DO say you did it but it wasn't illegal, then explain why. that's the key

also, do trial by written declaration instead of appearing in court

that is some interesting statements. i was speeding above speed limit, isn't it is clearly illegal? also, why a written declaration would be better than appearing in court? mind to explain a little bit?

i got a ticket for 65 in a 45

we've all heard that cops get bonus pay or whatever for showing up at your court date.

i've heard that they don't get bonus pay for fighting your written declaration, but i don't know for sure if that's the case. if it's true, then there's no incentive to bother with the paperwork.

besides, with trial by written declaration, you get to take your time with a well thought out statement, or just plagiarize a previously well constructed one.

basically, i stated that the weather was clear and dry, and it was daytime, and traffic was light.
then i stated that a speed survey had not been done on the road in the past 5 years, and therefore the posted speed was invalid. i didn't know if the speed survey had been done or not, but i tried anyway and it worked. you have to quote section numbers and everything. be thorough.

you have to pay the ticket up front, then they cut you a check when you win.

Here in MD it does. Went to court for some serious shit, cop did not show up, Got on the stand. Judge says Cased dismissed. Signed, and left thrilled knowing I had no points added, and did not have to pay a crazy fine.

Andrew, I appreciated your input!

my girlfriend also told me that she heard from radio that if i reschedule my court date in another county that is far away from the cop (i.e. LA county instead San Bernardino), very likely the cop would not show up. anyone has experience from that?

my friend got 2 speeding tickets both of them which he fought with trial by written declaration and won both times.

Yeah, I got a ticket for speeding one night 65-45 but the cop knew my Dad so he wrote it as 64 so I wouldn't get wreckless driving. The worst part is being a 17 year old driver, driving past midnight in Connecitcut becuase of the gay new law where you can't drive between 12-5am under the age of 18.

I got a Promise to Appear in Court, went and paid 150$ to a "charity" aka the damn police department and didn't get any strikes on my license.

Andrew makes a valid point. Trying to argue that you were not in the wrong will get you no where. Admitting what you did and why can help you out.

Cop not showing up works in NY I think. I got a summons for urinating in public on night in NYC. Went to the court date, cop wasn't there. The judge called me up and told me that I was free to go. Got away with no fine. sweet.
