this happened lastnight, it was a friends birthday, and they decided to go to dave and buster's. i stayed home, get a call from another friend, and he wants to kick it and drink somewhere. picked up a couple of friends, rolled out to this waterfront park, and we stayed inside drinking in the car. next thing you know a cop rolls up shining his light on us. we're like, "OH SHIT PUT THE DRINK AWAY!" forgot to put the cap on the bottle, the liquor started to leak, so now the whole car reeks. so cop gets all our info[id,etc], goes back to his car. one of my friend has 2 bench warrants, so he's basically fucked. friend got arrested, and the remaining 3 got curfew tickets.

i was wondering has anyone on zilvia gotten one of these before? if so how much is the ticket? i'm from oakland, california by the way. but thank god the cop let us go easily, i could've gotten my 2nd DUI for just sitting in the passenger side drinking. if the ticket is too much i would probably do community service. what a night, my friends told the cops we're just out of here drinking for chinese new years. :)

Unless 23 is your fake id age, then how could you get cited for curfew? IIRC curfew citations shouldn't be more than $75

no i am 23, the ticket was for being in the park at a closed time. on the ticket says, "12.64.110 omc park curfew." yeah it's pretty embarrassing, a f***ing park curfew ticket!

you sure they didn't give you trespassing tickets? and if they did, lol at you. around here if you don't reek of weed when they catch you in the park, they just tell you to leave.

oh, and it's also legal (here) for passengers to drink in a car. even if it's moving. just not the driver. yes, if i'm in the passenger seat, i can be drinking a 40 next to a cop at a stoplight. and he won't do anything.

i would take this ticket because he could have technically given you a DUI because you had the ability to drive a vehicle (you were in it drinking) and you had an open container...

it was thursday! i only goto clubs on fri & sat, usually every thursday we goto dave and buster's religiously, but it was just lastnight that i decided to not go and it was all bad. :doh:

I got one it was like 75 bucks. its not trespassing because its a public place and there are no gates or anything the park just has a curfew. The one by my house has a big gate to close it. the gate wasnt closed so i got out of the ticket by just saying we diddnt know that parks closed. You were drinking at a park which you arent supposed to do anyways so you will prbably be sol. Lucky for you they diddnt give you a drunk in public charge too

uhmmmm weird... haha 23 sitting ina car with some some dudes.. in a park... on thirsty thursday.. drinking.. GO TO THE BAR!! you drove to the park you could have driven to the bar and you guys would have saved yourselfs alot of money, and your friend who got arrested, could have saved him time and money haha. but ya the ticket should be too much if its over 100 id throw the bullshit flag on that one

Just pay the fee, problem solved. Don't think about it as $xx.xx that you are losing, think of it as money saved: 1) you don't have to pay thousands of dollars for the retainer for an attorney 2) you don't have to pay for classes 3) you still have your license and 4) you didn't have to pay to get your car out of impound. My friend just shelled out 5500 to try to get rid of a dui. That was just the attorney.

As far as open containers being legal in MO - of course everything is legal there when compared to CA. That horse is dead, why does everyone always have to keep beating it? Yes, we have smog. Yes, we can't smoke everywhere including hospitals and churches. True, we can't drink martinis riding shotgun. But what we do have outweighs those things by 10000000%. Sure, I'd love to buy a house for 50 grand. But I'd also like to make more than 5 bucks an hour. If California sucked so bad, more people would leave than are coming here. Mo' people mo' problems.

I was under the impression that open container law only applies if your under 21 or the car is started....Im pretty sure you can drink in a car with the keys not in the ignition....but then again drinking in public is illegal too, unless you guys were brown baggin it

Well, as you see I live in CT... I got pulled over for a 64 in a 45 and the cop gave me a Promise To Appear in Court, my court date is set to Monday. The shitty part is I could lose my license till I'm 21 if the prosecutors decide they want to slap the curfew law on me.

If you're drinking in the car the keys need to be a certain distance away from the car to avoid the open container wrath. At least that's what I heard a long time ago.

youd be suprised how many people have had their licenses taken away and havent or cant get them back yet. more than are willing to openly to admit.

I got one once when I was parked at my local park (South Gate) with my ex after getting something to eat from Jack in the Box. The curfew is 10:30pm and it was probably about 10:45pm when the same thing happened to me. My ticket was $50, but since I forgot to pay it, it turned into a $5000 warrant, which is fairly weak (I've had $25000 warrants before but don't ask lol). The ticket was due on a Friday and the following Tuesday I got pulled over IN FRONT OF MY HOUSE at gun point by a rookie cop. Needless to say, I was arrested, my car was towed (even though I parked it in front of my house), was taken to city jail, then the next day transported to the Men's Central Jail in Downtown LA because the judge decided that I hadn't done my time yet. Prick! For a $50 ticket! Just pay that shit. I've gotten pulled over before with a high ass warrant again in front of my house but the cop was cool and told me to take care of it.

Don't risk it, just pay that shit. I was pwned lol.
