My Car is Totaled!

I was in the middle of the intersection waiting to make a left turn. When the light turned yellowed I creeped a bit but someone ran that so I stopped completely and then it turned red. Oncoming traffic stop so I started to go. Then out of no where someone ran the red light and hit me. When I got out the car the guy said, "I live right here" (we were in hempstead, long island) and then ran away leaving his car. His car reaked of beer and there was a 24 pack of beer in his car and some of the cans were opened.

When the officer came I told him my story. I drew a blank and didn't know what to say. I told him the story and he's like "So you're telling me you ran a red light?" The cop was a total ass and made it my fault even though the guy ran and had beer in his car.

Later on that night when I got the police report he said it was my fault but he did include that the other driver fled the scene and did have open beer in his car. I pleaded with the officer that I did have the right of way but he refused to change his story. So luckily my dad is good friends with another officer so he is going to talk to this officer.

I don't have any pictures but the front is gone. I don't have a 240sx anymore and I'm sad. This was my first car, first accident and first lost :-(. Such a pain seeing my 240 on the tow-bed. Now my insurance is going to skyrocket and I'm 18 (It's under my name.) After this situation is fixed I'm going to look for another 240. I'm either looking for another white, maroon or black. White is my favorite for sure. I'm sad and I'll be emo for the next couple days. Cop was totally an ass :(

heres a lesson. let the police make their report, and you talk to a lawyer. police will use anything they can against you and dont factor in your still in shock and confused.

Thanks for putting that in paragraph form. It was easier reading it that way.

Good thing you learn at a young age how awful some officers can be. You do have to work on your story telling skills though. I believe you said some things that the officer didn't like and he just decided to pin it on you.

damn that so sad to hear another 240 gone that makes them so much more rare.. sad to hear this man hope you get back on your feet and build a nice 240 even better than your last man. hope things go better for you and listen to pwhitersxs cops are a pain in your taxes if anything like this happens again try to only tell them what you want them to hear you know they were just being dicks cause of the car you had.

All I want to know is what I have to do next and what is going to happen. This is my first time with this occurring. I'm using my dads car to go to school so should I get insurance under that car until I get another one? What's going to happen next? Can someone PLEASE fill me in with the process? Thanks for the help guys; I really appreciate it. It really pisses me off that my first accident has to be with a drunk guy who lives over 30 minutes away from the accident.

My car is at the tow-yard right now. It's being towed to my dads shop tomorrow as soon as possible. I mean I guess I can look at the bright-side. My next 240sx can be automatic because I have the 5 speed in my 240.

Well, limping, but I walked away.

Nothing broken.

Just a small cut on my finger and a swollen ankle from having it smashed in by the brake/gas pedals(both broke off and stabbed into my foot).

If the guy would've slammed into me just a split second later, I would've been a goner.

That beam right between the fender/door saved me.

To the OP, chances are, you'll get lucky with a new chassis that'll be cleaner than your last. Hope everything work out for yah.

By the way, the accident happened yesterday at around 4:20 pm. So I believe that I have till 4:20 today to call my insurance.

Cop already wrote it down as my fault and he refuses to change it. I have to call the insurance today too. My dad said if he doesn't change it; to amend it before I call insurance.

Hopefully the tow place will send it to my dads shop tonight because at the place of the accident they were like we'll just put it in my yard for now and wait for your dad to come. I was telling them my dads address and they were like no just wait for him to come. When he went to the yard shop we saw my car get pulled in (we arrived 20 minutes after accident) and then we went in there was nobody in site. We called the boss and he told my dad that he would just tow it tomorrow (being today) but he would charge us a holding fee. My dad was pissed but he saw it coming.

Heres the police report (I am MV#1; Other guy is MV#2. I'm writing it just as he wrote it...with caps in random places and everything):

MV#1 was W/B on Fulton Ave attempting to Make a Left Turn onTo peninSula Blvc S/W/B. MV#2 was E/B on Fulton Ave. MV#1 Failed to yield the right of way to MV#2 and came inTo collision with MV#2. MV#2 operator a Lg white Male with a beard and gray hair fleed the scene E/B on Fulton. Numerous open beer cans and odor of beer in MV#.

Thats where it stops. He didn't mention me being in the middle of the intersection or what color was the light. He didn't mention that the beer was in the other car. He just ended at MV#. Last night he refused to amend it. I understand he can't change it but by law he is suppose to be able to add information. My dad said he might have to get a lawyer involved if he doesn't change it.

Sorry to hear about your car man. I had a beautiful Datsun 280zxt and on my 18th birthday I totaled it =[ My insurance also went sky high it sucks. I know that Datsuns are alot cheaper to insure than 240's though so you might consider getting an early Z. I actually found a 240z that I'm driving now, and I like it better than my 280zxt. And at least you made it out of the car ok. Trust I know, cops are assholes to 18 year old kids haha I can't tell you how many points I have on my license because I was driving a sports car at the time.

holy shit that sucks so much man! atleast you had insurance. im yet to get into a car accident but my family insists on hitting my audi a bunch. i was walking to my front door to go take the car to my friend so he could buy it, and mybro was walking back in to tell me he just backed into my car( with an 06 f350 with 36's on it) well he scraped my front bumper. crushed my grill, dented the radiator, and took a chunk out of my carbon fiber hood. then i was backing up and sister came flying around the corner in my driveway and clipped my rear bumper destroying the bumper shock, putting a 5 inch crack in my rear valance and cracking my box in my trunk. and breaking some clips. ya, and i only had liability that right there is over 2500 worth of damage

Update:
Since the officer is off till tuesday, I can't get it amended until then. When I went to the insurance office it turns out that the other guy already filed a claim. I really want to know what he wrote down. So I really cannot do anything until tuesday
