I think it's a great idea. Whether you agree with the law or not, it is the law.

thats the point, its not "the Law".

its a violation of your civil rights. Just like road side sobriety checks are.

They need to have "cause" to pull you over, run your ID on the sidewalk, or search you here in the states.

SoCal is becoming more and more of a police state :(
and BTW, I would avoid BurBank area if you drive a tuner.

I got a ticket for modified exhaust at 8AM thursday morning on the corner of the court house. I showed the officers that I had my exhaust signed off at 3PM the previous wednesday, and they didnt care. popped the hood(its all stock SOHC), searched the car, threatened to have it taken and the engine and car vin#'s checked (after I told them the engine was a rebuild).
Then they proceeded to give me a ticket for no Tabs, (I have the red #1 paper in the window, exempting me from tabs till its finished registration), and a tint ticket.
3 violations, 2 of which i had proof they were fine right there!!
And law enforcement wonders why they put a sour taste in peoples mouth.

From what i have seen on these forums and the people i have talked to about how to get past emissions, having a tuner car with an exhaust is probable cause for a smog check.

Because a large portion of them aren't smog legal.

wow.. california has too much money.. they should donate some to our school districts..

Much of the waste in educational spending occurs at the county level, not the state. Arnold can shovel money into the educational budget all he wants, but if Supervisor X decides to give himself a raise every time, the kids are still screwed.

Multiple choice tests are also a collossal waste of time, but I disgress.

smog dyno are only rated for like 100 or 200hp, not a lot. It suppose to simulate runs from certain mph (25 iirc) and test for emission. My friend owns a shop and when the govt initial smog up in norcal, we sort of put a 400hp car on it for run, burnt out the motor and call the warrenty guy for repair.

this is such bull shit. If they're gonna do this then why do we have to have a MANDATORY smog check every 2 years. This is such a waste of tax payer money. Stop fucking with emissions stuff and get us out of debt, renovate our schools, get people off welfare. Shit.....

The article states that the CHP is stopping cars they "feel" might not pass emissions.

That is a stoppage and a search and temporary seizure and way, way too much discretion for individual officers.

Were I bar certified and a local community member, I would be inclined to challenge the legality of their scheme.

YUP! They are targeting probably less than 5% of the total air pollution in california with this program, and by that I mean gross polluters not cars in general. My car does pass. But it doesn't mean I am ok with my rights being violated, being harassed, wasting my time, having to sit there embarraesed while other motorist drive by and stare, and I bet I get harassed about other stuff once they have me over.

Thats why I usually start letting them have it as soon as they pull me over now days :) I also stop right after large driveway entrances so they have to block the exit entrance to stores or things like that :fawkd: It is awsome when they are trying to sweat me and people are honking at them to move, and all Im giving them is some "your profiling!! you dont even have a reason to pull me over, youv'e got no cause, that shit wont hold in court, your lucky I let you look at my license..." For all further arguing I refer you to read this thread.

1. Testing is NOT mandatory, you can refuse it. This has been stated 100x before. I think CARB even released a statement saying this to be true.

http://smogcheck.ca.gov/stdPAge.asp?Menu=/includes/Menu_GenInfo.htm&Body=/Geninfo/Factsheets/Roadside_Emissions_Survey-Jun_2007.htm

2. No citations are given, because how wrong is that that you volunteer to take this smog SURVEY and get cited for failing?

3. This is just SURVEYING, they're testing average cars and seeing who can and can't pass smog. If you fail they simply tell you how to fix it and send you on your way.

4. They've been doing this is the 909 for years.

They will continue to do this for YEARS more, in more counties, in more cities, more machines, and they'll ticket you and do whatever you want because why? Because NONE of us on this forum, or any tuner forum that gives a rats ass has ANY legal or financial power great enough to take on the CARB.

Why is it that we get picked on? Because we're young, dumb and have disposable income. Rhymes!

F.

I think it's a great idea. Whether you agree with the law or not, it is the law.

I've said it before and I'll say it again. You live in ATLANTA, GA.

That fact alone means you know NOTHING of what it's like to own a 240sx in California.

Also, that kind of attitude is SHIT. People with that kind of complacent outlook on law and government are the bane of this country's existence. You have this bull shit attitude of "Oh it doesn't affect me so it's a great law." Well what happens when they make a law outlawing something YOU love? You're just going to obey? Great. Enjoy your sad, empty life of submission. The rest of us meanwhile are going to fight injustice in whatever way possible.

Blah. Read that thread above. That pretty much sums my ideas up.

And no god damnit, I will not move. They could chase me around firing bullets at me. This is fucking CALIFORNIA. The greatest state in the country. I'll fight to the death to stay here because it is awesome and sunny and we have Horse Thief Mile.

**EDIT I just realized ProjectRDM is the same ass-clown I OWNED in that thread above. Hhahahaha don't you ever learn?

I remember reading that Florida has the highest per capita old people rate in the country, only beaten by some county in New Mexico or something.

and for you saying that California traffic sucks, I've never been there but on my way to school I hit rush hour like traffic at 9 o damn clock

plus I almost get hit virtually every day.

also, I think I may have multiple aneurysms and be at risk for a stroke

So sad. I now say fuck Florida for sure. I have never left cali in my life. I have had no reason to. Everything you could possibly need is here. You like hick white chics move to modesto, you like gangster chics move to fresno, you like asian chics, move to garden grove. But socal is where its at when it comes to cars. Yeah we pay tax on shit online but we can also pick it up most of the time. meets EVERY night. Rich older women(mid to late 30's) to be my sugar moma.Every type of food imaginable. The best taco shop in the world is in westminster. As for smog we just got to be smart about it.

No matter what you gotta pay to play and we pay a little more than the other states but we play a hell of a lot more than the other states.

Hands down we win.

And the terminator is our governor. +1 for that right lol

I think I would only move to Japan so When it comes to the u.s no one else can compete. I mean everyone foreign knows where california is. EVERYONE, that should tell you something

I just had some young people from china move in next door and I asked them why cali, why so cal. They said Its the only place worth it.

Naw, more profiling.

I took my proof of insurance out of my car after horse thief mile tis weekend and forgot to put it back in. So the tickets for no proof of insurance. (show proof at CHP monday, $10 fine, easy)

But on the freeway they passed me up alittle, and hit the brakes. then they paced me for over a mile. right next to me. I knew they were just looking for a reason then.
then they pulled behind me for another half mile. At this point, i have been pulled over so much in Ca, im just wishing they would hurry up and hit the lights.
once they got me over, they asked why i didnt have tabs. so i pointed to the red #1 paper taped to the window and told them that was my temp registration.

then they started asking me questions about my engine while shining a flashlight on the hood. the other cop during this 7 minute questioning is going around my car looking for violations with his flashlight.

finally they ran my info and had to settle on a no proof ticket.

Im getting tired of CHP and other departments making me pop the hood all the time, or asking me about my engine. then giving me a look like i am lying tothem. IT'S A BONE STOCK SOHC!!!!!
